Texas Senator Ted Cruz Vows To Argue Pennsylvania Challenge Case Before US Supreme Court

Mike Kelly, R-Pa., and others contend state officials had no right under the Pennsylvania Constitution to expand mail-in voting in 2019, and the state Supreme Court was wrong to uphold that statute. The group called it “an unconstitutional, no-excuse absentee voting scheme.”


“Pennsylvania’s General Assembly exceeded its powers by unconstitutionally allowing no-excuse absentee voting, including for federal offices, in the election,” the challengers argued in court papers. As a result, the election was “conducted illegally.”

The group seeks an emergency injunction from the nation’s highest court to block the completion of any remaining steps in the state’s certification of Pennsylvania’s 2020 election results, which took place last week. The petition was submitted to Associate Justice Samuel Alito.

While some Republicans are reportedly shying away from publicly supporting President Donald Trump’s claims of widespread election fraud, Senator Ted Cruz is running toward the fire, so to speak.

The Texas Republican said Monday he will help plaintiffs in Pennsylvania argue their election fraud case before the U.S. Supreme Court if justices accept it, which is not a certainty at this point.

Because of the importance of the legal issues presented, I’ve publicly urged #SCOTUS to hear the case brought by Congressman Mike Kelly, congressional candidate Sean Parnell & state rep. candidate Wanda Logan challenging the constitutionality of the POTUS election results in PA.

Petitioners’ legal team has asked me whether I would be willing to argue the case before #SCOTUS, if the Court grants certiorari. I have agreed, and told them that, if the Court takes the appeal, I will stand ready to present the oral argument.

As I said last week, the bitter division and acrimony we see across the Nation needs resolution. I believe #SCOTUS has a responsibility to the American People to ensure, within its powers, that we are following the law and following the Constitution.
