Washington DC, a federal appeals court on Friday reinstated the Biden administration’s vaccine-or-test mandate for businesses with at least 100 employees, a measure that impacts tens of millions of workers across the country.
The decision from the U.S. Court of Appeals for the 6th Circuit comes after the Biden administration asked the Cincinnati-based court in late November to reinstate its workplace vaccine mandate that was blocked by a court order.
The appeals court said in its Friday ruling that “based on the wealth of information” in its 153-page preamble that explains why the Occupational Safety and Health Administration (OSHA) issued an emergency temporary standard, “it is difficult to imagine what more OSHA could do or rely on to justify its finding that workers face a grave danger in the workplace.”
“It is not appropriate to second-guess that agency determination considering the substantial evidence, including many peer-reviewed scientific studies, on which it relied. Indeed, OSHA need not demonstrate scientific certainty,” the court continued.
The court said that it would be dissolving a stay issued by the U.S. Court of Appeals for the 5th Circuit in November as a result.
Friday’s 2-1 ruling by the U.S. Appeals Court for the Sixth Circuit allows for the Biden administration to enforce the requirement, though the battle is likely far from over. The case is expected to ultimately be decided by the Supreme Court.

What a clownish country we live in. A game of hot potato being passed from one court to another. Ladies and gentlemen get ready to rumbleeeeeeeee……………SC (it is in the hands of Mr. Kavanaugh now who I really doubt has the courage to do the right thing) will decide in favor of the mandate even though it makes no sense at all. And what is the logic behind the size of business, 100+? How is a business 99 and below different? Or is it just planned so 2 weeks after mandate approval “the prez” makes it mandatory for every living creature so we can “end” the “pandemic”?
If SC approves the mandate I won’t be surprised of forceful injections for the “dissenters”. Tragic times for this country.

This has always been a farce and will continue to be so. By getting the vaccine, I’m doing my, albeit small, part of perpetuating this nonsense.

It doesn’t matter. OSHA rule merely says employers have to vax or test. All employers have to do these things anyway to have a reasonable chance of re-opening their offices.
What the mandate will accomplish is more $ for useless government officials, pretending to help public health. And it will turn pro-vax Americans away from trusting government ever again. Every day these ppl realize that they are just as vulnerable, though thrice vac’d and boosted, as their unvax’s neighbors. A number of my friends recently realized this, even though just 6mo ago they were strongly in vax camp. Evil will lose in the end.
Dems made Covid the main talking point in their run up to the last election. Anyone not wearing a mask was a dumb Trumper. The problem is, since they somehow won, they now have to live with the impossible task of working with it. I guess the cheating side of the election strategy didn’t tell the Covid side, as the cheating was all they needed without having to create this situation where everyone is hiding under the bed covers.
What is going on in the village regarding employees that test positive, why are some charged there’s a time, and some are not. We have an interesting situation going on.
That’s what is going on, supposedly members of the police department that test positive were charged sick time. But other employees throughout the village were charged the time. We are not sure with the Law is Regarding sick time during Covid.

Suppose if that’s what we heard to Police Department was not charged sick time during the Covid outbreak. But others another department wore. We believe Governor passed the resolution law that no one will be charged sick time, and no one will be trouble if they do so. One law for all employees. Not different laws for different departments. That is illegal.

Ok to my friends and family. Governor Murphy, Signed legislation, (a3848) that no one should fear of retribution from their Employer. Stating that if you are sick, or have any symptoms of any kind of disease, flu, cold, please stay home. If any individuals being harassed .please call our hotline . New Jersey department of labor. And yes they do have people answering the phones.
