Creamer-Sanzari suit against NJDOT over road work goes to court

The contractors who said they could not complete the Route 3 bridge project before the Super Bowl without an infusion of cash from the state are suing the New Jersey Department of Transportation for money they say they are owed on an unrelated project nearby.

Creamer-Sanzari — a joint venture of the major construction contractors J. Fletcher Creamer & Son Inc. and Joseph M. Sanzari Inc. – sued the transportation department a year ago over a project at Route 120 and Paterson Plank Road. The job involved widening Route 120, redecking two bridges, and making improvements to the road surface, traffic signals, sidewalk and drainage, among other work.

The contractors said in the suit that when NJDOT opened up the project to bidders in 2008, there was concern that the target completion dates were not realistic given the amount of time that utilities would need to relocate infrastructure.

“The bidders questioned how the project could be completed in 22 months when the utility relocations of PSE&G alone, exclusive of notice periods, required 44 months of work,” the lawsuit said.

“NJDOT essentially told the bidders not to worry,” the lawsuit contended.
