Allendale NJ, In a move that has sent shockwaves through the nation’s capital, a federal grand jury in the Eastern District of North Carolina has officially indicted Allendale native ,former FBI Director James Comey. The charges stem from a social media post that federal prosecutors allege constituted a credible threat against the life of President Donald J. Trump.
The Charges: 18 U.S.C. § 871 and § 875(c)
The indictment, announced by U.S. Attorney W. Ellis Boyle, levels two serious felony counts against the 65-year-old former law enforcement chief:

Threatening the President (18 U.S.C. § 871): Alleging Comey knowingly made a threat to take the life of or inflict bodily harm upon the President.

Transmitting a Threat in Interstate Commerce (18 U.S.C. § 875(c)): Alleging the transmission of a communication containing a threat to injure another person.
If convicted on both counts, Comey faces a maximum penalty of 10 years in federal prison.
The Evidence: The “86 47” Instagram Post
The core of the government’s case centers on an incident from May 15, 2025. Prosecutors allege that Comey posted an image to Instagram depicting the numbers “86 47.”
While Comey has previously suggested the image—reportedly seashells arranged on a beach—was a political message, the Department of Justice argues otherwise. In the indictment, officials state that a “reasonable recipient” would interpret the post as a serious expression of intent to do harm. In political slang, “86” is often used to mean “to get rid of” or “cancel,” while “47” refers to Donald Trump’s status as the 47th President.

Acting Attorney General Todd Blanche emphasized the gravity of the charges in a press release:
“The temperature needs to be turned down, and anyone who dials it up and threatens the life of the President will be held accountable.”
FBI Director Kash Patel added that Comey’s former position makes the actions even more egregious, stating that as a former Director, Comey “knew full well the attention and consequences of making such a post.”
What’s Next for James Comey?
This marks the second time Comey has faced legal hurdles in the past year, following a previous indictment in Virginia that was ultimately dismissed. However, this new case in North Carolina focuses specifically on threats of violence rather than administrative or congressional misconduct.
As the case moves to the Western District of North Carolina for prosecution, legal experts are already debating the First Amendment implications of the “true threats” doctrine versus protected political speech.
