“What is Cory Booker hiding? Cory Booker pontificates about fairness and transparency, but the people of New Jersey want action, not vapid, hollow rhetoric. New Jerseyans have had enough of liberal politicians who think they are better than everyone else. If Cory Booker really believes in fairness and transparency, he will take the time to make sure that his city complies with the New Jersey Open Public Records Act as soon as possible, and not a day after the special election.”

METUCHEN, NJ – Steve Lonegan, Republican candidate for the United States Senate, spoke out today about the city of Newark’s lack of cooperation with an Open Public Records Act (OPRA) request. A similar request was made for Mayor Lonegan’s records as mayor of Bogota, and was answered promptly as required by law (see attached document).

Lonegan said, “When a mayor spends the people’s money, he or she ought to be accountable to the public. New Jersey law requires that these records be available upon request.”

The Lonegan campaign requested seven types documents from the city of Newark, relating to Newark as a whole and Cory Booker’s expenses as mayor. After unilaterally extending the deadline to August 14th, the day after the Democratic Primary, Newark did not even meet its self-granted deadline.

On August 15th, the Lonegan campaign received an email from the city of Newark, complying with the requests about Newark in general but completely ignoring the requests about Cory Booker’s expenses as mayor.

The Lonegan campaign has still not received an answer regarding those documents.

The Democratic Senatorial Campaign Committee thought it proper to have Lonegan’s expenses as mayor as potential ammo in this race. A review of the documents led to the following reply from the Bogota Clerk’s Office:

Mayor Lonegan had a tiny office which barely fit a desk and a chair; he had no employees, no per diem expenses, no travel, car, phone, credit card receipts, office expenditures; no cell phones; no computers and for several years, he refused payroll compensation for himself.

Lonegan served as Bogota Mayor for twelve years, winning three times in a town that gave Barack Obama 67.5 percent of the vote in 2012. He served for seven years as state director of Americans for Prosperity New Jersey, where he helped defeat liberal attempts to expand big government. Steve Lonegan is the conservative Republican candidate in the New Jersey special election for the United States Senate. Lonegan stands firmly on the bedrock conservative values of small government, fiscal responsibility and individual liberty.

The National Security Agency paid millions of dollars to cover the costs of major internet companies involved in the Prism surveillance program after a court ruled that some of the agency’s activities were unconstitutional, according to top-secret material passed to the Guardian.

The technology companies, which the NSA says includes Google, Yahoo, Microsoft and Facebook, incurred the costs to meet new certification demands in the wake of the ruling from the Foreign Intelligence Surveillance (Fisa) court.

The October 2011 judgment, which was declassified on Wednesday by the Obama administration, found that the NSA’s inability to separate purely domestic communications from foreign traffic violated the fourth amendment.

While the ruling did not concern the Prism program directly, documents passed to the Guardian by whistleblower Edward Snowden describe the problems the decision created for the agency and the efforts required to bring operations into compliance. The material provides the first evidence of a financial relationship between the tech companies and the NSA.

The intelligence agency requires the Fisa court to sign annual “certifications” that provide the legal framework for surveillance operations. But in the wake of the court judgment these were only being renewed on a temporary basis while the agency worked on a solution to the processes that had been ruled illegal.

Yesterday, President Obama announced his plan to make “college more affordable, tackle rising costs, and improve value for students and their families.”

But a big part of the President’s plan includes creating a college rating system—a federal scorecard—to evaluate colleges on measures such as graduation rates, the number of low-income students served (i.e., the percentage of Pell Grant recipients), graduate earnings, and affordability.

Scorecards are a seductive idea. But having the federal government issue scorecards to measure college output would be a mistake. Four problems with the President’s plan:

1. Government says what’s best. As we wrote yesterday in National Review Online, for one thing, a monopoly government scorecard would inevitably reflect what bureaucrats—rather than parents, students, and scholarly communities—determine is or is not important in education.

2. Special-interest institutions with more clout could shape the standards. Existing institutions that are comfortable within the cocoon of protectionist accreditation would lobby hard, and no doubt effectively, for output measures that define success in their own terms.

3. Standard-setters would also control college funding. Educational institutions’ lobbying becomes particularly problematic when considering the second part of President Obama’s proposal: to then tie federal student aid to the new rating system by giving larger Pell Grants and lower student loan interest rates to students who enroll in colleges that fare well on the federal scorecard.

The logical outcome is a system that has the federal government handing out subsidies based on a rating system designed by the people handing out the funding. What could possibly go wrong?

4. We already have scorecards. A competing range of private outcomes-based scorecards already exists, sponsored by such outlets as U.S. News & World Report, Forbes, ACTA, and Kiplinger’s. Each of these reflects the differing visions of quality held by different Americans, from post-graduation salary to the likelihood of a well-rounded education. A one-size-fits-all federal rating system is unnecessary and will likely trump these independent evaluators that parents and students have long trusted.

If the Obama Administration truly wants to “shake up” higher ed and bring down college costs, it would acknowledge that federal government intervention is the problem, not the solution.

Continuing to increase federal subsidies enables universities to raise tuition. Since 1982, the cost of attending college has increased 439 percent—more than four times the rate of inflation. Increases in college costs exceed increases in health care costs, which have risen more than 250 percent over the same time period. Economist Richard Vedder argues that “some of these financial aid programs have contributed mightily to the explosion in tuition and fees in modern times.”

The key in education reform is to do things that improve students’ learning. A federal college scorecard gets an F on all counts.

Republicans in the United States House of Representatives and Senate claim they will vote to defund Obamacare, but they won’t actually fight for it. What they want to fight for is just a delay of the individual mandate. That’s it. But there is so much more that is so much more onerous about Obamacare. Delta Airlines, in a letter it prepared back in June, outlined just how onerous Obamacare would be to the airline.

In the past twenty-four hours, during my radio show in Atlanta, numerous Delta employees called in to tell me Delta is now telling its employees their healthcare will be radically changed because of Obamacare. A handful of them said the June 2013 letter from Delta to the Obama Administration is being circulated among employees.

The letter is stunning. According to Delta, in 2014 Obamacare will cost the company at least $38 million in direct costs and that is only the beginning. With added medical inflation, Delta claims “the cost of providing health care to our employees will increase by nearly $100,000,000 next year.” A $100 million increase thanks in large part to Obamacare and ancillary cost increases derived therefrom. Yes, I have the letter. From the letter:

The ACA requires large employers to pay an annual fee of $63 per covered participant in 2014. For Delta’s roughly 160,000 enrolled active and retired employees and their family members, this represents more than $10 million added to the cost of providing health care next year. As we discussed, this fee, which is meant to help stabilize the state exchanges as they get started, provides absolutely zero direct benefit to our participants. It is, essentially, a direct subsidy from us and our employees to those who participate in the exchanges.

A Department of Homeland Security employee who works on, among other things, the procurement of guns and ammunition for U.S. Immigration and Customs Enforcement, spends his nights and weekends preparing for a coming race war and advocating for anti-gay causes, according to a new report from the Southern Poverty Law Center. Meet Ayo Kimathi, a.k.a. “the Irritated Genie,” who told his bosses at the DHS that his anti-white, anti-gay site, “War is on the Horizon,” was just an entertainment site that sells concert and lecture videos.

You see, DHS employees, even those with office jobs like Kimathi’s, have to get outside activities approved by their supervisors, according to the SPLC. Kimathi’s former supervisor told the watchdog group, which tracks hate speech and groups in the U.S., that despite her former employee’s banal description of his extracurricular activities, the actual content of the site left her “stunned.” She continued: “To see the hate, to know that he is a federal employee, it bothered me.” She added that had Kimathi’s site been accurately described to the agency, there’s no way the DHS would have signed off on it. Possibly to keep his bosses from looking up his work, Kimathi used only the site’s acronym, WOH, in his permission request. In addition to his involvement in the purchase of ICE supplies, Kimathi also had a public profile for the agency, speaking at vendor events. As “Irritated Genie,” Kimathi also has a public profile as a black supremacist advocate.

At the Paramus Park mall, it seems, if the moms are happy, everyone is happy. On Tuesday, however, the moms were unhappy about the news that an old-fashioned carousel that has kept generations of children amused for nearly 40 years has twirled its last tot.

“‘Meet me at the carousel’ cannot be said anymore,” said Caren Fassbender, the mother of a 2-year-old and a frequent visitor to the mall, which has carved out a niche as Bergen County’s mom-friendly shopping center. “It was a Bergen County icon.”

The small, 18-seat ride – the Golden Horse Carousel — was shut down Tuesday, and will be removed from the mall within the next two weeks, said Minnie Adams, the mall’s manager. She said Paramus Park did not renew carousel’s lease, and the mall plans to temporarily use the space it occupied for its Santa Claus station during the holidays.

The ride’s operators began telling customers last week that the carousel was leaving Paramus Park.

Citing concerns about privacy and government surveillance, Pamela Jones is shutting down her siteGroklaw, which for years took on what she and vocal fans saw as wrongheaded legal action in the tech domain.

“There is now no shield from forced exposure,” Jones said in final blog post Tuesday. Groklaw depended on collaboration over e-mail, “and there is now no private way, evidently, to collaborate.”

Jones, a paralegal, started her site a decade ago taking on the SCO Group’s legal attack on IBM and others involving Linux and Unix intellectual property. She rebutted the company’s position, detailed the arcana of the lawsuit proceedings, and shared legal filings on which the case rested. Volunteers attended some hearings in person, and collaborative efforts found just any hole that could be poked in SCO’s case. The site archives show hundreds of posts since its start in May 2003.

As SCO’s case fizzled, Groklaw directed its righteous indignation toward other legal cases, including the storm of patent infringement cases in the tech world, digital rights management, open-source licensing, and Psystar’s Mac clones.

In an e-mail, Jones said Groklaw won’t disappear, though activity on the site will.

WASHINGTON — Born in Canada to an American mother, Ted Cruz became an instant U.S. citizen. But under Canadian law, he also became a citizen of that country the moment he was born.

Unless the Texas Republican senator formally renounces that citizenship, he will remain a citizen of both countries, legal experts say.

That means he could assert the right to vote in Canada or even run for Parliament. On a lunch break from the U.S. Senate, he could head to the nearby embassy — the one flying a bright red maple leaf flag — pull out his Calgary, Alberta, birth certificate and obtain a passport.

“He’s a Canadian,” said Toronto lawyer Stephen Green, past chairman of the Canadian Bar Association’s Citizenship and Immigration Section.

The circumstances of Cruz’s birth have fueled a simmering debate over his eligibility to run for president. Knowingly or not, dual citizenship is an apparent if inconvenient truth for the tea party firebrand, who shows every sign he’s angling for the White House.

“Senator Cruz became a U.S. citizen at birth, and he never had to go through a naturalization process after birth to become a U.S. citizen,” said spokeswoman Catherine Frazier. “To our knowledge, he never had Canadian citizenship.”

The U.S. Constitution allows only a “natural born” American citizen to serve as president. Most legal scholars who have studied the question agree that includes an American born overseas to an American parent, such as Cruz.

The Constitution says nothing about would-be presidents born with dual citizenship.

Detractors have derided Cruz as “Canadian Ted,” saying he can’t run for president because he wasn’t born on U.S. soil.

Cruz, a Harvard-trained lawyer and former clerk for the U.S. chief justice, disagrees. He reasserted last week that being an American by birth makes him eligible.

Sen. Rand Paul (R-Ky.) on Sunday called for a Supreme Court review of the constitutionality of the National Security Agency’s top-secret surveillance programs, arguing that congressional hearings and new safeguards announced by President Obama might not be sufficient to ensure privacy rights.

“I think the constitutionality of these programs needs to be questioned, and there needs to be a Supreme Court decision that looks at whether what they are doing is constitutional or not,” Paul told “Fox News Sunday.”

The Washington Post reported this week that the NSA broke privacy rules or overstepped its legal authority thousands of times per year, according to an internal audit revealed by former defense contractor Edward Snowden.

Paul blasted the administration in light of the revelation, saying President Obama “fundamentally misunderstands the constitutional separation of powers.”

Judging

Atlas Shrugged Essay Contest

The winning applicant will be judged on both style and content. Judges will look for writing that is clear, articulate and logically organized. Winning essays must demonstrate an outstanding grasp of the philosophic meaning of Atlas Shrugged. Essay submissions are evaluated in a fair and unbiased four-round judging process. Judges are individually selected by the Ayn Rand Institute based on a demonstrated knowledge and understanding of Ayn Rand’s works. To ensure the anonymity of our participants, essay cover sheets are removed after the first round. Winners’ names are unknown to judges until after essays have been ranked and the contest results finalized. The Ayn Rand Institute checks essays with Ithenticate plagiarism detection software.

Rules

No application is required. The Contest is open to students worldwide, except where void or prohibited by law.

Entrant must be a 12th Grader, College Undergraduate, or Graduate Student. To avoid disqualification, mailed in essays must include a stapled cover sheet with the following information:

your name and address;
your e-mail address (if available);
the name and address of your school;
topic selected (#1, 2 or 3 from list above);
your current grade level; and
(optional) the name of the teacher who assigned the essay, if you are completing it for classroom credit.

Essay must be no fewer than 800 and no more than 1,600 words in length, and double-spaced.

One entry per student. No purchase necessary to win. Essay must be postmarked no later than September 17, 2013, no later than 11:59 PM, Pacific Standard time.The Ayn Rand Institute has the right to provide contest deadline extensions when deemed appropriate.

Essay must be solely the work of the entrant. Plagiarism will result in disqualification. Essays must not infringe on any third party rights or intellectual property of any person, company, or organization. By submitting an essay to this Contest, the entrant agrees to indemnify the Ayn Rand Institute for any claim, demand, judgment, or other allegation arising from possible violation of someone’s trademark, copyright, or other legally protected interest in any way in the entrant’s essay.

Decisions of the judges are final. Employees of the Ayn Rand Institute, its board of directors and their immediate family members are not eligible for this contest. Past first-place winners are not eligible for this contest.

All entries become the property of the Ayn Rand Institute and will not be returned.

Winners, finalists, semifinalists and all other participants will be notified via e-mail by November 28, 2013.

Winners are responsible to provide their mailing addresses and other necessary information under the law in order to receive any prizes. Contest winners agree to allow the Ayn Rand Institute to post their names on any of ARI’s affiliated websites. The winning first place essay may be posted in its entirety on any of these websites with full credit given to the author. Winners will be solely responsible for any federal, state or local taxes.

Australian researches have found a way to improve the hydrating qualities of beer, without compromising on taste. By adding electrolytes to the amber ale, the researchers from a Queensland university may even have found a way to avoid a post-drink hangover.

SAY goodbye to the dreaded Monday morning hangover, thanks to researchers from a Queensland university who have discovered it may be possible to improve the hydrating effects of beer.

Since the beginning of time,  it seems sipping on a frosty cold beer has been a necessity on a scorching hot day. This can be counter-intuitive at times, given alcohol actually increases dehydration and leads to drunkenness, risky behavior and eventually, the hangover.

However, researchers from Griffith University’s Health Institute may have answered every Australians prayers. They have found that by adding electrolytes, a common ingredient found in sports drinks, and reducing the alcohol content could make a beer more refreshing than ever.

As part of the study the Institute manipulated the electrolyte levels of two commercial beers, one that was regular strength and one that was light. They then gave those two beers to volunteers who had been heavily exercising just before consumption to test their fluid recovery.
