During a tense hearing Wednesday, the state Supreme Court appeared ready to reject an argument by several towns seeking to tamp down their affordable-housing obligations.
In a series of landmark rulings dating to the 1970s, the Supreme Court said that New Jersey’s low- and moderate-income residents have a right to affordable homes in their communities, and that towns must allow their development.

OLD TAPPAN – A former board of education member who wrote on Facebook that some parents who oppose random drug testing “smoke pot with their kids” is suing a married couple for allegedly smearing her name, according to a lawsuit.

Kathleen Quinn Fable, who served for three years on the Northern Valley Regional Board of Education in Old Tappan claims in court papers that Dennis Doros and Amy Heller of Harrington Park made statements that injured her reputation and adversely affected her advertising business.
The issue stems from an Aug. 5, 2013 Facebook post Fable made about parents who oppose suspicion-based, random drug testing in Bergen County schools.
“Should we be acting on the demands of the parents who smoke pot with their kids?” Fable wrote in the post, which appeared in a closed Facebook group for Old Tappan moms.

TOPEKA, Kan. (AP) — A Topeka man who answered a Craigslist ad to donate sperm so two women could have a baby together is not legally the child’s father and isn’t required to provide financial support, a Kansas judge has ruled.
The state Department for Children and Families had not decided as of Tuesday whether it would appeal last week’s ruling by Shawnee County District Judge Mary Mattivi. The department sought to force William Marotta to pay child support for the girl born in December 2009.
Mattivi last year required Marotta to submit a DNA sample to confirm that he was the girl’s biological father and declared he was not “a mere donor of sperm.” But the judge’s Nov. 22 ruling concluded that birth mother’s former partner should be considered the child’s second parent rather than Marotta, in part because he has had minimal contact with the girl.

(CNN)A college student from Michigan said Wednesday that he has received death threats after being chosen to cast an Electoral College vote for his state in December.
Although the presidential election was won by Donald Trump on November 8, it’s not official until December 19, when all 538 members of the Electoral College will come together to cast their votes.
Michael Banerian, the youth vice-chairman of the Michigan Republican Party, will be one of his state’s 16 electors. The honor of being selected, a role typically bestowed to recognize a person’s service and dedication to their political party, has come at a price, Banerian told CNN’s Brianna Keilar .
“Obviously, this election cycle was pretty divisive. Unfortunately it’s bled over into the weeks following the election and I have been inundated with death threats, death wishes, generally angry messages trying to get me to change my vote to Hillary Clinton or another person, and unfortunately, it’s gotten a little out of control.” Banerian said.
Banerian said he has been threatened with violence.

Now that New Jersey has had a medical marijuana program in place for nearly seven years, shouldn’t the state change the decades-old classification of marijuana as one of the most dangerous and reviled drugs, one without any medicinal benefit?
That question was posed to a state appeals panel Tuesday on behalf of two plaintiffs – an inmate serving a life sentence for drug trafficking and a Maple Shade teenager who uses medical marijuana to control epileptic seizures.
After listening to the arguments, the three-judge panel in Trenton said it would release an opinion later.
Newark lawyers Joseph Linares and Marc Haefner of the Walsh Firm contend it is inconsistent for the state to have a medical marijuana program and a classification of marijuana as a Schedule I drug, a category that includes heroin. Cocaine and other addictive drugs fall into Schedule II and III and are considered less harmful than marijuana, the lawyers argued.
State Deputy Attorney General Jodi Krugman opposed changing the classification, noting that the federal government classified marijuana as a Schedule I drug in 1970 and has repeatedly turned down petitions to assign it a new designation, most recently last summer. “Other states with medical marijuana programs have not rescheduled marijuana,” she said.
Linares, however, said state law requires the director of consumer affairs to review the classifications of controlled drugs and make changes “when appropriate” and without deference to the federal classification.

Fair Lawn NJ, Fair Lawn PD, EMS and a paramedic unit from The Valley Hospital all rushed to aid an adult male pedestrian who was struck by a school bus while crossing Fair Lawn Avenue near Saddle River Road late Wednesday afternoon, 11/30. The school bus driver remained on the scene and was cooperating with police officers. The condition of the victim and the hospital to which he was transported were not made available at the accident scene.

In a case that could reshape the look and feel of many New Jersey towns, the state Supreme Court heard arguments Wednesday on whether municipalities must zone for the many thousands of affordable-housing units that they did not zone for during the last 16 years.
If the high court rules that an obligation for that “gap period” exists, it could double or triple the number of affordable-housing units that some towns and cities must zone for by 2025.
In some of their questioning, justices seemed to be skeptical that the obligation could be avoided.
“Are you saying these people [in need of affordable housing] disappeared for 16 years?” asked Justice Faustino Fernandez-Vina.

PARAMUS — A New Jersey mall has come up with a 21st century answer to a problem that has plagued generations of holiday shoppers: finding a parking space.
Westfield Garden State Plaza partnered with MyPark, a Miami company that allows shoppers to reserve a parking space by using a downloadable app. The specially modified parking spaces are equipped with a gate that remains upright until the person who reserved the space uses the app to bring the gate down.
The mall announced the rollout Wednesday. A total of 33 spaces, located near the entrance to Nieman Marcus, will be available at a cost of $10 for four hours each, NorthJersey.com reported.
The mall has nearly 11,000 parking spaces for shoppers at its more than 300 stores. The Garden State Plaza sees about 18 million visits a year, according to figures provided by Westfield.
The MyPark service is already available at a few other locations, including six properties in Florida, but the company plans to introduce it at several more locations in 2017.

Ridgewood NJ, Ridgewood PD, FD, and the Bergen County Department of Health Services Hazardous Materials Unit responded to a diesel fuel leak in front of 421 Eastgate Road, Ridgewood on the afternoon of Wednesday, 11/30. The drive train of a privately owned sanitation truck hauling leaves from the Borough of Hillsdale tore loose from its mounting brackets and punctured an 87 gallon diesel fuel tank. An undetermined about of fuel spilled onto Eastgate Road requiring action from FD personnel and a contracted hazardous waste clean up crew. A portion of Eastgate Road was closed for an extended period until clean up efforts were completed. No injuries were reported in the mishap.

In accordance with the US Environmental Protection Agency Brownfields Grant Applications, community notification policies, the Village Council of the Village of Ridgewood, at its regularly scheduled public work session to be held on Wednesday, December 7, 2016 starting at 7:30 pm, or shortly thereafter, in the Level Four Courtroom of Village Hall, 131 North Maple Avenue, Ridgewood, New Jersey, will hear a presentation on the following:
“US Environmental Protection Agency 2017 Brownfields Grant Proposals
For the Site Remediation of the North Walnut Street Parking Lot ; Lots 3 and 4, Block 3805”
The Village of Ridgewood is seeking to apply for two (2) US EPA 2017 Brownfield Grants. One is an Assessment Grant and the second is a Cleanup Grant for the Village property known as the North Walnut Street Parking Lot, also known as Lots 3 and 4, of Block 3805. The purpose of this discussion will be to hear a presentation on the grant funding proposals for assessment and cleanup of the Village parcel, as well as to solicit public comment on the grant applications and the proposed use of funds.
A copy of the 2017 USEPA Brownfields Grant proposal applications will be available in the Office of the Village Clerk, Level 5, Village Hall, 131 North Maple Avenue, Ridgewood, New Jersey. Comments regarding the grant proposals will be incorporated into the grant applications and may also be submitted in writing to the Village Clerk no later than December 15, 2016 by the close of business.
