Over 20,000 People Sign Petition to End Jersey City’s Short Term Rental Ban

Jersey City NJ, Statement from Airbnb on Jersey City Referendum Campaign the Jersey City Clerk certified the petition submitted by the Jersey City short-term rental community, backed by Airbnb, against Ordinance 19-077.

This ordinance — passed by the Jersey City Council and signed by Mayor Fulop in June — would severely restrict residents’ ability to share their properties as short-term rentals.

The following statement can be attributed to an Airbnb spokesperson: “Today, the 20,000 individuals who stood against Mayor Fulop’s short-term rental ban by signing our community’s referendum petition have been heard. Their message is simple: The people of Jersey City will not remain silent as elected officials push through bad policy that jeopardizes the financial livelihoods of their neighbors. Now, we call on the City Council to respect the wishes of their constituents by throwing out this unpopular ordinance and starting over, collaborating with the short-term rental community and small business leaders to craft and implement common-sense regulations without destroying a thriving economy. We stand ready to work with them to find this path forward — and if not, our community looks forward to bringing this issue to the polls in November.”

Jersey Shore town’s rule targeting Airbnb rentals to get public hearing

TOMS RIVER — The public will get a chance to chime in on a revised version of a controversial ordinance regulating short-term rentals, like those found on Airbnb and Vacation Rentals By Owner.

The amended ordinance eases restrictions on the minimum number of rental days on properties on the barrier island from three nights to two nights through April 1 through Nov. 30.

“It was determined that a minimum two-day rental during an extended season would be more workable on the barrier island and would not detract from the overall purposes of the ordinance,” it states.

A minimum 30-day stay will be enforced in all other parts of Toms River.

The township’s assistant attorney, Anthony Merlino, told the Asbury Park Press that the original ordinance was introduced after the council received complaints of houses advertised on Airbnb as daily rentals.

NJ lawmakers take step toward taxing Airbnb and home-sharing rentals

New Jersey lawmakers are moving ahead with plans to tax and regulate home-sharing operations like Airbnb. And while the company is OK with collecting taxes, it doesn’t like the approach being taken to license or prohibit the short-term rentals it brokers.

Assemblywoman Annette Quijano, D-Union, said New Jersey’s tax laws need to be updated to keep up with technology and the home-sharing portion of the hospitality industry.

“It’s unfair to hotels and motels that have to compete with a new business model that provides essentially the same service but does not have to charge state sales tax, the state hotel/motel fee and a municipal hotel tax, which can total up to 18 percent in some areas,” Quijano said. “That’s a very significant disparity and a significant barrier to overcome.”

Last year, more than 6,000 New Jersey hosts earned over $50 million through 257,000 short-term rentals arranged through Airbnb.

More NJ towns getting rid of Airbnb and short-term rentals

The war rages on in North Jersey against short-term rentals made possible through companies such as Airbnb.

Residents using these services can link with folks looking for a place to stay for a night or two, or a week. And their home, or a room, essentially becomes a temporary hotel.

Due to their proximity to New York City, many residents of North Jersey counties are bringing in big bucks through the rental market. But one by one, municipalities are saying the practice has to go.

In the middle of January, Ridgewood became the latest in a growing list of Bergen County towns to ban rentals of 30 days or less.

“Upwards of $1,000 is the fine for violation of that ordinance,” said Mayor Susan Knudsen.

According to Knudsen, town officials received a number of complaints from concerned residents, disturbed by increased traffic volume and different faces and vehicles entering and leaving driveways on a weekly basis.

“We have small residential neighborhoods that were never intended to be bed and breakfasts or homes that were seconding as an inn,” she said.

Ridgewood may revisit short-term rentals in the future, Knudsen said, if proper regulations are in place.

North Jersey Towns Move To Ban Air BnB, Other Short Term Rentals

RIDGEWOOD, N.J. (CBSNewYork) — Short term room rentals are big business in the New York area, but towns in northern New Jersey are moving to ban them and homeowners could face fines.

Suzanne Warfield told CBS2’s Meg Baker that she thinks of herself as a super host — renting a room in her home for more than two years now, and charging $100 a night — she made more than $14,000 in 2016.

Now, the Village of Ridgewood has put a ban on short-term rentals.

“The village has legitimate concerns about party houses, that’s not me. I am a single woman, enjoy living in this community, and being able to rent a bedroom is allowing me to stay in my home during difficult financial times,” she said.

Many of her guests are repeat customers with ties to the area, or couples looking for a new home.

“Three sets of grandparents who come into town to visit their grandchildren,” she said.

In Ridgewood, there are 63 homes playing host to Air BnB. The village had 3,000 guests in 2016.

Ridgewood’s mayor said the niche travel industry had not been addressed with zoning rules until now.

Ridgewood NJ, Bottom line, there’s now an ordinance that prohibits such short term rentals. Those wishing to snub their noses at it and continue (or start) running such operations risk being fined $1000 per day if found guilty in municipal court.

ORDINANCE NO. 3570 AN ORDINANCE TO AMEND CHAPTER 117 OF THE CODE OF THE VILLAGE OF RIDGEWOOD ENTITLED “BUSINESSES AND OCCUPATIONS” AT ARTICLE I, SECTION 1A, AND TO CREATE A NEW ARTICLE IX ENTITLED “SHORT TERM RENTALS”. AMEND: ARTICLE I Section 117-1A ADVERTISE OR ADVERTISING: Any form of solicitation, promotion, and communication for marketing, used to solicit, encourage, persuade, or manipulate viewers, readers, or listeners into contacting for goods and/or services in violation of this Ordinance, as same may be viewed through various media including, but not limited to, newspapers, magazines, flyers, handbills, pamphlets, commercials, radio, direct mail, internet websites, or text or other electronic messages for the purpose of establishing occupancies or uses of rental property, for Consideration, which are prohibited by this Ordinance. HOUSKEEPING UNIT: Constitutes a family-type situation, ,involving one-or-more persons, living together that exhibit the kind of stability, permanency and functional lifestyle equivalent to that of a traditional family unit, as further described in the applicable reported and unreported decisions of the New Jersey Superior Court. OCCUPANT: Any individual inhabiting, using, living, gathering, entertaining, being entertained as a guest, or sleeping in a dwelling or a portion thereof, or having other permission or possessory rights or interest in the dwelling. OWNER: Any person(s) or entity(ies), association, limited liability company, corporation, or partnership, or any combination, who legally use, possess, own, lease, sub-lease or license (including an operator, principal, shareholder, director, agent, or employee, individually or collectively) that has charge, care, control ,or participates in the expenses and/or profit of a Dwelling Unit pursuant to a written or unwritten agreement, rental, lease, license, use, occupancy agreement or any other agreement. NEW ARTICLE ARTICLE IX: SHORT TERM RENTALS SECTION 117-56 – PERMITTED USE The residential occupancy of an otherwise lawful and lawfully occupied dwelling for a period of thirty (30) days or less by a person who is a member of the Housekeeping Unit of the Owner, without Consideration, such as house guests, is permitted. SECTION 117-57 – PROHIBITIONS: No person shall undertake, maintain, authorize, aid, facilitate, solicit and advertise any rental activity that violates any part or provisions of this Article. SECTION 117-57 -SHORT TERM RENTAL PROPERTY: Notwithstanding anything to the contrary in the Village Code, it shall be unlawful for any person, including but not limited to, and owner, lessor, sub lessor with any possessory interest in any dwelling, to receive compensation of any kind for the use, occupancy, or rental of any dwelling for a period of thirty (30) days or less. SECTION 117-59 – ENFORCEMENT: The provisions of this Article shall be enforced by the Village Zoning Officer, Fire Department, Police Department and any other Village Official or employee so designated by the Village Manager who all shall be authorized to issue summons or other appropriate civil violations or complaints for any violations of the terms and provisions of this Article. SECTION 117-60 – FINES AND PENALITES: Any person who is found or adjudicated to have violated any provisions of this Article shall be liable for a fine not to exceed one thousand ($1000.00) Dollars. Each day of any such violation after receiving written notice of same shall be a new and separate violation. SEVERABILTY: If any portion of this Ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered. Except as hereby amended, all other sections of the Code of the Village of Ridgewood shall remain in full force and effect.
