Fort Lee NJ, Bergen County Prosecutor Mark Musella announced the arrest of FATOU DIABY (DOB: 5/24/1995; single; medical assistant) of 55 W 129th Street, Apartment 3F, New York, NY, on charges of Leaving The Scene Of A Motor Vehicle Accident Resulting In Serious Bodily Injury and Hindering Apprehension. The arrest is the result of an investigation conducted by the Bergen County Prosecutor’s Office under the direction of Chief Robert Anzilotti and the Fort Lee Police Department under the direction of Chief Matthew J. Hintze.
At approximately 12:23 p.m. on June 8, 2020, the Fort Lee Police Department responded to a report of motor vehicle accident at the intersection of Hudson Terrace and Myrtle Avenue. Upon arrival, officers located a 23-year-old male lying in the roadway with multiple serious injuries. He was transported to Hackensack University Medical Center for treatment and has since been discharged. Multiple witnesses reported to responding officers that the operator of the other vehicle involved, a red Honda Accord, had initially stopped and checked on the status of the victim, but then got back in her vehicle and left the scene prior to police arrival.
As a result of the investigation, FATOU DIABY was arrested on Monday, July 13, 2020 and charged with one count each of Leaving The Scene Of A Motor Vehicle Accident Resulting In Serious Bodily Injury, in violation of N.J.S.A. 2C:12-1.1, a 3rd degree crime; and Hindering Apprehension, in violation of N.J.S.A. 2C:29-3.b(1), a 4th degree crime. DIABY is scheduled for a first appearance in Central Judicial Processing Court in Hackensack on Friday, August 14, 2020.
Prosecutor Musella states that the charges are merely accusations and that the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt, and he would also like to thank the Fort Lee Police Department for its assistance in this investigation.
