“No Probable Cause”: The FBI Washington Field Office (WFO) Speaks Out

Palm Beach, Florida, A massive crack has appeared in the official narrative surrounding the 2022 raid on Mar-a-Lago. Explosive new documents obtained by Judicial Watch reveal that high-ranking FBI field agents explicitly warned the Department of Justice (DOJ) that the search of Donald Trump’s home was legally unsound and lacked the necessary probable cause.
The 207-page document dump, uncovered on April 21, 2026, paints a picture of a federal agency at war with itself, with investigators on the ground being “rebuffed” by a DOJ seemingly determined to execute a high-profile raid despite internal objections.
The records, part of the counterintelligence investigation codenamed “Plasmic Echo,” include internal emails that expose a deep rift between FBI agents and DOJ leadership.
On July 13, 2022—weeks before the raid—FBI field agents explicitly stated they did not believe a search warrant was justified. Instead, they urged the DOJ to work through Trump’s attorneys to recover documents.
“WFO does not believe… that we have established probable cause for the search warrant at Mar a Lago,” one email reads. “DOJ has persistently disagreed.”
Key Findings in the Judicial Watch Records:
-
The Scope was Too Wide: Agents argued there was no justification to search Trump’s personal office or bedroom, citing a lack of “recency” and failure to distinguish between general boxes and actual classified information.
-
A “Counterproductive” Fixation: FBI staff warned that the DOJ’s five-week “fixation” on obtaining a search warrant actually delayed the recovery of records.
-
Disregard for Optics: While the FBI requested a “professional, low-key” approach to ensure the safety of the team, DOJ officials allegedly dismissed these concerns. One official, identified as Mr. Toscas, reportedly stated he “frankly doesn’t give a damn about the optics.”
Coordination with the Biden White House
The documents also highlight direct coordination between the FBI, the DOJ, and the Biden White House Counsel’s Office as early as May 2022. This coordination included the targeting of Trump aide Walt Nauta for interviews, raising fresh questions about the “independent” nature of the investigation.
Furthermore, the records suggest that the investigation may have been spurred by outside political influence. A February 2022 report shows that the left-wing advocacy group Citizens for Responsibility and Ethics in Washington (CREW) sent a letter to the DOJ that helped kickstart the probe into the former President’s record-keeping.
Director Wray vs. The Field Agents
Perhaps the most striking revelation is the disconnect between FBI leadership and the rank-and-file. The day after the raid, FBI Director Christopher Wray sent a bureau-wide email claiming the FBI “does not cut corners” and “does not play favorites.”
However, the internal case files show that his own Washington Field Office had already formally disputed the legal basis for the raid before it ever occurred.
“These documents show the FBI knew there was no probable cause, yet Biden’s Justice Department pushed forward with an abusive raid,” said Judicial Watch President Tom Fitton. “This is a historic abuse of power.”
Comparison: FBI vs. DOJ Stance on Mar-a-Lago
| Issue | FBI Field Agent View | DOJ Leadership View |
| Probable Cause | Not established; legally insufficient. | Fully established; authorized search. |
| Method of Recovery | Cooperate with Trump’s lawyers. | Forceful execution of search warrant. |
| Search Scope | Limit to storage; exclude residence/office. | Wide scope including office and bedroom. |
| Public Image | “Low-key” to protect safety/optics. | “Doesn’t give a damn” about optics. |
Why This Matters in 2026
As the legal battles surrounding the 2022 raid continue to echo through the halls of Congress and the courts, these documents provide the most significant evidence to date of internal dissent within the federal government. For many, this confirms long-held suspicions of a “weaponized” DOJ overriding the professional judgment of career FBI investigators.
