I agee with Jefferson that this document should evolve as society evolves.
The evolutionary process for the constitution is built into it.
It’s called the constitutional amendment process (see Article 5).
Yes, it should be able to evolve by means provided for it to do so in the Constitution, not by judges’ and politicians’ whims (i.e., via Constitutional Amendment). Don’t ask a judge to determine if he/she thinks society has “evolved” — that does not demonstrate that society has evolved, it merely shows that that the particular judge’s opinion has “evolved” (and I’m not using the word “evolved” in a positive or negative way — I just mean “changed”).
