There’s a big difference between ‘opinion’s’ and ‘slander’.
If someone makes a statement about a particular individual that is false and or defamatory, I’d say they could be liable for it. (one would have to prove damages in court and that’s a difficult and expensive task)
A ‘public person’ *elected official, govt employee* vs a ‘private person’ also has certain definitions and parameters of what is acceptable and expected to be written about them.
If I recall, one of the earlier online blogs set a legal precedent where online posters could state opinions, but not false accusations and slander.
The blog owner was sued and the problem there…and im not 100 percent certain…had to do with his editing of posts or selectively allowing some posts and not others vs. allowing all posts.
It was “emerson eye’ or ‘eye on emerson’… something along that name.

More than five months have passed since Ridgewood had a permanent municipal manager, surpassing the period in 2009 when the village was last between full-time chief administrative officers.

But the search for a new manager is reaching its end, Mayor Paul Aronsohn said last week, telling The Ridgewood News that he expects the Village Council to make a decision “by early March.”

Over the past year, governing bodies throughout Bergen County have witnessed changes in their administration for reasons such as inflated salaries and poor decision-making.

In addition to Ridgewood, towns including Hackensack, Emerson and Bogota either lost or removed administrators and managers in 2013.

It was unclear this week whether any of those former administrators applied for the job in Ridgewood.

Hardly a week goes by that does no bring angry mail about drivers who get away with violating the ban on using hand-held cellphones behind the wheel.

“We need increased surveillance,” complained a reader from Paramus. A Hawthorne reader wants police to use unmarked cars to catch abusers. A Wanaque man wants teams of cops stationed at street corners. A man from Emerson thinks camera surveillance would stem the flood of cellphone-related crashes.

Police rarely embrace such notions, citing staffing shortages and more serious priorities for a perceived dearth of cellphone tickets. But what other traffic priority could be more serious than distracted driving? What causes more fatalities?

Too often journalists rely on police responses to such questions instead of the facts found in court records. Figures from the New Jersey Administrative Office of the Courts show that police are not ignoring cellphone violations. They ticketed 81,125 of them in the 12 months ended May.

That’s 1,560 a week — 192 in Bergen; 64 in Passaic.

Reader asks did administrators and teachers “walk to school” for the month of October ?

Ridgewood NJ, Since October was named “Walk to school month” many readers have inquired if teachers and administrators have practiced what they preached ?

Did Superintendent Dan Fishbien or members of the BOE walk to the Ed Center ? Did they join the Ridgewood School community in celebrating Walk-tober Fest! Taking some time this month to promote health, safety and the environment by walking to school – or just simply taking a walk. Keeping motorists away from school campuses will create a safer environment for students who choose to walk or ride their bikes to school.

Did they foloow there own advice as advertised that “walking to school promotes safety, health, concern for the environment and physical activity.”

Few people know how to take a walk. The qualifications are endurance, plain clothes,old shoes, an eye for nature, good humor, vast curiosity, good speech, good silence and nothing too much.

Three men were struck and killed by NJ Transit trains over a period of less than 24 hours, including one in Fair Lawn during Thursday morning’s commute and another on the border of Westwood and Emerson.

Service was suspended for one hour on the Bergen County Line after Stephen Van Kirk, 59, of Fair Lawn, was struck at about 7 a.m. near the Radburn station in Fair Lawn, NJ Transit said.

Robert Derosa, 26, of Washington Township, was struck just after midnight on Thursday by a Hoboken-bound train on the Pascack Valley Line in a secluded, heavily wooded area on the Westwood-Emerson border, NJ Transit said.

On Wednesday, a 57-year-old Aberdeen man jumped in front of a train on the North Jersey Coast Line at about 1:30 p.m. Wednesday, the agency said.

The Emerson Board of Education (BOE) appointed Brian Gatens as Emerson’s new superintendent of schools on Monday.

“Congratulations… The whole board was in agreement that you were our guy,” said BOE President Mary Reid at a special meeting held to appoint Gatens on July 8.

Pending transition timelines, the BOE anticipates Gatens’ start date will be during or near late summer. “Preferably before the start of the school year,” explained Interim Superintendent Larry Hughes.

When prosecutors charged two Bergen County men with causing the “drug-induced death” of an Emerson woman this week, they applied a rarely used statute that — although on the books since 1986 and upheld decisively by the state Supreme Court — remains the subject of legal debate, because of its severity and the difficulties of proving the charge.

The Strict Liability in Drug-Induced Deaths statute essentially treats suppliers as killers if the drugs that they placed on the street wind up causing a death. It is rarely used because the chain of supply leading to the death can be tough to trace.

Often, in the case of an overdose death, “all they have is a dead body,” Bergen County Prosecutor John L. Molinelli said. “We know they took the drugs, but we don’t know where they got it from.”

In a clear escalation of the war on the heroin trade and the growing epidemic of overdoses, authorities on Wednesday charged two Bergen County men with causing the “drug-induced death” of an Emerson woman by supplying her with the drugs that led to a fatal overdose.

The decision by Bergen County prosecutors signals a move to go after small-time dealers, using a decades-old law that equates suppliers with killers if the drugs that they placed on the street end up causing a user’s death.

Christopher Benvenuto, 27, of Old Tappan and Jessie Kurzweel, 26, of Closter, were the latest to be charged with “strict liability for drug-induced death” by prosecutors across North Jersey over the last few months. Doreen Leach, 47, of Emerson, died Tuesday of a suspected heroin overdose.

“The local street dealers who think they can get away with probation because they are dealing in small amounts have to understand that, every time they do that, they are risking a substantial amount of prison time,” Bergen County Prosecutor John L. Molinelli said Wednesday.

Lightning strikes are “a very real danger that people need to be aware of,” says Westwood Mayor John Birkner.

Birkner has been researching lightning detection systems for his town, which is looking to join the growing number of New Jersey communities that already have such systems in place, sounding alarms when dangerous storms are near.

Last year 28 people nationwide were killed by lightning, including three in New Jersey, the second highest number for any state, data show. One lightning victim was a Haworth man struck and killed as he watched his grandson play soccer in Demarest. The other two died on the beach in separate incidents at the Jersey Shore.

In 2006, the previous year New Jersey had three lightning deaths, two were teenagers killed on a soccer field in Montvale.

Detection systems monitor lightning strikes and warn the public when potentially dangerous storms fall within a certain radius of the area. The system typically sets off alarms that have been installed at fields and playgrounds, warning the public to leave those open areas. The system also gives an all-clear signal when the danger has passed.

Cresskill recently installed a lightning detection system, Tenafly is seeking bids for a system for its municipal and school fields, and Westwood is considering a joint purchase of a system with Emerson and Washington Township.

A consortium of eight schools and seven towns in the Northern Valley is solidifying plans for a cooperative purchase of a $200,000 lightning detection system.

Communities including Wayne, Rutherford, Ridgefield, Dumont, Ridgewood and Ho-Ho-Kus already have systems in place.

Voters went to the polls in 23 North Jersey school districts Tuesday, and, in large part, gave approval to proposed tax levies and spending ranging from spending on security to expansion of a gymnasium.

Unofficial results from Englewood, Hackensack, East Rutherford, Emerson, Norwood, Midland Park, Ridgewood, Oakland, Garfield, Fairview, Wood-Ridge, Ramsey and Harrington Park – all in Bergen County — showed voters approving the tax levies.

Almost One-Third of State Sheriffs’ Organizations Now Oppose Obama Gun Control

According to a recent Washington Examiner article, a total of 14 sheriffs’ associations now oppose President Obama’s proposed gun control measures.

The article notes that sheriffs’ associations in South Carolina, California and, most recently, Nevada, have joined thegrowing group of other state associations in demanding that Obama stop going after law-abiding gun owners and instead focus on improving the National Instant Criminal Background Check System.

“We have all seen what persons who have mental illness, who are users of illegal controlled substances, or are members of criminal gangs can do with weapons in their hands; any weapons, not just firearms.  As it currently stands, many of these individuals are not entered into the National Instant Criminal Background Check System for a whole variety of reasons.  This must be addressed at the national, state and local levels,” said the Nevada sheriffs.

“The sheriffs of the state of Nevada do not believe that the answer to this issue includes making criminals out of otherwise law-abiding individuals. As the old saying goes, ‘As guns are outlawed, only outlaws will have guns.’ The answer lies within a myriad of approaches including education, addressing violence, keeping firearms out of the hands of the mentally ill, criminal gang members, and illegal controlled substance users, as well as prosecuting and incarcerating those who would use firearms to commit crimes.”

The Ridgewood Concert Band Presents , “Music Electronic”

Ridgewood NJ , The Ridgewood Concert Band (RCB) is proud to continue their 30th Anniversary Season with their upcoming concert on Friday. Titled “Music Electronic”, the concert will feature a wide variety of music ranging from the world premiere of “X-ING for Electric Viola and Concert Band” to a selection of holiday favorites. The band will also continue their season-long tribute to composer John Barnes Chance with the performance of his second symphony.

The RCB looks forward to sharing this concert and hopes to see you on Friday!

Guest Conductor: Frank L. Battisti

Frank L. Battisti is the Conductor Emeritus of the New England Conservatory of Music Wind Ensemble. Under Mr. Battisti’s leadership, the Ensemble established a national and international reputation for being one of the premiere ensembles of its kind in the United States. It has performed often at music conferences, in live radio concert broadcasts over the National Public Radio (NPR) Network and has recorded for Centaur and Golden Crest Records.

During the past 40 years Mr. Battisti has been responsible for commissioning and premiering many works for wind ensemble by distinguished American and foreign composers. Critics and colleagues have praised him for his commitment to contemporary music and his outstanding performances. Mr. Battisti is a very active guest conductor, having directed many professional, university, college, military and high school ensembles in the United States and all over the world. The Ridgewood Concert Band is very excited to have the opportunity to work with him and to perform under his baton at this concert.

Guest Soloist Martha Mooke

Martha Mooke was featured by her hometown paper, The Staten Island Advance, in an interesting article that includes information about the piece she will premiere on Friday with the RCB.

Season Spotlight: Composer John Barnes Chance

This season the Ridgewood Concert Band is paying tribute to composer John Barnes Chance. The RCB website features an interactive page with information about his biography and works.

The featured work for the December concert is Chance’s Second Symphony. The symphony had its origins in a 1962 “contest” between John Barnes Chance and composer Clifton Williams, his teacher and mentor who agreed that each would write a work using the four-note motif: C#-D-F-E. When Chance sent a tape of part of his work to Williams, the latter gave up, and Chance turned to other endeavors. In 1972, the Northwest Music Center in North Dakota commissioned him to write a work dedicated to the Minot State College Wind Ensemble. He resurrected the earlier work and added to it, creating this symphony. His accidental death soon after precluded his ever hearing it performed.
