TRENTON, NJ — Senator Jon Bramnick (R-21) has publicly voiced strong opposition to the Murphy administration’s proposed Department of Labor (DOL) rule change on independent contractors, warning it could have devastating economic consequences for workers, families, and small businesses across New Jersey.
“This rule change will drive small business owners out of New Jersey, plain and simple,” Bramnick said. “By misclassifying thousands of independent contractors as employees, the Labor Department would strip away the flexibility and freedom that make these professions possible. The result will be lost jobs, higher costs, and fewer opportunities for residents.”
At the center of the debate is the state’s plan to reinterpret the long-standing “ABC Test,” a standard used to determine whether a worker is classified as an employee or an independent contractor. If enacted, the change could reclassify thousands of professionals—including financial advisors, truckers, rideshare drivers, freelance creatives, and more— as full-time employees.
Critics argue that this move would not only burden businesses with higher payroll taxes and compliance costs, but also destroy the flexibility that makes contract work appealing.
According to a recent FSI–Oxford Economics study, the rule could push 65% of financial advisors to consider leaving New Jersey, resulting in the loss of 4,670 jobs and $470 million in GDP.
Bramnick joins a growing list of lawmakers and business leaders sounding the alarm, warning that the proposal could accelerate the outmigration crisis already plaguing New Jersey.
“This is about protecting choice, freedom, and opportunity for New Jersey workers,” Bramnick added. “We cannot afford policies that punish entrepreneurship.”
As the debate intensifies, the future of independent work in New Jersey could hang in the balance.
