Bellmawr NJ, Ian Smith and Frank Trumbetti appeared before a judge on Monday and the judge ruled that they can continue to keep their doors open.
The owners of a Bellmawr gym who were in violation of Gov. Phil Murphy’s executive order to remain closed had first closed in March under a statewide emergency order, the gym opened without permission on May 18 and then padlocked by the state on May 22 under a court order.
Atilis Gym owner Ian Smith announced on an Instagram post Tuesday that the judge ruled that his business was not in contempt of court.

Smith and co-owner Frank Trumbetti made headlines by reopening the gym in May, in violation of the order. They said that the state issued them another violation over the weekend for operating and stated that the doors would be locked if they continued to operate. In response, Smith and Trumbetti removed the gym doors .
Monday’s decision came during an ongoing battle between the gym and Gov. Phil Murphy, who has barred indoor operations at gyms as part of the state’s response to the COVID-19 pandemic.
