This move is particularly notable because Passaic is the only jurisdiction outside of California targeted by the agency for monitoring in this election cycle.
The DOJ’s stated goal is to “ensure transparency, ballot security, and compliance with federal law.” However, the decision has ignited a heated political debate, with the New Jersey Democratic leadership strongly opposing the intervention.
The Justification: A History of Voter Fraud Allegations
While Justice Department officials did not cite a specific reason for the Passaic County focus, the area—and particularly its largest city, Paterson—was the site of one of New Jersey’s most significant and contentious voter fraud cases in recent history.
The context for the DOJ’s decision includes:
- The 2020 Paterson Special Election: Five years ago, Democrat Paterson Councilmen Michael Jackson and Alex Mendez, along with others, were indicted on multiple counts of election fraud in connection with a May 2020 special election conducted solely by mail-in ballots.
- Ongoing Legal Battles: State Attorney General Matthew Platkin’s office filed expanded charges in October 2023 against Mendez, his wife, and campaign workers. Court documents allege the Mendez campaign destroyed mail-in ballots for opponents and replaced them with Mendez votes. The legal proceedings in this high-profile case remain a constant fixture in local headlines.
The New Jersey Republican State Committee, which formally requested the federal monitoring, has pointed to this “long and sordid history” of mail-in ballot issues in the county.
A Highly Inappropriate Intervention? State vs. Federal Conflict
The DOJ’s decision to send election monitors was made the day before the state’s in-person early voting began on October 25.
Acting New Jersey U.S. Attorney Alina Habba—whose appointment is currently being challenged in federal appeals court—defended the monitoring, stating, “Election protection means making sure every eligible voter can participate freely and every lawful vote is counted.”
However, State Attorney General Matthew Platkin, a Democrat, appearing to defend the states famed “culture of corruption” called the monitoring “highly inappropriate,” arguing it constitutes federal overreach into state responsibilities.
“The Constitution gives states, not the federal government, the primary responsibility for running elections,” Platkin stated, adding that the DOJ “has not even attempted to identify a legitimate basis for its actions.”
The placement of the federal staffers from the Civil Rights Division has not been made public, but their presence underscores the contentious political atmosphere surrounding this crucial statewide election.
Whether the federal monitoring ultimately ensures transparency or merely serves to fuel further political tensions remains the central question as New Jersey voters head to the polls.
