New Milford NJ, Acting Bergen County Prosecutor Dennis Calo announced the arrest of Nicholas G. CLARK (DOB: 6/6/1996; single; and employed as a package handler) of 311 Hudson Drive Sycamore Gardens, Newark, Delaware on charges of Luring, Attempted Aggravated Sexual Assault, and Attempted Endangering the Welfare of a Child. The arrest is the result of an investigation conducted by the Bergen County Prosecutor’s Office under the direction of Chief Robert Anzilotti, members of the New Milford Police Department under the direction of Chief Brian Clancy, and members of the New Castle County (Delaware) Police Department under the direction of Colonel Vaughn M. Bond, Jr.
On April 9, 2019, members of the Bergen County Prosecutor’s Office Cyber Crimes Unit received information that a stranger was communicating online with a 12-year-old juvenile from New Milford, New Jersey. The ensuing investigation, led by the Bergen County Prosecutor’s Office Cyber Crimes Unit and the New Milford Police Department, revealed that since February 2019 Nicholas G. CLARK used a social media and chatting application to engage in sexually explicit dialogue with the 12-year-old juvenile and made plans to meet with the juvenile on April 5, 2019. The meeting was interrupted by a member of the juvenile’s family and the matter was reported to authorities. Detectives, now in control of the juvenile’s online accounts, had online conversations with CLARK. who again engaged in sexually explicit dialogue believing he was still speaking with the juvenile. CLARK also discussed plans to meet with the juvenile again.
On April 17, 2019, detectives from the Bergen County Prosecutor’s Office Cyber Crimes Unit travelled to Newark New Castle, Delaware and, with assistance from the New Castle County (DE) Police Department, executed a search warrant at Nicholas G. CLARK’s home.
As a result of the investigation, an arrest warrant was issued in the State of New Jersey on April 17, 2019 charging Nicholas G. CLARK with two counts of Luring, in violation of N.J.S.A. 2C:13-6A, a 2nd degree crime; two counts of Attempted Aggravated Sexual Assault, in violation of N.J.S.A. 2C:5-1(A) / 14-2A(1), a 2nd degree crime; and two counts of Attempted Endangering The Welfare Of A Child, in violation of N.J.S.A. 2C:5-1(A) / 2C:24-4(A)(1), a 3rd degree crime. CLARK was taken into custody on April 17, 2019 by the New Castle County (DE) Police Department pursuant to the New Jersey arrest warrant, posted $60,000 in bail, and was released by a Delaware judge pending extradition proceedings.
On Tuesday, May 14, 2019, Nicholas G. CLARK surrendered to detectives at the Bergen County Prosecutor’s Office in Paramus and remanded to the Bergen County Jail pending a first appearance and detention hearing in this matter.
Acting Prosecutor Calo states that the charges are merely accusations and that the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt.
