Paramus NJ, Bergen County Prosecutor Mark Musella announced the arrest of AVERY FOOTE (DOB: 01/22/1988; married; employed as a security guard) of Paramus, NJ on charges of Aggravated Assault and Endangering The Welfare Of A Child. The arrest is the result of an investigation conducted by the Bergen County Prosecutor’s Office under the direction of Chief Robert Anzilotti and the Paramus Police Department under the direction of Chief Kenneth Ehrenberg.
On Tuesday, October 8, 2019, an infant was transported by ambulance to Hackensack University Medical Center for medical treatment after the baby appeared to be in distress. The infant had sustained a skull fracture, a broken rib, a broken wrist and had a retinal bleed, all of which were indicative of physical trauma. An investigation by the Bergen County Prosecutor’s Office Special Victims Unit and the Paramus Police Department revealed that the child’s biological father, AVERY FOOTE, intentionally caused the injuries.
As a result of the investigation, on Thursday, October 10, 2019, AVERY FOOTE was charged with one count of Aggravated Assault, in violation of N.J.S.A. 2C:12-1b(1), a 2nd degree crime; and one count of Endangering The Welfare Of A Child, in violation of N.J.S.A. 2C:24-4A, a 2nd degree crime. FOOTE was remanded to the Bergen County Jail pending a first appearance in Central Judicial Processing Court in Hackensack, NJ.
The infant victim is presently at Hackensack University Medical Center in stable condition. Prosecutor Musella states that the charges are merely accusations and that the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt, and he would also like to thank the Paramus Police Department for its assistance in this investigation.
