Ridgewood NJ, the Ridgewood Board of Education President Mike Lembo used the Sommerville-Hawes Dads Night email list to send out a promotional email for his Ridgewood Board of Education campaign in volition of the and ban on political activity by 501(c)(3) organizations.
Each election cycle, the IRS reminds 501(c)(3) exempt organizations to be aware of the ban on political campaign activity. The IRS published its most recent reminder in a public news release which you can read here.
The division within the IRS responsible for overseeing churches and charities is the Tax Exempt and Government Entitities Division. TEGE has created a webpage entitled Charities, Churches, and Educational Organizations – Political Campaign Intervention. It is dedicated to the IRS most recent activities related to 501(c)(3) and political activity.
A definitive court case on the issue of free speech and political expression is Branch Ministries Inc. versus Rossotti PDF. In that case, the court upheld the constitutionality of the ban on political activity. The court rejected the plaintiff church’s allegations that it was being selectively prosecuted because of its conservative views and that its First Amendment right to free speech was being infringed.
The court wrote: “The government has a compelling interest in maintaining the integrity of the tax system and in not subsidizing partisan political activity, and Section 501(c)(3) is the least restrictive means of accomplishing that purpose.”

Let us be very clear, the DN organization did not endorse or lobby for any candidate. There are about 10 emails a day that come from that email list (on topics ranging from plumber recommendations to giving away used sports equipment to selling cars) and there is no implication in any way that an email coming from that list is endorsed, supported or advocated by DN. The IRS rules are related to advocacy or promotion of a candidate by a 501C3 which did not occur in this case.
I agree that we should question the decision by the candidate to send the email but it is irresponsible to criticize the organization without having all the facts.

We live in a town where anything goes at this point. VOR-Mayor gives $47K mortgage loan to his friends Richard Brooks and Gail Price. Not allegedy, signed and sealed by another member of Ridgewood’s community. Nothing is done. Brooks is still Chair of Parks and Rec and Gail Price is the partner of the lawfirm representing the giant billboard planned for Route 17. Again no action taken. People know they can get away with whatever they want and nothing is done. That is the example that is being set for the next generation. Read it and weep.
