DOJ Files Landmark Lawsuit Against Harvard: $2.6 Billion in Federal Funding at Risk Over Antisemitism Claims

CAMBRIDGE, MA — In a historic legal move, the U.S. Department of Justice (DOJ) has officially filed a lawsuit against Harvard University, alleging systemic race and national origin discrimination against Jewish and Israeli students.

The lawsuit, filed in the U.S. District Court for the District of Massachusetts, claims Harvard violated Title VI of the Civil Rights Act of 1964, a federal law that prohibits discrimination in any institution receiving taxpayer funds.

The Allegations: “Deliberate Indifference” and Selective Enforcement

The Justice Department’s Civil Rights Division argues that since October 7, 2023, Harvard has allowed a hostile environment to flourish, failing to protect students from harassment, assault, and intimidation.

According to the complaint, the University failed in two primary areas:

  • Widespread Hostility: Harvard allegedly remained “deliberately indifferent” to a level of campus hostility so severe it drew national attention and Congressional inquiry.

  • Selective Rule Enforcement: The DOJ claims Harvard refused to enforce its own campus conduct codes against mobs that occupied buildings and “terrorized” Jewish and Israeli students.

Washington Weighs In: Statements from the Administration

Top federal officials have signaled that this case is a cornerstone of the administration’s commitment to civil rights enforcement on campus.

Secretary of Health and Human Services Robert F. We hold Harvard accountable on the principle that antisemitism has no place in any program funded by the American people.”

The $2.6 Billion Stakes

The lawsuit isn’t just about policy changes; it’s about the massive flow of federal money to the Ivy League. Harvard is currently slated to receive over $2.6 billion in active grants from the Department of Health and Human Services alone.

The DOJ is seeking to:

  1. Compel Harvard to fully comply with Title VI.

  2. Recover taxpayer funds that were accepted while the university was allegedly in violation of federal civil rights law.

A Failed Reform Effort?

While Harvard has made public commitments to address “anti-Israeli bias” and antisemitism, the Office for Civil Rights (OCR) found these proposed reforms insufficient. “OCR required concrete action, not assurances,” stated Director Paula M. Stannard, commending the DOJ for moving toward litigation.
