Trenton NJ, In the largest consumer protection settlement since the Big Tobacco agreements of the 1990s, Meta Platforms, Inc. has agreed to pay up to $17.1 billion and implement strict new youth protection features across Instagram and Facebook.

Disclosed in court filings during a federal trial in Oakland, California, the landmark agreement resolves claims brought by 47 states, the District of Columbia, and U.S. territories. State attorneys general alleged that Meta engineered addictive platform features, collected minor data without parental consent, and misled the public regarding mental health risks to children and teens.

Key Financial Details of the Settlement

  • Total Payout Range: Meta will pay a guaranteed minimum of $12.1 billion over 10 years. The total can reach $17.1 billion if competing platforms (such as TikTok, YouTube, and Snapchat) adopt similar child-safety standards.

  • State Allocations: New Jersey, which co-led the bipartisan multistate investigation, will receive between $525 million and $752 million from the youth safety deal.

  • Data Privacy Resolution: Meta separately agreed to pay over $460 million to resolve additional data-privacy claims tied to third-party user data sharing leading up to the 2016 election, with New Jersey receiving over $20 million from that resolution.

Mandatory Youth Safety & Platform Changes

Subject to final court approval, the agreement mandates comprehensive redesigns to how Meta operates accounts for minors on Instagram and Facebook:

  • Daily Screen Time Limits: Imposes a combined 2-hour daily limit on Facebook and Instagram, featuring automatic breaks after 15, 60, and 90 minutes of continuous use for 5 years (dropping to 60 minutes if peer platforms adopt equivalent terms).

  • Nighttime Access Blocks: Restricts access for youth accounts between 12:00 a.m. and 6:00 a.m.

  • School-Hour Notifications: Limits push notifications on weekdays from 8:00 a.m. to 3:00 p.m. during the academic school year.

  • Social Comparison Restrictions: Limits features tied to youth mental health concerns, including beauty filters and visible public “like” counts.

  • Safety & Parent Controls: Enhances age-verification procedures, simplifies parental controls, and strengthens safeguards against cyberbullying, eating disorder content, and self-harm material.

  • Independent Audits: Requires independent third-party audits to monitor Meta’s implementation and compliance for state review.

Industry Impact & Response

Led by state attorneys general including Jennifer Davenport (NJ), Rob Bonta (CA), Phil Weiser (CO), and Russell Coleman (KY), the lawsuit argued that internal research documented mental health harms while public warnings were withheld.

In an open statement following the settlement, Meta urged competitors TikTok and YouTube to join state attorneys general in adopting these standardized youth protections to ensure broader industry accountability.
