Trenton NJ, A heated legal and political battle has erupted in Trenton as the New Jersey Assembly Judiciary Committee advanced a trio of controversial bills designed to block federal immigration enforcement within the Garden State.

While supporters call the legislation a “Safe Communities” initiative, critics—led by Assemblyman Bob Auth (R-Bergen)—argue the move is a direct violation of the U.S. Constitution and creates a dangerous rift between state and federal law.

The Bills: A “Sanctuary State” Expansion?

On Monday, January 5, 2026, Assembly Democrats moved forward with three key pieces of legislation (A6308, A6309, and A6310) that would significantly expand New Jersey’s existing pro-immigrant policies.

The package includes:

  • The Safe Communities Act (A6308): Creates “sensitive locations” like schools, hospitals, and courthouses where federal civil immigration enforcement would be restricted.

  • Privacy Protections (A6309): Limits the ability of state agencies to collect or share immigration status data.

  • Codifying the Trust Directive (A6310): Makes the state’s 2018 “Immigrant Trust Directive” permanent law, prohibiting local police from helping ICE with civil arrests.

Assemblyman Auth: “The Supremacy Clause Still Matters”

During a tense hearing, Assemblyman Bob Auth questioned the very foundation of the legislation. Auth read aloud the Supremacy Clause of the U.S. Constitution, which establishes that federal law takes precedence over state law when the two conflict.

“What specifically is causing the fear?” Auth asked a housing attorney during testimony. “If you’re here as a citizen, you go to court, you get equal justice, right? If you’re here as a resident alien, you get equal justice. So what is the problem?”

Auth argued that the New Jersey legal system already provides due process for everyone, and that the proposed laws address “misconceptions” rather than actual legal barriers. He warned that the state is overstepping its authority by attempting to regulate federal agents.

The Human Side of the Debate

Advocates for the bills, including the Fair Share Housing Center and Make the Road NJ, presented hours of testimony claiming that fear of ICE is driving families into the shadows.

  • Public Safety: Supporters argue that if immigrants are afraid to report crimes to local police for fear of deportation, the entire community becomes less safe.

  • Federal Raids: Advocates pointed to recent ICE activity in Newark and Woodbridge as proof that stronger state-level protections are needed to keep families together.

What Happens Next?

The bills passed the Judiciary Committee on a 4–2 party-line vote. However, the road ahead is far from certain:

  • Appropriations Committee: The package is scheduled for a hearing on January 8, 2026.

  • Gubernatorial Transition: While Governor Phil Murphy might sign the bills before leaving office, Governor-elect Mikie Sherrill has expressed skepticism toward similar “Immigrant Trust” legislation in the past.

  • Federal Conflict: The Trump administration’s White House has already signaled it will challenge any state laws that interfere with federal deportation efforts.

  2. I am sick and tired of Democrats kissing the ass of law breaking illegal immigrants in NJ. I busted my ass working all my life, paying taxes, paying for my own retirement, paying for my own medical insurance and never got a DIME from any government. My social security is around $1600 per month after deducting my medicare payment and my supplemental medical insurance is another 240 per month. Illegals get on the average $3000 per month, sect 8 rent, EBT, free health care. I guess when you give illegals a driver license, and it ‘serves as a voter registration’ you get more Democrats.
    I see something wrong with this
