Ridgewood NJ,Superior court judge orders Ridgewood BOE to produce certificates from board members, to certify the manner in which they access Board of Education emails:

On Friday, March 13th, Superior court judge, Bonnie Mizdol ordered the Ridgewood BOE to produce certificates from two members of board, within 7 days attesting to the manner in which they access Board of Education emails from any and all non-Board devices and/or non-Board email accounts. These certifications shall be detailed and specific, including but not limited to::

  1. The type(s) of non-Board device(s) used to access Board emails;
  2. Any and all program(s) and/or application(s) used on such non-Board devices to access Board emails;
  3. Whether, as of November 13, 2019, they have ever used email settings configured to allow retrieval of Board emails on non-Board email accounts; and
  4. Whether such settings were located on Board email accounts, Board devices, private email accounts, or private devices,

The judge also ordered an award of reasonable attorney’s fees and costs to prevailing party Dani under OPRA. The prevailing party was represented by Walter M. Luers, who is a leading OPRA attorney in the state of New Jersey.

  1. once again our board of education is caught taking actions that are unlawful. I’m glad the judge gave them what they deserve.

  4. So this begs the question, can a candidate that has pending legal action against the BOE be elected to the BOE?

    I am asking a legal question, not for people’s opinions.

  5. Case has been decided and over with. Saurabh Dani was right.

  6. The candidate had checked this out in advance. He was indeed able to bring this action as a candidate. He could not have done so as an elected official. It is no longer pending. It has been resolved. We owe a huge debt of gratitude to Saurabh Dani for shedding light through the opacity of the Board of Education.

  12. The fact that the BOE members let this go to a legal matter is shameful on the part of the entire Board. This started off as a perfectly lawful request that they decided not to respond to, which in-turn forced the lawsuit. I’m sure they were hoping that Dani would let sleeping dogs lie. They made a strategic blunder. When a Board does not respond to a perfectly lawful request under the laws of the state, and then they are forced to respond by way of a lawsuit, the Board should resign. The court’s decision shows that they wasted time, money, and ran afoul of the law, specifically the Open Public Records Act (OPRA), which used to be called “Right To Know Law”, which governs the public’s access to government records in New Jersey. So, they were holding back on every citizens “right to know”. Time, money, and public records, is what they are there to provide oversight over, and be good stewards over. If they cannot do that for themselves, they cannot be expected to provide financial oversight and governance over a school system. It’s total irresponsibility of their roles as board members, and the board speaks with one voice, a resolution for the entire BOE to step down is in order.

  13. Nice try at spin there. The person that controlled what money we all had to waste in this lawsuit was candidate Dani. When Valley sued Ridgewood they lost whatever support they had in town. The same should happen to this self-important muckraker and his low-information voting block.
