Ridgewood NJ, Fraudster and Theranos founder Elizabeth Holmes’ months-long battle to extend her freedom is over: A federal court judge late Monday denied the former Tech darlings bid to delay imprisonment, ruling she must surrender April 27 to serve her sentence for felony fraud at a Texas prison camp.
Judge Edward Davila wrote in his ruling that he found Holmes was not a flight risk or danger to the public, but he concluded she had not raised any substantial questions of law or fact that would be likely to result in a reversal of the jury’s fraud verdict or a new trial. “Ms. Holmes is in no position to inflict similar harms of fraud on the community, and the Court is unaware of any evidence that she is likely to commit acts of deception or fraud in her everyday life,” Davila wrote.
Elizabeth Holmes was the founder and former CEO of Theranos, a healthcare technology company that claimed to have developed a revolutionary blood testing system that could perform a wide range of tests using just a small amount of blood. The company was founded in 2003, and at its peak, it was valued at $9 billion.
In 2015, a series of investigative articles in the Wall Street Journal raised serious questions about the accuracy and reliability of Theranos’s technology. Subsequent investigations by regulatory agencies and criminal charges revealed that the company’s claims were largely fraudulent, and that it had misled investors, medical professionals, and patients.
In 2018, Holmes and her former partner, Sunny Balwani, were indicted on multiple counts of wire fraud and conspiracy to commit wire fraud. Their trial is set to begin in March 2022. If convicted, they could face up to 20 years in prison.
