Judge Rules Towns “Lack Standing” to Protect Their Own Borders

Montvale NJ, the “Garden State” is at a breaking point. For decades, New Jersey’s suburbs have been defined by quiet streets and local control. But a recent, devastating legal ruling has signaled what many residents fear is the “Death of the Suburbs.”
Montvale Mayor Mike Ghassali said on Facebook,
“We are disappointed the District Court refused to consider our meritorious challenge to Mount Laurel by claiming its mandates do not harm taxpayers and elected officials. We look forward to bringing this to the Third Circuit Court of Appeals”
In late 2025, Mercer County Judge Robert Lougy dismissed a major lawsuit brought by a coalition of 27 New Jersey municipalities. These towns were fighting to overturn the 2024 Affordable Housing Reform Law, arguing that the state’s relentless “Fair Share” mandates are destroying local communities, enriching developers, and driving up costs for everyone.
The Ruling: Towns “Lack Standing” to Protect Their Own Borders
On September 30, 2025, Judge Lougy issued a decision that effectively silenced the 27 towns involved in the challenge. Despite the towns’ arguments that the state is imposing unfunded mandates, the court ruled that the law is technically “voluntary”—even though towns face aggressive “Builder’s Remedy” lawsuits if they don’t comply.
Key Ruling Details:
- The “Standing” Trap: The judge found that towns lacked legal standing to challenge the law because it falls within the legislature’s power to enforce the Mount Laurel Doctrine.
- Dismissed with Prejudice: The state-level case cannot be refiled, leaving towns with fewer options to stop the bulldozers.
- The Involuntary Reality: While the court calls it voluntary, local leaders argue the “threat of litigation” makes it anything but.
