Washington DC, legal showdown ends: Habba resigns to “Protect Stability” of NJ office . After a contentious, three-month legal battle over the legitimacy of her authority, which began after Habba had several Democrats arrested for trespassing at an ICE facility . Alina Habba the former personal lawyer to President Donald Trump, has resigned as the Acting U.S. Attorney for the District of New Jersey.

The resignation, announced by Habba on social media (X) on Monday, follows a pair of decisive federal court rulings that found her serving in the powerful position “without lawful authority.”

The protracted legal fight centered on the Trump administration’s efforts to keep Habba in the role—a position that typically requires Senate confirmation—after her 120-day interim term expired in July.

  • August Ruling: A federal judge first ruled she was serving unlawfully, disqualifying her from her role as New Jersey’s top federal law enforcement officer.

  • Appeals Court Upholds: Last week, the 3rd U.S. Circuit Court of Appeals unanimously upheld that decision, rejecting the Justice Department’s maneuvers to keep her in the post.

In her statement, Habba framed the decision as a necessary step: “As a result of the Third Circuit’s ruling, and to protect the stability and integrity of the office which I love, I have decided to step down in my role as the U.S. Attorney for the District of New Jersey.”

🚪 New Role: Senior Advisor to Attorney General Pam Bondi

While stepping down from the New Jersey prosecutor role, Habba is not leaving the Department of Justice. She will remain in the Trump administration, shifting her focus to a national advisory position.

Habba announced she will now serve as Senior Adviser to the Attorney General for U.S. Attorneys under Attorney General Pam Bondi.

It is not immediately clear what this new national role entails, but Habba’s comments suggest a broad focus on federal appointments across the country.

Quote from Habba on X: “But do not mistake compliance for surrender. This decision will not weaken the Justice Department and it will not weaken me… my fight will now stretch across the country.”

The Legality Debate: Why Was the Appointment Challenged?

The legal challenge to Habba’s authority gained traction after the federal courts questioned the administration’s use of novel legal maneuvers to bypass the traditional requirement of Senate confirmation—or a process where federal judges appoint an interim replacement.

The controversy caused significant delays and uncertainty within New Jersey’s federal court system, forcing judges to delay proceedings until clarity on the office’s leadership was provided.

Attorney General Pam Bondi publicly backed Habba, stating the Justice Department would continue to appeal the court rulings and expressed confidence that Habba could return to the role if the appeals are successful.

For now, the powerful federal prosecutor duties will be split among other career lawyers within the New Jersey office, returning a measure of stability sought by the courts.

  1. Time would be better spent picking a U.S. Attorney and ramming confirmation through the Senate.
