The Mystery Man Steps Into the Light
For over two years, the identity of the individual providing the State Attorney General’s office with audio recordings and detailed accounts of alleged wrongdoing remained a secret. However, during a pivotal court hearing on February 25, Cruz was revealed as the “star witness” who received criminal immunity in exchange for his grand jury testimony.
Immunity Sparks Legal Firestorm
The revelation has triggered a fierce debate in the courtroom. Defense attorney Paul Brickfield, representing Councilman Mendez, argues that the grand jury should have been informed of Cruz’s immunity agreement. Brickfield contends this information is “exculpatory,” suggesting that the witness’s motivations could clear his client of guilt.
Conversely, Deputy Attorney General Lisa Cialino maintains that the immunity deal was not exculpatory and that there was no legal requirement to disclose it to the grand jurors.
A Case Plagued by Delays
The election fraud case dates back to the all-vote-by-mail contest of June 2020, held during the early stages of the COVID-19 pandemic. Defense lawyers are currently pushing for a dismissal, citing New Jersey’s speedy trial requirements and the potential for “foggy memories” given the six-year gap since the events occurred.
Superior Court Judge Sohail Mohammed is expected to rule on these dismissal requests on March 9.
