The breathalizer only checks for alcohol content. So a low alcohol content is one thing but what if he smoked weed? That doesnt show up on any field tests so they rely on the sobriety tests. Dumb ass shouldnt have refused. I hope he gets the same penalty that anyone else does who refuses.
“False positives” in field sobriety tests are quite common. Its why they have breathalyzers. Whenever anyone refuses they are routinely charged with both refusal and DWI–separate offenses. Based on reports that he subsequently tested well below legal limit, he was likely drinking but not drunk,, refusal penalty is automatic whether you are drunk or not
