Bergen Catholic Parents Sue School Over Fight That Injured Their Son

Oradell NJ, a lawsuit filed Wednesday accuses Bergen Catholic High School of negligence, claiming the school failed to protect a student from being injured in a fight last year.

The parents of the injured student allege that inadequate supervision between class periods during the fall 2023 semester led to their son being attacked by another student. The lawsuit seeks $75,000 in damages to cover injuries, legal fees, and other costs.

Details of the Incident

The lawsuit claims that during the semester their son started attending Bergen Catholic, another student approached him from behind and instigated a physical altercation between classes. According to the suit, the lack of proper monitoring and supervision allowed the incident to occur, causing injuries to the student.

Legal Process and Damages

The case is being brought through a friendly hearing, a process often used when minors are involved in financial settlements. Under this arrangement, a judge oversees the distribution of funds to ensure they are held securely for the injured party.

The parents are seeking $50,000 for the student, $6,250 for themselves, and $18,750 to cover attorney fees. The suit, filed by Daniel Dugan and Natalia Kapitonova of the Stewart Lee Karlin Law Group, alleges the school “breached its duty” to provide a safe environment for students.

Bergen Catholic High School is represented by Kimberly Parson of the Rebar Kelly law firm. Parson did not provide a comment on the case as of Thursday afternoon.
