Building a Legal Strategy

Lawyers handle a variety of cases for a wide range of clients. They aim to gather enough information and evidence in order to develop a winning strategy. The strategy is the cornerstone of their court case, and it’s designed to ensure success. Lawyers also ensure that their clients are prepared by educating them on the best strategy to use in court.

Nevertheless, building a strong case can be difficult, especially when the evidence is scarce. To shape their strategy, lawyers rely on the factual evidence. The case may not be in the client’s favor if there are no substantial facts.

Private investigators are often hired by lawyers because of this need. An investigator who is proficient will diligently investigate all avenues in order to uncover pertinent facts. Investigators conduct research, interviews, surveillance and more to gather information that is crucial for a case.

Private Investigators’ Vital Role In Surveillance

When it comes to surveillance, choosing the right private investigator for your firm is essential.

Private investigators who are proficient in their field undergo rigorous training before they can obtain a license. The training provides them with the skills they need to provide services to lawyers, such as surveillance.

The art of surveillance requires a high level of skill. The investigator must closely monitor the individual’s behavior and activities while keeping a discrete distance. The case is compromised if the subject detects you. To ensure successful surveillance, it is important to remain unnoticed in order to avoid any changes in behavior.

Conducting surveillance for a lawyer demands utmost subtlety. The person under surveillance must remain unaware of the presence of the investigator. A lawyer’s ability in determining a strategy depends on the subject’s normal behavior. A private investigator who is familiar with the admissibility rules of evidence at court can be invaluable. If evidence is gathered incorrectly, it could be dismissed in court, which would undermine the efforts of the lawyer to win their case.

Different types of Legal Surveillance Services

The motivations for conducting surveillance can vary greatly, even though the techniques themselves are the same. These services show several examples of surveillance performed by a private detective for a lawyer.

Divorce Proceedings: Uncovering Infidelity

Many prenuptial contracts in modern marriages include terms regarding fidelity. Infidelity, for example, could prompt the non-offending spouse to file divorce without any financial obligation toward the cheating partner.

Malerie Rose, a family lawyer with Rose Family Law in Mississauga says “we often hire private investigators to substantiate accusations of infidelity. We  do not have the expertise or resources to monitor suspects independently”.

Private investigators use a variety of resources to determine infidelity. To gather information, they may interview family members, neighbours, or friends. Surveillance is the most common method of detecting infidelity.

Child Custody Disputes: Establishing Parental Unfitness

A nurturing environment is essential for the well-being of a child. Unfortunately, many households do not provide this type of care. Many lawyers help people who are concerned about the ex-partners’ ability to care for their children to modify child custody agreements.

A parent may be unsuitable to have custody of a child for a variety of reasons, such as abuse, substance abuse or neglect. In these cases, attorneys heavily rely upon private investigators for surveillance of the accused parent.

Private investigators conduct surveillance on the ex-parent to determine if their behavior is appropriate. The investigator will detail the actions of the ex-parent who has custody over the weekend. For example, if they leave the house on Saturday night and return five hours later. The lawyer will then use this information to support their case.

Concealed Assets

During divorce proceedings, it is common to find that one spouse takes great measures to conceal money, real estate or valuable items such as jewelry.

Hide assets to lower an individual’s financial worth. The court may order a settlement that is far less than what the spouses are entitled to. Illegally hiding assets can lead to substantial fines.

Private investigators use surveillance as their primary method of locating hidden assets. Research is important, but surveillance can pinpoint the exact location hidden assets. Private investigators can track an individual’s activities, such as if they suddenly travel to the Caribbean. They may be able to identify frequent visits to multiple banks.

The private investigator will then use their experience to determine if there are any hidden accounts in these banks. The private investigator may discover hidden items, such as jewelry in a safe deposit box instead cash. These revelations are invaluable to an attorney, as they can strategize with the client.

Fraudulent Activities

Private investigators are a vital resource for lawyers in fraud cases. Although a large part of their job involves extensive research and surveillance, it remains an important component in many cases.

Calvin Barry, a Toronto DUI and criminal attorney, says that insurance companies in Ontario often deal with dubious claims. Private investigators are hired by these companies through their legal representatives. These investigators use surveillance techniques to verify the validity of claims. The information gathered is then relayed to legal staff of the insurance company. These lawyers then assess whether there is a case against the person in question.

In the end, lawyers need substantial information in order to help their clients. For a strategy that will withstand the pressures of court, it is essential to have solid evidence. Private investigators are invaluable in this endeavor. They can help you achieve a positive legal outcome.
