District Court Rules that State Department Must Make Public FBI Declaration on Clinton Email Retrieval Efforts

Washington, DC, Judicial Watch President Tom Fitton made the following statement regarding today’s ruling by United States District Judge James E. Boasberg that the Department of State must make public a FBI declaration detailing its efforts to retrieve Hillary Clinton’s government emails (Judicial Watch, Inc. v. Rex Tillerson (No. 1:15-cv-00785)):

We’re happy with the ruling but it is unbelievable we’re being opposed by Trump appointees in the State and Justice Department’s on the Clinton email issue.  President Trump ought to be outraged his appointees are protecting Hillary Clinton. The State Department should initiate action with the Justice Department – and both agencies should finally take the necessary steps to recover all the government emails Hillary Clinton unlawfully removed.

On April 30, 2015, Judicial Watch sued former Secretary John Kerry after the State Department failed to take action on a letter sent to Kerry “notifying him of the unlawful removal of the Clinton emails and requesting that he initiate enforcement action pursuant to the [Federal Records Act],” including working through the Attorney General to recover the emails. After initially being dismissed by the district court, Judicial Watch’s lawsuit was revived on appeal by the U.S. Court of Appeals for the District of Columbia Circuit on December 27, 2016. The Federal Records Act states that an agency head “shall” initiate an action through the Attorney General when he becomes aware of any unlawful removal of agency records.

While at the State Department, Clinton conducted official government business using an unsecure email server and email accounts. Her top aides and advisors also used non-“state.gov” email accounts to conduct official business. Clinton left office February 1, 2013.

The Trump administration defended handling of the email matter by the Obama administration filed two declarations from the FBI trying to justify the State Department’s refusal to follow the law and refer to the Clinton email issue to the Justice Department.  As the decision notes, the second FBI declaration is non-public and was filed in camera and ex parte with the court.  Judge Boasburg today rejected the State Department’s arguments that the FBI declaration be withheld to protect grand jury secrecy:

After reviewing the document in camera, the Court concludes it largely rehashes information already made public, thus obviating any need for secrecy.

Hurricane Harvey first made landfall as a Category 4 storm near Rockport, Texas, on the evening of August 25, 2017.  The storm has since devastated communities in both Texas and Louisiana, claiming many lives, inflicting countless injuries, destroying or damaging tens of thousands of homes, and causing billions of dollars in damage.  The entire Nation grieves with Texas and Louisiana.  We are deeply grateful for those performing acts of service, and we pray for healing and comfort for those in need.

Americans have always come to the aid of their fellow countrymen — friend helping friend, neighbor helping neighbor, and stranger helping stranger — and we vow to do so in response to Hurricane Harvey.  From the beginning of our Nation, Americans have joined together in prayer during times of great need, to ask for God’s blessings and guidance.  This tradition dates to June 12, 1775, when the Continental Congress proclaimed a day of prayer following the Battles of Lexington and Concord, and April 30, 1789, when President George Washington, during the Nation’s first Presidential inauguration, asked Americans to pray for God’s protection and favor.

When we look across Texas and Louisiana, we see the American spirit of service embodied by countless men and women.  Brave first responders have rescued those stranded in drowning cars and rising water.  Families have given food and shelter to those in need.  Houses of worship have organized efforts to clean up communities and repair damaged homes.  Individuals of every background are striving for the same goal — to aid and comfort people facing devastating losses.  As Americans, we know that no challenge is too great for us to overcome.

As response and recovery efforts continue, and as Americans provide much needed relief to the people of Texas and Louisiana, we are reminded of Scripture’s promise that “God is our refuge and strength, a very present help in trouble.”  Melania and I are grateful to everyone devoting time, effort, and resources to the ongoing response, recovery, and rebuilding efforts.  We invite all Americans to join us as we continue to pray for those who have lost family members or friends, and for those who are suffering in this time of crisis.

NOW, THEREFORE, I, DONALD J. “Our democracy has no room for inciting violence or endangering the public, no matter the ideology of those who commit such acts.  The violent actions of people calling themselves antifa in Berkeley this weekend deserve unequivocal condemnation, and the perpetrators should be arrested and prosecuted.

“In California, as across all of our great nation, we have deep reverence for the Constitutional right to peaceful dissent and free speech.  Non-violence is fundamental to that right.  Let us use this sad event to reaffirm that we must never fight hate with hate, and to remember the values of peace, openness and justice that represent the best of America.”

A U.S. appeals court dismissed a Subway settlement in its footlong suit, calling the class-action deal to pay the lawyer fees “utterly worthless” for the customers, according to a report.

“A class action that seeks only worthless benefits for the class and yields only fees for class counsel is no better than a racket and should be dismissed out of hand,” wrote the three-judge panel of the 7th U.S. Circuit Court of Appeals in Chicago, according to the Daily News.

Multiple suits were filed four years ago when customers claimed they were shorted in buying Subway “Footlongs” that were less than 12 inches.

America’s Post-Charlottesville Nervous Breakdown Was Deliberately Induced

Americans are being emotionally manipulated to take up cause with those whose ultimate purpose is the repeal of the First Amendment and erasure of national memory.

Wars are won or lost based mostly on perceptions of events, not on what actually happens. This is true for any given battlefield, whether it’s the 1968 Tet Offensive in Vietnam or the ideological battlefield over the future of the First Amendment as played out in Charlottesville in 2017. The reality of what takes place in the public arena is always secondary to any projected illusion.

So let’s never forget this: Whoever has the power to dictate public perceptions of reality is in a position to dictate public opinion and behavior. Abusing language and images to stir up emotions is an ancient trick of power-mongers. And once journalism turns into unchecked propaganda, we become trapped in its dangerous illusions.

Only the teensiest fraction of Americans have any real interest in violent extremism, whether it be the violence represented by the specter of the Klu Klux Klan or the violence promoted by groups like Antifa who pretend they are fighting for social justice. But the media is promoting imagery of the former as a foil for the latter

Who’s buried in Grant’s Tomb?

That question used to be part of an old joke. But the answer might soon be “no one” if certain New York politicians get their way.

New York Mayor Bill DeBlasio has called for a review of the historic relevance of public monuments in the city. City Council Speaker Melissa Mark Viverito has said she wants Grant’s Tomb to be on the review list. It seems that during the Civil War, Grant issued an order expelling Jews from Kentucky, Tennessee and Mississippi in an effort to crack down on black-market trading.

Christopher Columbus is on the list as well, of course, and Columbus Circle and its giant statue of the explorer are under review as well.

All of this is part of that national effort by the left to cleanse history of  historical figures with checkered pasts.

That effort has been in the news ever since that fight in Charlottesville, Va., over the proposed removal of a statue of Confederate General Robert E. Lee.

Court: Residents Can’t Mention “Islam” or “Muslim” At Public Hearing on Mosque Construction; Thomas More Law Center Files Federal Lawsuit

Bernards Township NJ,  In a settlement agreement, which reads more like an instrument of surrender, Bernards Township (“Township”), New Jersey officials agreed that, in addition to a $3.5 million payment to Islamic Society of Basking Ridge (“ISBR”), residents and citizens of the Township are prohibited from commenting on “Islam” or “Muslims.” at the upcoming public hearing to approve the settlement.  Astonishingly, a federal judge approved the prohibition as a fully enforceable Order of the Court.

As a result of this suppression of speech, the Thomas More Law Center (“TMLC”), a national public interest law firm based in Ann Arbor, Michigan, yesterday, filed a lawsuit in the New Jersey Federal District Court on behalf of Christopher and Loretta Quick. The lawsuit was filed by TMLC affiliated New Jersey attorney, Michael Hrycak. Mr. Hrycak was assisted by TMLC staff attorney, Tyler Brooks. The TMLC is representing the Quicks without charge.

TMLC’s lawsuit alleges that Bernards Township’s settlement agreement constitutes a prior restraint on speech based on content, as well as, a violation of the Establishment Clause because it prefers Islam over other religions.  The lawsuit asks the court to: declare that the settlement agreement is unconstitutional; and to enter a preliminary and permanent injunction against its enforcement.

The Quicks reside within 200 feet of the proposed mosque construction in a zoned residential area.  Yet, the settlement agreement prohibits them from describing the many unique features of Islamic worship which will impact design of the building, traffic density, water and sewage, traffic control problems, road construction, and parking arrangements. According to the settlement agreement, ISBR is permitted to make statements concerning Christians and Jews and their places of worship, but in contrast, the Agreement prohibits commentary relating to Islam or Muslims. In fact, ISBR has previously discussed the Christian and Jewish religions and their places of worship.

Richard Thompson, President and Chief Counsel of the Thomas More Law Center, commented: “As we have previously documented, ISBR has taken the extraordinary step of concealing significant links on their website to a radical group named by the federal government as an unindicted co-conspirator in the largest terrorism financing trial in America history, the Islamic Society of North America (“ISNA”).  ISNA is claimed by the Muslim Brotherhood as one of “our organizations.” According to internal documents seized by the FBI, the Muslim Brotherhood’s strategy is to engage in a “grand Jihad in eliminating and destroying Western civilization from within . . .”

Thompson continued, “While claiming that the Township had a religious animus against Muslims, ISBR hid from the public view its animus toward Christians and Jews, by not only hiding anti-Christian and anti-Semitic verses published on its website, but also hiding its significant ties to ISNA. Instead of standing up to defend its citizens against ISBR’s hate-filled anti-Semitic and anti-Christian bias, the Township colluded with ISBR’s “Civilization Jihad” by capitulating to payment of millions of dollars to ISBR, allowing the construction of the new mosque and Islamic center in violation of zoning codes, and now even suppressing speech concerning Islam or Muslims at a public meeting.”

In March 2016, ISBR filed a lawsuit in the New Jersey Federal District Court alleging that Bernards Township had discriminated against the Islamic Society when it declined to approve the construction of a large mosque on a lot that was far too small to handle the contemplated structure.  And in November 2016, the United States represented by the U. S. Justice Department filed a second lawsuit against the Township on similar grounds. The settlement agreement covers both lawsuits.

After a couple of years during which Donald Trump has done so much to make the jobs of those of us in the media easier and more entertaining, I am starting to see a pattern.

First the Donald says something of which my fellow members of the media strongly disapprove.

Then they take to their computers and TV screens to declare that “This time he’s really gone too far.”

Much speculation about his replacement by someone less interesting ensues.

And then the Donald mounts a counterattack that deflates the media narrative – until next time, when he will once again go too far and start the cycle over again.

The coverage of this Charlottesville incident offered a classic example.

Little Leaguers getting infected by adults’ bad sportsmanship

Kids, by definition, are impressionable. They know only what they know, what they’re given to know and what they’re interested in knowing. And then that knowledge, often in the form of prompts, is applied.

Years ago my family was seated with the Drobnis family at dinner when talk turned toward the Vietnam War. Mike Drobnis said that after he was drafted he joined the Coast Guard.

His son, Danny, about 10 at the time, grew excited.

“Dad,” he said, “you were drafted?”

“I was,” his father answered.

“Wow,” said Danny. “What round?”

But impressionable cuts all ways, thus, by now, Bill Henel should have known better, should have cut himself a break and watched something else. Or read a book.

Henel was a Brick, N.J., Little League umpire for 20 years, and a member of its board of directors for 25 years.

“But this is my last year,” he wrote. “I’m tired of trying to tell kids about sportsmanship. It’s hopeless, and TV shows the worst of them as funny and cool. A sad state.”

As I recall, the ideas set forth in that book seemed horrific to me when I read it years ago and they sit no better with me today. In a society where some seek individuality so strongly, it seems to be such a contrary notion that they would then gather, as individuals, to completely sanitize any record of individuality in favor of socialism.

The United States is comprised of diverse people with individual histories from nations with histories. Those coming to our country for freedom neither seek to, nor should they, erase their history. By the same token, the history of the people in this country should not be erased.

This is not to say that I support what has occurred in any of our histories, as touring prison camps and museums in Europe was difficult for me for what my ancestors suffered there. However, that is part of my history. My ancestors rose up and overcame the oppression just as slavery was overcome in this country. Memorials, statues, buildings and sacred grounds are better seen as places we may go to pay tribute to those who suffered in order to teach us the lessons needed to bring us to the place we are today and serve as reminders of what we can never allow again. “

President Trump signs the VA Choice and Quality Employment Act of 2017 Improving Veterans Healthcare

Washington DC, GIVING VETERANS A CHOICE: President Donald J. Trump is giving veterans a choice in the healthcare they receive so they can receive the right care, at the right time, from the right provider.

President Trump signed the VA Choice and Quality Employment Act of 2017 to authorize $2.1 billion in additional funds for the Veterans Choice Program (VCP).

Veterans become eligible for care under the VCP if they live more than 40 miles from the closest eligible VA medical facility, wait times are over 30 days from the clinically indicated date, or they meet other special criteria.
The VCP has improved veterans’ access to care, and since its inception has resulted in more than 21.6 million appointments, serving over 1.8 million unique veterans.
This new funding will ensure VCP-eligible veterans continue to receive care in their communities from providers they trust.
While initially created as a temporary program in 2014, VCP has proven to be a valuable addition to the Department of Veterans Affairs (VA) healthcare system.

The Act empowers the VA to hire the very best people at competitive rates for senior positions so our veterans receive the best care possible.

The Act expands the VA’s direct-hiring authority, which will increase the speed at which the VA can onboard qualified people for VA jobs.

The Act authorizes 28 major medical facility leases, including some that have been on hold for over three years.

PUTTING VETERAN CARE FIRST: President Trump is making veteran healthcare a priority of his Administration and has moved quickly to improve the Department of Veterans Affairs healthcare system.

The Administration has implemented a new White House VA hotline, staffed principally by veterans, to help veterans.
Under President Trump, the VA fired 677 employees, suspended 238, and demoted 32, as part of the President’s effort to restore integrity and accountability to a department charged with supporting our Nation’s heroes.

The VA is the first agency to post information on employee disciplinary action online.

President Trump signed the Veterans Accountability and Whistleblower Protection Act, improving senior VA officials’ ability to fire failing employees while establishing important safeguards to protect whistleblowers.
The VA is beginning the process of adopting the same electronic health records as the Department of Defense.
The VA has acted to increase transparency and accountability by launching an online “Access and Quality Tool” to provide veterans a way to access wait time and quality of care data.
Wait times are now posted online for each of the 168 medical centers managed by the VA.
The VA plans to dispose of 430 vacant buildings in the next 24 months, and is reviewing another 784 underutilized buildings.

Federal Court Orders State Department to Conduct a Search of Benghazi Emails of Hillary Clinton’s Closest Advisors

Washington DC in what can only be considered a major victory for Judicial Watch, Thursday they announced that on August 8, 2017, D.C. District Court Judge Amit P. Mehta ordered the State Department “to search the state.gov e-mail accounts of Huma Abedin, Cheryl Mills, and Jacob Sullivan,” former aides of Hillary Clinton during her tenure as Secretary of State. The State Department is ordered to search in those accounts “for records responsive to [Judicial Watch’s] March 4, 2015, FOIA [Freedom of Information Act] request.” (A separate Judicial Watch FOIA lawsuit first broke open the Clinton email scandal.)

Judge Mehta described Judicial Watch’s Clinton Benghazi FOIA lawsuit as “a far cry from a typical FOIA case. Secretary Clinton used a private e-mail server, located in her home, to transmit and receive work-related communications during her tenure as Secretary of State.” Further:

[I]f an e-mail did not involve any state.gov user, the message would have passed through only the Secretary’s private server and, therefore, would be beyond the immediate reach of State. Because of this circumstance, unlike the ordinary case, State could not look solely to its own records systems to adequately respond to [Judicial Watch’s] demand.

[The State Department] has not, however, searched the one records system over which it has always had control and that is almost certain to contain some responsive records: the state.gov e-mail server. If Secretary Clinton sent an e-mail about Benghazi to Abedin, Mills, or Sullivan at his or her state.gov e-mail address, or if one of them sent an e-mail to Secretary Clinton using his or her state.gov account, then State’s server presumably would have captured and stored such an e-mail. Therefore, State has an obligation to search its own server for responsive records.

State has offered no assurance that the three record compilations it received [from Secretary Clinton and her aides], taken together, constitute the entirety of Secretary Clinton’s e-mails during the time period relevant to Plaintiff’s FOIA Request. Absent such assurance, the court is unconvinced “beyond material doubt” that a search of the state.gov accounts of Abedin, Mills and Sullivan is “unlikely to produce any marginal return.”

Accordingly, the court finds that State has not met its burden of establishing it performed an adequate search in response to Plaintiff’s FOIA Request and orders State to conduct a supplemental search of the state.gov e-mail accounts of Abedin, Mills, and Sullivan.

“This major court ruling may finally result in more answers about the Benghazi scandal – and Hillary Clinton’s involvement in it – as we approach the attack’s fifth anniversary,” said Judicial Watch President Tom Fitton. “It is remarkable that we had to battle both the Obama and Trump administrations to break through the State Department’s Benghazi stonewall. Why are Secretary Tillerson and Attorney General Sessions wasting taxpayer dollars protecting Hillary Clinton and the Obama administration?”

Judicial Watch asked a federal court to compel the Trump State Department to undertake a thorough search of all emails of former Secretary of State Hillary Clinton regarding the terrorist attack on Benghazi, including those of Clinton’s closest advisors. Judicial Watch also specifically asked the court to compel the agency to produce all records of communications between Clinton and top aide Jake Sullivan relating to Ambassador Susan Rice’s appearance on NBC’s “Meet the Press” the Sunday following the 2012 Benghazi massacre.

The State Department has until September 22, 2017, to update the court on the status of the supplemental search and production of additional emails to Judicial Watch.

On May 6, 2015, Judicial Watch filed a lawsuit when the State Department failed to respond to a March 4, 2015, FOIA request (Judicial Watch, Inc. v. U.S. Department of State (No. 1:15-cv-00692)), seeking:

All emails of former Secretary of State Hillary Rodham Clinton relating to the September 11, 2012 attack on the U.S. Consulate in Benghazi, Libya.
The timeframe for this request is September 11, 2012 to January 31, 2013.

North Korea Armageddon?

The People’s Republic of Korea , Does the Media or the American people really believe North Korea has 60 Nuclear Warheads? IF they do, I’m sure they don’t have more than 5 or 6 missiles capable of reaching the U.S. or even Guam, and half will probably explode prematurely while the other half can be destroyed by U.S anti-missile missiles. They also probably don’t have more than 2 or 3 warheads that have been miniaturized enough to fit a missile, and the strength of their warheads (in order to make as many as possible) was about the yield of the A-bombs that hit Hiroshima and Nagasaki – roughly 15 kilotons, compared to U.S. 20 megaton Nuclear bombs.

North Korea is always dangerous, because Kim Jong Un is a psychotic nut job, but President Trump is right to call him out because Un wants to stay in power. He knows that if he really tries to bomb the U.S., South Korea, or our allies, Trump WILL destroy him and his armies. Then, the Koreas can unite and finally have peace and prosperity. Neither China nor Russia will do a thing about it, especially if NATO goes on alert.
