Franklin Lakes NJ, Scott Lieberman of Franklin Lakes, who is accused of causing the death of 92-year-old Albert Schnellbacher in a 2022 car crash, now faces a civil lawsuit. Indicted on vehicular homicide charges in March 2023, Lieberman had previously been charged with reckless manslaughter in October 2022. The incident involved Lieberman’s Ferrari Competizione striking Schnellbacher’s Chevy Equinox as the elderly man was turning left on Windsor Road from Briarcliff Road in Teaneck. Allegations against Lieberman include driving recklessly, crossing the yellow line, and speeding. He was released with conditions on October 6, 2022.
Civil Lawsuit Details
The lawsuit, filed by Schnellbacher’s widow, Elfriede, in Bergen County Superior Court, not only names Lieberman but also includes several individuals associated with World Wide Ferrari and its parent company. The suit accuses Lieberman of driving the Ferrari in a “careless, reckless, and negligent manner,” resulting in Schnellbacher’s death. Additionally, it charges the other defendants with negligence, claiming their failure to act contributed to the fatal crash.
Allegations Against World Wide Ferrari
The lawsuit asserts that Lieberman relied on the defendants’ “skill and judgment” regarding their warranties, which they allegedly breached. It claims that they were responsible for instructing him on proper vehicle operation and failed to inform him of a defect and recall from Ferrari. According to the suit, the defendants did not return the Ferrari to fix these issues, thereby contributing to Schnellbacher’s death.
Impact on Schnellbacher’s Family
Elfriede Schnellbacher’s suit highlights the financial and emotional impact of her husband’s death. She was financially dependent on him, and the loss has deprived her of his support and companionship. The lawsuit also emphasizes the significant contributions Schnellbacher made to his family, including his children and grandchildren, who have lost his “services, assistance, companionship, advice, guidance, counsel, and training.”
Seeking Damages
The Schnellbacher family is seeking various damages, including compensation for pain and suffering, pre-impact terror, monetary and compensatory damages, interest, and the cost of the lawsuit. World Wide Ferrari has not yet responded to requests for comment.
