How Asset Forfeiture Allows Cops to Steal from Citizens
A Virginia lawmaker takes on policing for profit.

In September Rep. Scott Garrett (R-NJ), Chairman of the Congressional Constitution Caucus, and Rep. Tony Cárdenas (D-CA), Co-Chairman of the bipartisan Crime Prevention and Youth Development Caucus, today introduced H.R. 5502, the Fifth Amendment Integrity Restoration (FAIR) Act, to protect Americans from having their property seized without the due process of law.  The FAIR Act makes a number of changes to civil asset forfeiture laws to restore the constitutional protections guaranteed by the Fifth Amendment.

The FAIR Act would ensure that Americans are innocent until proven guilty by requiring the government to meet a higher legal standard before seizing an individual’s property.  This legislation would raise the standard to seize assets from a preponderance of evidence to a higher standard of clear and convincing evidence.  In addition, the FAIR Act would eliminate the practice of equitable sharing and eliminate all profit incentives by requiring that all funds seized by the federal government go into the general treasury fund.

It probably seemed like a bright idea at the time: Let the police seize the ill-gotten gains of alleged drug dealers and other suspected criminals and sell it, using the proceeds to buy much-needed crime-fighting gear.

Unfortunately, the process—civil asset forfeiture—did not require convicting anybody of a crime. In fact, it didn’t even require charging anybody with a crime. Not surprisingly, this led to rampant abuse, which has been abundantly documented for many years. Various reform efforts, including a 2000 federal law, have been unable to stop what’s become known as policing for profit.

But Virginia lawmaker Mark Cole is going to give it another shot. That’s as good a sign as any that civil asset forfeiture has jumped the shark.

You can’t get much more conservative than Cole, a Republican who represents Spotsylvania in the General Assembly, without falling off the edge of the political spectrum. Cole supports “traditional family values” — so much so that he voted against appointing a Richmond prosecutor and former Navy pilot to a judgeship because he was gay. Cole has sponsored legislation to deny government benefits to illegal immigrants. And to strip state funding for abortions even in cases where the fetus has “gross and totally incapacitating physical deformity or mental deficiency.” And to rewrite a state prohibition against guns in schools so private schools could set their own rules. Four years ago, he sponsored a bill to protect people from having microchips implanted in their bodies, in part because such microchips might be used as the “mark of the beast” described in Revelations.

On his website, Cole boasts of supporting law enforcement. “Public safety and emergency services are Mark Cole’s top priorities,” reads a quote from Stafford County Sheriff Charlie Jett. “He helped ensure that funding was available for pay raises for deputies and state troopers. He has been a strong voice for us in Richmond.”

But policing for profit has gone too far, even for Cole. In anticipation of the 2015 legislative session, he already has filed a bill (HB 1287) that would forbid asset forfeiture without a conviction—and even then only after all appeals have been exhausted.

Bergen County Freeholders are expected to vote on a resolution at their Oct. 22 meeting that would likely fund a $100,000 parking study in the village.

Several Ridgewood business owners have claimed that the village’s metered parking lots are full by 9 a.m. Most spots are taken by commuters and employees, leaving no spaces for downtown shoppers, they said.

The village has been in talks with the Bergen County Improvement Authority (BCIA) for more than a year about a partnership that would ideally result in the county building a 450-space parking garage at the site of the Hudson Street lot, where there are currently only a couple dozen 12-hour metered parking spots.

The county would own and operate the garage, which the village would pay for over the course of 20-30 years from the revenue from the garage.

To put the plan into motion, the freeholders and the county executive both need to sign off on the transferring of funds from the county’s planning department to the BCIA through the approval of the resolution.

To that end, Mayor Paul Aronsohn invited Freeholder Chairman David Ganz, who sets the agenda for the freeholder meetings, to Ridgewood last Tuesday to view the Hudson Street lot and observe the parking challenges in Ridgewood.

Scott Gerami says he’s always “had a passion for gadgets and technology,” and after 26 years in real estate, he’s still looking for an edge to make his listings stand out in a crowded marketplace.

Over the past year, the REALTOR® and managing broker of RE/MAX in Naperville, IL, has been tinkering with a camera-equipped drone aircraft to make his real estate photography really soar.

Folks in the Chicago suburb shouldn’t be alarmed if they see Gerami standing outside a home with a control panel, piloting one of his do-it-yourself flying machines overhead.

The intrepid Gerami is not alone. According to The New York Times and Chicago Tribune, the next trend in real estate photography is being deployed in increasing numbers to capture new angles on high-end homes for sale.

While regulatory issues on these unmanned aircraft are still being sorted out, the birds-eye views are enticing to agents such as Gerami. “I’m looking for unique ideas to set myself apart,” he said.

After watching one of Gerami’s drone-driven videos, you’ll get a sense of how the next wave in real estate photography is taking flight. He first built a couple of “rough and crude” devices “from the ground up,” but he’s continued to make refinements that have allowed him to explore new ways of deploying his flying machine.

He said his latest model, his fourth, cost him about $1,200 to build.

DALLAS — The man who has become the first Ebola patient to develop symptoms in the United States told officials at Texas Health Presbyterian Hospital last Friday that he had just arrived from West Africa but was not admitted that day because that information was not passed along at the hospital, officials acknowledged Wednesday.

The man, Thomas E. Duncan, was sent home under the mistaken belief that he had only a mild fever, a hospital administrator said; the information that he had traveled from Liberia, one of the nations at the heart of the Ebola epidemic, was overlooked.

Mr. Duncan came back to Texas Health Presbyterian Hospital on Sunday and was admitted for treatment, but in those two days in between, his contacts with a number of people — including five schoolchildren and the medics who helped transport him to the hospital — potentially exposed them to Ebola, forcing officials to monitor and isolate them in their homes and to begin a thorough cleaning of the schools the students attended. Mr. Duncan is now in serious but stable condition.

DALLAS — Parents rushed to get their children from school Wednesday after learning that five students may have had contact with the Ebola patient in a Dallas hospital, as Gov. Rick Perry and other leaders reassured the public that there is no cause for alarm.

The patient, identified by The Associated Press as Thomas Eric Duncan of Liberia, arrived in the U.S. on Sept. 20 to visit family. Dallas County Health and Human Services Director Zachary Thompson said county officials suspect that 12 to 18 people may have had contact with Duncan.

“Right now, the base number is 18 people, and that could increase,” he said. Thompson said more details are expected by Thursday afternoon. The number includes five students at four schools, Dallas school district Superintendent Mike Miles said.

“This case is serious,” Perry said during a news conference at Texas Health Presbyterian Hospital Dallas, where Duncan is being treated. “Rest assured that our system is working as it should. Professionals on every level on the chain of command know what to do to minimize this potential risk to the people of Texas and of this country.”

Miles said Dallas school officials learned Wednesday morning that five students at four schools — Tasby Middle, L.L. Hotchkiss Elementary, Dan D. Rogers Elementary and Conrad High — had come in contact with Duncan. Lowe Elementary is also being watched because it connects to Tasby.

PARCC testing is supposed to be more about the child’s facility with using a computer than his or her knowledge of the subject matter being tested. This is untested, seat-of-the-pants, thrown-together Obamacare website territory we will be in, and there will be a huge blowback. Fifth graders in particular need to be ready for anything, given that their standardized math scores for this year constitute the first 1/7th part of the rubric that determines whether they are ranked in the top 10 percent of their middle school in math at the end of sixth grade. If they are not so ranked, they will be prevented from taking Algebra in 7th grade and will be exposed to the Constructivist CMP math curriculum during all of 7th and 8th grade. This will stunt their growth at a critical time, and will eventually seriously limit their ability to compete for acceptance to a top notch school of engineering or science upon graduation from high school. CMP math in the middle schools is ‘the one that hot away’ about six years ago during the most recent battle in Ridgewood’s protracted Math War.

Springs Charter Schools in Temecula, Calif., not only had a problem with “The Hiding Place,” they also took issue with any other book that was written by a Christian author or included a Christian message.

“We do not purchase sectarian educational materials and do not allow sectarian materials on our state-authorized lending shelves,” Superintendent Kathleen Hermsmeyer wrote in a letter to attorneys at the Pacific Justice Institute (PJI).

“The Hiding Place” is a best selling book written by Holocaust survivor Corrie ten Boom, a woman who even after living in a concentration camp made it her life’s work to help rehabilitate other survivors.

I had the opportunity to talk with my friend Alter Wiener (a Holocaust survivor who wrote his own book about his personal story surviving the Nazis) and here’s what he had to say about the ban:

The papers or TV do not bring good news. Violence, corruption, prejudice are on the top of the news. I am saddened and frustrated and feel like reading something uplifting. I had been inspired reading The Hiding Place twenty years ago. The book came to my mind now when I am eager to find a source of light in the darkness. While reading it, for the second time, I gained a respite from exposure to the disparaging current events. Being riveted to The Hiding Place, I am hiding ephemerally from the ominous world.

In today’s modern culture selfishness prevails, youth show no respect for the elderly. The ten Boom family’s moral conduct is the antidote to the corrupted people in today’s society.

As a Holocaust survivor, I just don’t understand how somebody wishes to ban a book such as The Hiding Place that has a message of love and compassion, and banned the book because of its Christian message of love and tolerance.

In addition, the Pacific Justice Institute has threatened to take legal action if the ban isn’t reversed, citing that is a violation of the 1st Amendment. Perhaps the school can just reverse the ban and allow the readers the freedom to choose what they want to read.

Schools around North Jersey are wielding a new weapon in the fight against teen drug and alcohol use: the parents’ pledge.

Dubbed the Safe Homes Pledge, it’s part of a nationwide movement that asks parents to sign an agreement committing themselves to providing adult supervision for parties in their homes, securing prescription medication, and not serving alcohol to any guest under the age of 21.

Among the North Jersey towns and school districts where parents have participated are Ramsey, Ridgewood, Ramapo Indian Hills Regional High School District, Northern Highlands Regional High School, Pascack Hills, Ringwood, Wayne and Wanaque. The names of parents who have signed the agreement are then listed in a local directory.

Now, parents in the Northern Valley Regional School District are being asked to take the pledge.

The initiative is the latest step in a wide-ranging campaign by the Northern Valley community to fight alcohol and drug use.

Ridgewood NJ, A Ridgewood Panel says lack of parking is the source of problems in downtown Ridgewood , but in readers offered many other ideas .

While parking is often mentioned , many felt the issue has been long over played. Readers said store hours , types of stores and restaurants , rents , taxes and Ridgewood’s over bureaucratic non responsive regulatory environment pose significant problems for businesses. It seems Ridgewood has gotten a very anti business reputation.

Readers also questioned the lack of comprehensive planning  , spot zoning, ad hoc development, and a lack of efforts by the Chamber to promote new business in town .

Readers though the panel was a bit self serving , and said “What a bunch of self serving greedy people lead by a councilman who is a narcissi . The article shows how much the Ridgewood News is on board with this. These greedy people using words such as “stigma,” “that Ridgewood is asleep.” “that Ridgewood has lost its edge.” “Some similarly jarring points were made” “When you drive into this town, I don’t want to say it the wrong way, but it looks kind of dumpy… -” Thanks.

“Sarceno, a Ridgewood resident, said he wanted to attract anything other than a restaurant into the historic building, but he couldn’t.“It was amazing to see the lack of interest from anyone other than a restaurant,” he said.

Mr. Sarceno did you expect a Gap or a JC Penny to go in there. We all know what you did. You bought that building at a discount and then you go to your friend on the Council and push for a parking garage on Hudson St which would make the bank building more attractive for renters not to mention charging higher rent.”

Most readers would like the down town developed in a sensible fashion , but after years of Valley Hospital looking to ram their expansion down the Village’s throat and the constant barrage of over the top ridiculous claims by developers and politicians  the public has grown very suspicious and these actions and they have severely undermined Village leadership .
The fact is no one in Ridgewood wants to live in Hoboken ,other wise they would just move there . Whats needed is an honest assessment  as to whats best for the Village  and far less self aggrandizing from developers and politicians looking out for the own interests .

Home prices in North Jersey rose in August, as sales across the United States slowed and sales of luxury homes increased, according to data released by RealtyTrac on Thursday.

For New Jersey, the median price for homes sold in August was $285,000, an increase $13,000 from last month.

Bergen County sales in August remained steady with a median price of $425,000, an increase of $1,000 from the same period last year. Passaic County sales also remained unchanged from July at a median price of $265,000. It was a $3,500 drop from last year.

Nationally, residential properties sold at an annual pace of about 4.5 million in August, down a half a percentage point from July and 16 percent from last year. The decline marks the fourth consecutive month where sales decreased on a year-over-year basis.

Despite the slowing pace, the median price of the properties sold in the U.S. rose 3 percent to $195,000 from July and 15 percent from last year. It is the highest price since August 2008.
