WASHINGTON D.C.—A major legislative effort to guarantee pay for active-duty military members and essential federal employees working through the ongoing government shutdown was blocked by Senate Democrats on Thursday.

The measure, known as the Shutdown Fairness Act of 2025, was sponsored by Senator Ron Johnson (R-Wis.) and would have immediately funded paychecks for critical workers. The bill failed on a mostly party-line 54-45 vote, falling short of the 60 votes needed to advance.

Who the Blocked Bill Would Have Paid

The Johnson-sponsored legislation was designed to alleviate the financial stress on personnel required to work without pay during the shutdown, specifically guaranteeing wages for:

  • Active-Duty Military Members: Ensuring the paychecks of service members remain uninterrupted.
  • Excepted Employees: Federal workers deemed “excepted” from the shutdown by their agency heads.
  • Emergency Workers: Employees performing essential emergency functions.

According to Senate Majority Leader John Thune (R-S.D.), this coverage would have included a wide range of critical personnel:

  • Transportation & Safety: Air traffic controllers and Transportation Security Administration (TSA) agents.
  • Law Enforcement: Federal law enforcement, Immigration and Customs Enforcement (ICE) officers, and Border Patrol agents.
  • Capitol Complex Staff: Over 300 congressional employees, including the U.S. Capitol Police.

The Crossover Vote: Three Democrats Break Ranks

While the vote was largely along party lines, three Democratic senators crossed over to support the Republican measure:

  1. Sen. Jon Ossoff (D-Ga.)
  2. Sen. Raphael Warnock (D-Ga.)
  3. Sen. John Fetterman (D-Pa.)

This break highlights the political tension surrounding the shutdown’s financial impact on core government functions and personnel.

Sen. Fetterman, along with Sen. Catherine Cortez Masto (D-Nev.) and Sen. Angus King (I-Maine), has also been voting with Republicans on separate attempts to fully reopen the government, demonstrating a growing frustration with the prolonged stalemate.

The decision to block the bill ensures that the pay issue remains tied directly to the broader budget fight, leaving thousands of essential workers—who are legally required to be on the job—to wait for retroactive pay once the government is fully funded.
