The lawsuit alleges that Microsoft and OpenAI utilized the newspaper’s articles to train artificial intelligence chatbots without obtaining proper permission.
These large language models scour online information to assist AI platforms in generating human-like text or images. The Times asserts that a dataset supporting OpenAI’s ChatGPT-3 contains at least 16 million unique records sourced from its publications. Furthermore, the Times expressed concerns that such platforms could potentially redirect traffic away from its website, leading to decreased revenue from advertising and subscriptions. Specific examples highlighted in the lawsuit exhibit instances where both ChatGPT and Microsoft’s Browse With Bing reproduced content nearly identically from the Times. Additionally, the filing illustrates how ChatGPT can bypass the newspaper’s paywall upon request.
In a similar vein, OpenAI is also facing a lawsuit from notable novelists like George RR Martin and John Grisham.
