Ridgewood’s Observer Corps stays on top of local government

New Ridgewood Council Gets Down to Village Business

Donna M Rolando , Staff Writer, @Dmmrolando6:59 p.m. ET June 22, 2017

RIDGEWOOD — It’s not only newspaper reporters that are the watchful eyes and champions of transparency at municipal meetings these days.

The League of Women Voters of Ridgewood, a nonpartisan group that advocates for good government, has introduced a local Observer Corps program to stay on top of municipal news through a team of volunteer reporters.

“It’s intense work but if you like to write, and you’re interested in good government and love your community, it’s a good way to participate,” said Pamela Perron, coordinator of the local Observer Corps.

BAR FIGHT LEADS TO LAWSUIT CLAIMING FOOTBALL FAN’S CONSTITUTIONAL RIGHTS DENIED BY NEW JERSEY BAIL REFORM

ankle_bracelet_theridgewoodblog
Former U.S. Solicitor General Paul Clement Leads Battle Against Christie Administration
June 23,2017
the staff of the Ridgewood blog

Ridgewood NJ, A class action lawsuit has been filed in the United States District Court for the District of New Jersey.  The case of Holland v. Porrino, et al concerns a Dallas Cowboys football fan involved in a bar fight, who claims he was denied his constitutional right to bail by a New Jersey judge.

32-year-old Brittan Holland was arrested and charged following an argument and fight with a Philadelphia Eagles fan in Winslow Township.  He was subsequently ordered to be released wearing a GPS ankle monitor pending his trial.  However, the suit contends that this action reflects the unlawfulness of New Jersey’s bail reform laws, which took effect on January 1.  Intended to make things more fair for defendants who lack the financial resources to be bailed out, the new system calls for judges to utilize a risk assessment tool to determine whether to hold defendants in jail or release them on a simple promise to appear.

Filed by former U.S. Solicitor General Paul Clement on behalf of Holland and Lexington National Insurance Corporation, which represents others in Holland’s situation, the suit maintains that New Jersey’s current bail reform laws are illegal.  Clement, widely regarded as one of the greatest constitutional litigators of our time, contends that bail is guaranteed in the Eighth Amendment of the Constitution.

The defense is led by Attorney General Christopher Porrino, representing Governor Chris Christie’s administration, to which he reports.  Christie was strongly behind the push for New Jersey bail reform when it passed in 2014.

By ordering Holland’s release on the condition that he wear an ankle monitor, Clement’s suit states that he was thus denied the option of bail, to which he should have been legally entitled.

Since taking effect, the state’s new bail laws have been highly controversial, with both law enforcement and victims groups criticizing it as creating a threat to public safety.  Under the former system, which used money bail to create accountability, potentially dangerous defendants were carefully monitored by bail agents after being released.  With the new system, there is little incentive for a person who has been freed from jail to show up for court.

As for Brittan Holland, Clement’s suit claims that under the previous law, he would have very likely “paid a nonexcessive amount of bail to secure his future appearance, likely with the help of a surety company like Plaintiff Lexington National.  He then would have enjoyed his full pre-trial liberty, just like any other presumptively innocent member of society.”  However, because the court never had the option to set bail, Holland’s release was secured through non-monetary conditions, which included the use of an ankle monitor, through which his “liberty is sharply curtailed.”  The suit adds, “he cannot shop for food or basic necessities and cannot take his son to baseball practice”

The plaintiff in this case is bringing three claims against New Jersey bail reform: (1) deprivation of his Eighth Amendment and Fourteenth Amendment right to bail by denying his right to bail as an option in the first instance; (2) deprivation of his rights of due process; (3) violation of his Fourth Amendment rights to be free from unreasonable searches and seizures, as a result of being required to be placed on GPS and other monitoring.

A preliminary injunction motion has been filed, with the court being asked to hear the matter by July 17 – and rule on it in an expedited fashion.  Practically speaking, New Jersey’s bail reform laws could face a court injunction within the next four weeks.  If that occurs, it would entirely derail the new laws and once again, restore monetary bail, within the discretion of a judge, as a required consideration as a first option when it comes to setting bail.

About the American Bail Coalition

The American Bail Coalition is dedicated protecting the Constitutional right to bail and the promotion, protection and advancement of the surety bail profession in the United States. Affordable housing mandate threatens quality of life, mayor says

Affordable housing mandate threatens quality of life, mayor says

BY DAVE HUTCHINSON

NJ Advance Media for NJ.com

MONTGOMERY TWP. – Mayor Ed Trzaska is concerned that a potential court mandate requiring the township meet an affordable housing unit quota will put an overwhelming burden on the municipality and negatively effect the quality of life.

At issue is a state Supreme Court ruling in March of 2015 that opened the door for municipalities to be sued for not providing a “fair share” of affordable housing units. The ruling also allows a municipality to demonstrate in court that it has met the requirement to provide affordable housing.

The township, which has a population of some 23,000, has been in the forefront of providing affordable housing units, said Trzaska. Currently, he said the township has 300 affordable housing units, of which more than one-fourth are vacant.

Under a possible court ruling by the Fair Share Housing Counsel, the township could be forced to build between 501 and 1,000 additional affordable housing units, as well as 4,000 market-rate units, said Trzaska. The township has yet to be given the exact number of affordable units it must build, he said.

New Jersey on fast-track to legalizing recreational pot in 2018

POT-SMOKING-KID

Gubernatorial candidates Phil Murphy and Kim Guadagno each favor changing states marijuana laws

POT POLITICS NEW JERSEY GOVERNOR ELECTION
BY KEVIN C. SHELLY
PhillyVoice Staff

Don’t spark up yet, New Jersey. But maybe next year.

The state’s marijuana law appears destined to change in 2018 after Gov. Chris Christie leaves office on Jan. 16.

The Republican nominee for governor, current Lt. Gov. Kim Guadagno, supports decriminalizing pot, but not full legalization. On the other hand, Democratic gubernatorial nominee Phil Murphy has made recreational marijuana legalization part of his campaign platform.

The powerful New Jersey Senate Judiciary Committee held a committee meeting Monday on legalization featuring a parade of more than 20 supporters and just three witnesses who spoke against the proposed change.

New Jersey Democrat accused of taking bribes from top donor

A federal judge on Wednesday began trying to find 16 New Jersey residents who can be fair and impartial jurors in the September corruption trial of U.S. Senator Robert Menendez and a top donor.

Menendez, a New Jersey Democrat, is accused of improperly seeking to help Florida doctor Salomon Melgen in a Medicare overbilling case, a contract dispute with the Dominican Republic and with visa applications for three girlfriends. Prosecutors say Menendez accepted nearly $1 million in campaign donations and luxury travel, including a Paris vacation, from Melgen.

Judicial Watch: Obama NSC Advisor Susan Rice’s Unmasking Material is at Obama Library

Records Sought by Judicial Watch May Remain Closed to the Public for Five Years

June 22,2017
the staff of the Ridgewood blog

Washington DC, Judicial Watch today announced that the National Security Council (NSC) on May 23, 2017, informed it by letter that the materials regarding the unmasking by Obama National Security Advisor Susan Rice of “the identities of any U.S. citizens associated with the Trump presidential campaign or transition team” have been removed to the Obama Library.

The NSC will not fulfill an April 4 Judicial Watch request for records regarding information relating to people “who were identified pursuant to intelligence collection activities.”

The agency also informed Judicial Watch that it would not turn over communications with any Intelligence Community member or agency concerning the alleged Russian involvement in the 2016 presidential election; the hacking of DNC computers; or the suspected communications between Russia and Trump campaign/transition officials. Specifically, the NSC told Judicial Watch:

Documents from the Obama administration have been transferred to the Barack Obama Presidential Library.  You may send your request to the Obama Library.  However, you should be aware that under the Presidential Records Act, Presidential records remain closed to the public for five years after an administration has left office.

Judicial Watch’s Freedom of Information Act (FOIA) April 4 request sought:

1.) Any and all requests for information, analyses, summaries, assessments, transcripts, or similar records submitted to any Intelligence Community member agency or any official, employee, or representative thereof by former National Security Advisor Susan Rice regarding, concerning, or related to the following:

Any actual or suspected effort by the Russian government or any individual acting on behalf of the Russian government to influence or otherwise interfere with the 2016 presidential election.
The alleged hacking of computer systems utilized by the Democratic National Committee and/or the Clinton presidential campaign.
Any actual or suspected communication between any member of the Trump presidential campaign or transition team and any official or employee of the Russian government or any individual acting on behalf of the Russian government.
The identities of U.S. citizens associated with the Trump presidential campaign or transition team who were identified pursuant to intelligence collection activities.

2.) Any and all records or responses received by former National Security Advisor Susan Rice and/or any member, employee, staff member, or representative of the National Security Council in response to any request described in part 1 of this request.

3.) Any and all records of communication between any official, employee, or representative of the Department of any Intelligence Community member agency and former National Security Advisor Susan Rice and/or any member, employee, staff member, or representative of the National Security Council regarding, concerning, or related to any request described in Part 1 of this request.

The time frame for this request was January 1, 2016, to the April 4, 2017.

While acknowledging  in its FOIA request that “we are cognizant of the finding by the Court of Appeals … that [the NSC] “does not exercise sufficiently independent authority to be an ‘agency’ for purposes of the Freedom of Information Act,” Judicial Watch argued:

The records sought in this request pertain to actions by the former National Security Advisor that demonstrate a much higher degree of independent authority than was contemplated by the court; specifically, the issuance of directives to the Intelligence Community related to the handling of classified national security information…

The recent revelations of the role of Susan Rice in the unmasking the names of U.S. citizens identified in the course of intelligence collection activities and the potential that her actions contributed to the unauthorized disclosure of classified national security information are matters of great public interest.

Judicial Watch has filed six FOIA lawsuits related to the surveillance, unmasking, and illegal leaking targeting President Trump and his associates (see here, here, here, here, here and here).

“Prosecutors, Congress, and the public will want to know when the National Security Council shipped off the records about potential intelligence abuses by the Susan Rice and others in the Obama White House to the memory hole of the Obama Presidential Library,” said Judicial Watch President Tom Fitton.  “We are considering our legal options but we hope that the Special Counsel and Congress also consider their options and get these records.”

NJ student says superintendent too biased to investigate Trump yearbook flap

make america great again

By Dan Alexander June 21, 2017 4:07 PM

WALL — One of the students whose yearbook pictures were censored in order to remove Donald Trump refernces is calling for an independent investigation, saying that the district superintendent cannot be trusted because she once posted an anti-Trump article to the district website.

Superintendent Cheryl Dyer call the accusation an affront to her “personally and professionally.”

Wyatt Dobrovich-Fago told the township Board of Education on Tuesday that he wants an independent investigation into the deletion of the logos from his sweater vest and from the T-shirt worn by junior Grant Berardo, according to a News 12 New Jersey report.  A Trump quotation submitted by Wyatt’s sister, freshman class president Montana, also was omitted.

The yearbook alterations caused a local stir and made national headlines.

Ridgewood NJ, in his recent letter to the editor Councilmen Jeff Voigt makes an impassioned plea: Don’t squash advisory board https://www.northjersey.com/story/opinion/readers/2017/06/20/letter-dont-squash-advisory-board/410315001/ and focuses on the misguided concept of Collective guilt. Which boils down to another attempt by a politician to use a special interest group to further his political agenda.

CRAB is nothing more than a political action committee looking to force their agenda down people throats . Recent attempts by the  group to target and undermine the current council and their vicious attacks on anyone who disagrees with their approach undermines there very mission.

The fact is CRAB is just another Aronsohn and an Company group looking to impose Hudson County Machine politics  on the Village of Ridgewood . The Latest attempt by CRAB pushing the rainbow flag did nothing to advance acceptance but created a more polarizing political situation in Ridgewood .

And finally by using Councilmen Voigts own logic the group used the wrong rainbow flag ,which according the BLM Black Lives Matter disenfranchises people of color by having them purposely excluded from the “gay coalition” .

RIDGEWOOD — Two down, two to go.

After a literal 11th-hour change to the site plan, the Ridgewood Planning Board approved the application for an apartment complex on South Broad Street at the old Brogan Cadillac site.

The project, known as The Dayton, is one of four multifamily housing applications filed in the wake of a master plan amendment that rezoned areas of downtown Ridgewood for multifamily housing.

“Clear Cut” , “turf Field” Roberta has issues with the new tree ordinance

Ridgewood NJ, in a letter to the editor former Village Manager Roberta Sonenfeld, Tree tax is a bad idea https://www.northjersey.com/story/opinion/readers/2017/06/20/letter-tree-tax-bad-idea/412244001/ . Is it just us or does anyone else find in both ironic and ridiculous that one of the people who pushed the “clear cutting” several acres of trees at Schedler Property ,in order to build a new turf baseball field has issues with the new tree ordinance ?

The ordinance regulating tree removals on private property requires a permit to remove any tree larger than 8 inches in diameter. Any healthy tree removed must be replaced, or a payment made in lieu of replacement. Key provisions of the new ordinance are outlined below.

The ordinance was specifically established to protect the Village of Ridgewood from people like Roberta Sonenfeld and Paul Aronsohn who were looking to ‘clear cut” and  turf down every inch in the Village of Ridgewood . As they say “round up the usual suspects “, we bet most readers can add a litany of names to this list.

IRS Warns of New Phone Scam Involving Bogus Certified Letters

IRS Warns of New Phone Scam Involving Bogus Certified Letters; Reminds People to Remain Vigilant Against Scams, Schemes this Summer

IR-2017-107, June 15, 2017

WASHINGTON – The Internal Revenue Service today warned people to beware of a new scam linked to the Electronic Federal Tax Payment System (EFTPS), where fraudsters call to demand an immediate tax payment through a prepaid debit card. This scam is being reported across the country, so taxpayers should be alert to the details.

In the latest twist, the scammer claims to be from the IRS and tells the victim about two certified letters purportedly sent to the taxpayer in the mail but returned as undeliverable. The scam artist then threatens arrest if a payment is not made through a prepaid debit card. The scammer also tells the victim that the card is linked to the EFTPS system when, in fact, it is entirely controlled by the scammer. The victim is also warned not to contact their tax preparer, an attorney or their local IRS office until after the tax payment is made.

“This is a new twist to an old scam,” said IRS Commissioner John Koskinen. “Just because tax season is over, scams and schemes do not take the summer off. People should stay vigilant against IRS impersonation scams. People should remember that the first contact they receive from IRS will not be through a random, threatening phone call.”

EFTPS is an automated system for paying federal taxes electronically using the Internet or by phone using the EFTPS Voice Response System. EFTPS is offered free by the U.S. Department of Treasury and does not require the purchase of a prepaid debit card. Since EFTPS is an automated system, taxpayers won’t receive a call from the IRS. In addition, taxpayers have several options for paying a real tax bill and are not required to use a specific one.

Tell Tale Signs of a Scam:

The IRS (and its authorized private collection agencies) will never:

Call to demand immediate payment using a specific payment method such as a prepaid debit card, gift card or wire transfer. The IRS does not use these methods for tax payments. Generally, the IRS will first mail a bill to any taxpayer who owes taxes. All tax payments should only be made payable to the U.S. Treasury and checks should never be made payable to third parties.
Threaten to immediately bring in local police or other law-enforcement groups to have the taxpayer arrested for not paying.
Demand that taxes be paid without giving the taxpayer the opportunity to question or appeal the amount owed.
Ask for credit or debit card numbers over the phone.

For anyone who doesn’t owe taxes and has no reason to think they do:

Do not give out any information. Hang up immediately.
Contact the Treasury Inspector General for Tax Administration to report the call. Use their IRS Impersonation Scam Reporting web page. Alternatively, call 800-366-4484.
Report it to the Federal Trade Commission. Use the FTC Complaint Assistant on FTC.gov. Please add “IRS Telephone Scam” in the notes.

For anyone who owes tax or thinks they do:

View your tax account information online at IRS.gov to see the actual amount you owe. You can then also review your payment options.
Call the number on the billing notice, or
Call the IRS at 800-829-1040. IRS workers can help.

The IRS does not use email, text messages or social media to discuss personal tax issues, such as those involving bills or refunds. For more information, visit the “Tax Scams and Consumer Alerts” page on IRS.gov. Additional information about tax scams is available on IRS social media sites, including YouTube videos.
