Wayne NJ, a second developer has hit Wayne township with a builder’s remedy lawsuit, this time to force a “substantial” housing project on pristine woodland off of Berdan Avenue.
The township had been shielded from such litigation, until a judge ruled two months ago that officials’ procrastination in fulfilling their affordable housing demand was grounds to abolish that immunity.
The lawsuit targets a 15.4-acre site, just south of the township’s borders with Franklin Lakes and Oakland. The land abuts a protected forest and network of hiking trails to the east, called High Mountain Park Preserve.
According to the 10-page complaint filed in state Superior Court in Paterson, the parcel is suited for a mixed-use or high-density residential development,
The lawsuit does not specify what the proposed development would be, only that it will include some affordable housing.
Thanks to the liberal democrats on the NJ Supreme court we have the ‘mt laurel’ ruling that these developers use to their advantage to supersede local zoning laws.
My parents busted their ass to move here from Passaic so they don’t have to live with the low-lifes that ruin these inner cities with their crime and drugs…. and the Mt Laurel forces them to live with them here with the court mandated low income housing.

It seems that no matter how far you wish to raise your family away from crowded, crime and drug ridden, violent communities, your elected officials continue their attempts to bring the city to your door. I don’t blame the developers; they see an opportunity to make more money. I blame all those who have continued to vote they way they do in New Jersey. Doesn’t anyone read ? NJ is #1 for the 3rd year in a row of highest percentage of people moving out. Soon there will be no tax base to support all of the “programs”, and property values will shrink by 50% in my opinion.

I have been working to reverse the Mt. Laurel planned destruction of the environment in Wayne: I delivered an extensive written and oral critique to the NJ Superior Court at its most recent ‘fairness hearing on Wayne on March 23, 2021. Anything accomplished in Wayne can be applied elsewhere where the developers and compliant local officials follow the same game plan. Beyond that is a procedural flaw that also may be common.
