Court Rules Against Development in Single Family Zone in Paramus

Paramus NJ, a New Jersey appeals court has upheld the Paramus zoning board’s decision to reject a 35-unit multi-family development in a part of the borough that is zoned for single-family homes only. The developer Highview Homes proposed a 45-unit development for the site that would include parking and other amenities in 2016. Homes had purchased 1.8 acres on Sorbello Road,the project required that three single-family homes on the property be demolished.

The developer later scaled back its project to 35 units, but when the company sought variances so it could build, the zoning board rejected the plan, since the property sits in an R-100 zone, which only allows for single-family homes.

In its Thursday  ruling, the court said the zoning board’s reasons “for denying the plaintiff’s application find ample support in the record.” Citing a 2005 decision, the court noted that “public bodies, because of their peculiar knowledge of local conditions, must be allowed wide latitude in their delegated discretion.

  4. Funny thing is if we ask to oppose developers, VC (+BOE, library, RW Moms and Dads etc.) will respond by saying that we can get sued and incur $$$ in court costs. In the meantime they have no problem asking for MILLIONS of $ for unnecessary and grandiose expenses. These people are insane.
