Pressure Mounts to Limit Governor’s Emergency Powers

Trenton NJ, In response to months of mandatory shutdown across the state, 10th District Legislators Senator Jim Holzapfel and Assemblymen Greg McGuckin and John Catalano have sponsored a resolution which would prevent the overreaching of the Governor’s executive powers.  SCR-117 and ACR-181 proposes a constitutional amendment to limit effective period of certain emergency orders, rules, or regulations issued by Governor to 14 days.

“We cannot allow one person’s decisions with such far-reaching consequences to impact an entire state for so long without legislative input,” said Senator Holzapfel. “This measure would ensure that the people’s elected representatives from all corners of the state have a say in whether consequential emergency orders should be extended.”

The proposed amendment would provide that certain emergency orders, rules or regulations issued by a governor during a state of emergency will terminate on the 15th day after issuance unless the Legislature approves an extension. This will force the governor to work with the Legislature.

“The months of shutdown have made it clear to all lawmakers and our residents that the Governor’s Executive powers need to be checked,” added Assemblyman McGuckin.  “The legislature is a co-equal branch of government, elected by the people and we believe that no Governor should have absolute power.”

The legislators believe that this constitutional amendment is necessary to prevent excessive unilateral decisions without the input of the legislature.  This resolution would give the power back to the people with a vote on an amendment to the state constitution placing restrictions on executive authority

“The people have had enough,” concluded Assemblyman Catalano.  “In times of crisis, we need the appropriate checks and balances and this amendment to our State Constitution will ensure that the power is given back to the people.”

  2. The pressure is mounting..No the pot is about to explode. What needs to come about is a bill that limits all governors powers over in cases of State of emergencies. Also governors powers to borrow outrageous sums of money and add taxes without a people vote

  3. People may well have had enough but go ahead open up way to soon and see what happens. FYI I’m all for getting back ASAP but when it’s right.
    I think both NJ and NY governors have done a great job.

    What…will we see another surge in deaths at nursing homes and long-term care facilities? Did the NY and NJ governors not make sure to seal a great many of those residents’ fates by arguably deliberately “corralling”, if you will, the COVID-19 virus in their very homes, from which they could not escape?

    Or … will we see a surge in hospitalizations in unfortunate people whose physician-prescribed access to chloroquine or hydroxychloroquine was severely curtailed by corrupt and ice-hearted bureaucratic fiat, solely because, instead of rheumatoid arthritis or lupus, their underlying diagnosis was COVID-19, a disease the Orange-Man-burning flames of which guys like Murphy and Cuomo are desperate to fan between now and November, regardless of who gets sick or dies, or how many (i.e., the more the better)?

    Mental exercise: replace “governors powers” with “presidential powers” and see if you agree with the following statement. On either “side”, it strikes how how messed up things are right now….
