Responsible Planning Group Seeks Stay on January 31, 2025 “Affordable Housing” Deadline

Montvale NJ, the Local Leaders for Responsible Planning (LLRP) have filed a new request for a stay on the looming January 31, 2025, affordable housing deadline. Citing flawed rulemaking by the Administrative Director of the Courts (ADC) and the Housing and Mortgage Finance Agency (HMFA), the group argues that municipalities are being forced into compliance without adequate notice or opportunity to comment.

A hearing on this application will be held on January 23, 2025, presided over by Judge Lougy.

Key Concerns

The LLRP highlights several issues with the current process:

  1. Exemptions from Judicial Conduct Rules
    The ADC’s rules allow certain Affordable Housing Dispute Resolution Program members to bypass the Code of Judicial Conduct, which typically prohibits political activity and outside income.
  2. New Requirements for Fair Share Plans
    The ADC has imposed additional mandates for municipalities to adopt fair share housing plans, further complicating compliance with affordable housing obligations.
  3. Lack of Transparency in HMFA Rulemaking
    The HMFA issued nearly 200 pages of Fourth Round rules without public notice or comment. While HMFA claims to have consulted housing advocacy organizations through roundtable events, New Jersey municipalities were excluded from the process.

LLRP’s Commitment

The LLRP remains committed to challenging what they describe as a fundamentally flawed system or court ordered mandated over development.

“Under the law, New Jersey’s suburban towns must create four affordable housing units for every 10 people that move into an urban aid municipality such as Jersey City or Hoboken,” said Mayor Ghassali, a leading member of the LLRP.

He emphasized the group’s determination to pursue the case to the Supreme Court if necessary, adding, “We have a moral obligation to litigate this flawed approach, even if it takes us time to get there.”

    1. nice try fair share housing is a developer give away at taxpayers expense, not affordable about it except for the name
