FIVE ARRESTED IN FAIRVIEW SHOOTING

Fairview NJ, Bergen County Prosecutor Mark Musella announced the arrests of CARLOS BURGOS (DOB 1/27/2000, single, unemployed) of 411 Martin Luther King Boulevard, Jersey City, NJ, and RAUL TORRES (DOB: 12/25/1999; single; and unemployed) of 1116 7th Street, North Bergen, NJ, on charges of Felony Murder, Murder, Conspiracy To Commit Robbery, Robbery, Unlawful Possession Of A Weapon, and Possession Of A Weapon For An Unlawful Purpose; DAVID MARTINEZ (DOB 6/5/2001, single; and unemployed) of 9022 Fulton Avenue, North Bergen, NJ, and LEXIE BURKE (DOB 1/26/1999, single, and unemployed) of 8615 Durham Avenue, North Bergen, NJ, on charges of Felony Murder, Conspiracy To Commit Robbery, Robbery, Unlawful Possession Of a Weapon, and Possession Of A Weapon For An Unlawful Purpose; and DYLAN RODRIGUEZ (DOB 4/5/2001, single, and unemployed) of 31 74th Street, North Bergen, NJ, on charges of Hindering Apprehension, Possession Of Marijuana With Intent to Distribute, and Unlawful Possession Of A Weapon. The arrests are the result of an investigation conducted by the Bergen County Prosecutor’s Office under the direction of Chief Robert Anzilotti and the Fairview Police Department under the direction of Chief Martin Kahn.

On Saturday, June 29, 2019, the Bergen County Prosecutor’s Office received information that a resident, later identified as David Duque-Soto, of 215 Fourth Street in Fairview, NJ was dead from apparent gunshot wounds. The investigation revealed that CARLOS BURGOS, DAVID MARTINEZ, LEXIE BURKE, AND RAUL TORRES went to the victim’s residence, with firearms, intending to steal drugs and money. During the commission of the robbery the victim was fatally shot. After the shooting, CARLOS BURGOS met with DYLAN RODRIGUEZ in North Bergen and gave him a firearm used in the murder. DYLAN RODRIGUEZ took the weapon and concealed it inside a private residence.

As a result of the investigation, CARLOS BURGOS was arrested on July 1, 2019 in West New York and charged with one count each of Felony Murder, in violation of N.J.S.A. 2C:11-3(a)3, a 1st degree crime, Murder, in violation of N.J.S.A. 2C:11-3(a)1/3(a)2, a 1st degree crime, Armed Robbery, in violation of N.J.S.A. 2C:15-1, a 1st degree crime, Conspiracy To Commit Armed Robbery, in violation of N.J.S.A. 2C:5-2/15-1, a 2nd degree crime, Possession Of A Weapon For An Unlawful Purpose, in violation of N.J.S.A. 2C:39-4a, a 2nd degree crime, Unlawful Possession Of A Weapon, in violation of N.J.S.A. 2C:39-5b, a 2nd degree crime. CARLOS BURGOS was remanded to the Hudson County Jail pending a detention hearing in Hackensack, NJ scheduled for Friday, July 5, 2019 at 9:00 a.m.

RAUL TORRES was arrested on July 1, 2019 in Paramus and charged with one count each of Felony Murder, in violation of N.J.S.A. 2C:11-3(a)3, a 1st degree crime, Murder, in violation of N.J.S.A. 2C:11-3(a)1/3(a)2, a 1st degree crime, Armed Robbery, in violation of N.J.S.A. 2C:15-1, a 1st degree crime, Conspiracy To Commit Armed Robbery, in violation of N.J.S.A. 2C:5-2/15-1, a 2nd degree crime, Possession Of A Weapon For An Unlawful Purpose, in violation of N.J.S.A. 2C:39-4a, a 2nd degree crime, Unlawful Possession Of A Weapon, in violation of N.J.S.A. 2C:39-5b, a 2nd degree crime. RAUL TORRES was remanded to the Hudson County Jail pending a detention hearing in Hackensack, NJ scheduled for Friday, July 5, 2019 at 9:00 a.m.

DAVID MARTINEZ was arrested on July 1, 2019 in North Bergen and charged with one count each of Felony Murder, in violation of N.J.S.A. 2C:11-3(a)3, a 1st degree crime, Armed Robbery, in violation of N.J.S.A. 2C:15-1, a 1st degree crime, Conspiracy To Commit Armed Robbery, in violation of N.J.S.A. 2C:5-2/15-1, a 2nd degree crime, Possession Of A Weapon For An Unlawful Purpose, in violation of N.J.S.A. 2C:39-4a, a 2nd degree crime, Unlawful Possession Of A Weapon, in violation of N.J.S.A. 2C:39-5b, a 2nd degree crime. DAVID MARTINEZ was remanded to the Hudson County Jail pending a detention hearing in Hackensack, NJ on Wednesday, July 10, 2019 at 9:00 a.m.

LEXIE BURKE was arrested on July 1, 2019 in West New York and charged with one count each of Felony Murder, in violation of N.J.S.A. 2C:11-3(a)3, a 1st degree crime, Armed Robbery, in violation of N.J.S.A. 2C:15-1, a 1st degree crime, Conspiracy To Commit Armed Robbery, in violation of N.J.S.A. 2C:5-2/15-1, a 2nd degree crime, Possession Of A Weapon For An Unlawful Purpose, in violation of N.J.S.A. 2C:39-4a, a 2nd degree crime, Unlawful Possession Of A Weapon, in violation of N.J.S.A. 2C:39-5b, a 2nd degree crime. LEXIE BURKE was remanded to the Hudson County Jail pending a detention hearing in Hackensack, NJ scheduled for Friday, July 5, 2019 at 9:00 a.m.

DYLAN RODRIGUEZ was arrested on July 1, 2019 in North Bergen and charged with one count each of Unlawful Possession Of A Weapon, in violation of N.J.S.A. 2C:39-5b, a 2nd degree crime, Hindering Apprehension, in violation of N.J.S.A. 2C:39-3(a)3, a 3rd degree crime, Possession Of Marijuana With Intent To Distribute, in violation of N.J.S.A. 2C:35-5a/5b(11), a 3rd degree crime. DYLAN RODRIGUEZ was remanded to the Hudson County Jail pending a detention hearing scheduled for Monday, July 8, 2019 at 9:00 a.m.

Prosecutor Musella states that the charges are merely accusations and that the defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt, and he would also like to thank the Fairview, Cliffside Park, North Bergen, West New York, and Jersey City Police Departments, and the Bergen and Hudson County Sheriff’s Offices for their assistance in this investigation.
