Washington DC, a federal judge has declined to further delay the U.S. government’s “Fork in the Road” buyout program, allowing the initiative to move forward despite legal challenges from federal employee unions, who where fighting to hold onto union membership and dues.
Judge Rules Against Union Challenge
In a Wednesday ruling, U.S. District Court Judge George O’Toole determined that the unions did not have standing to challenge the program.
“The unions do not have the required direct stake in the Fork Directive, but are challenging a policy that affects others, specifically executive branch employees. This is not sufficient,” O’Toole wrote in his decision.
This ruling effectively allows the Biden administration to proceed with the buyout program, which offers eight months of pay and benefits to federal employees who choose to leave government service.
Program Details & Impact
🔹 At least 40,000 federal employees have already accepted the buyout, representing about 2% of the federal workforce.
🔹 The government had planned to end the offer on Feb. 6, but extended the deadline while awaiting O’Toole’s decision.
🔹 With the ruling, the window to accept the deal will soon close as originally planned.
Union Response & Next Steps
The American Federation of Government Employees (AFGE), the largest union involved in the lawsuit, criticized the ruling but vowed to continue the fight.
“Today’s ruling is a setback in the fight for dignity and fairness for public servants. But it’s not the end,” said AFGE President Everett Kelley.
AFGE attorneys are now reviewing legal options, emphasizing that the ruling did not address the lawfulness of the program itself.
What’s Next?
While the “Fork in the Road” program moves forward, unions may continue challenging it through other legal avenues. Federal employees considering the buyout must now make their final decisions quickly before the government closes the offer.
