Ridgewood NJ, Senator Senator Kip Bateman (R-Somerset, Middlesex, Mercer, Hunterdon) will introduce legislation to repeal the 23 cent per gallon gas tax increase that was signed into law by Governor Chris Christie.

Sen. Kip Bateman announced legislation and a new online petition to repeal the 23 cent/gallon gas tax increase that was recently enacted. (SenateNJ.com)

Bateman, who opposed and voted against the gas tax increase, also announced the launch of a new online petition to give drivers and commuters impacted by the gas tax the opportunity to have their voices heard.

“While the Governor and the Democrat-led Legislature didn’t listen to the tens of thousands of New Jerseyans who spoke out against raising the gas tax, I listened and understand their concerns,” said Bateman. “The overtaxed people of New Jersey have demanded that we find another way to fund our transportation needs without taking more out of their pockets. This repeal effort is recognition that there are fiscally responsible alternatives to the gas tax.”

The legislation to repeal the gas tax increase will be introduced when the Senate next meets.

“I’ve heard from so many commuters who struggle financially every time the price of gas rises, and they’re pleading for help to save them from the gas tax increase,” added Bateman. “Lawmakers have a responsibility to not harm already struggling residents through our state’s tax policy, and that’s what this effort to repeal the gas tax increase is all about. I encourage everyone to sign and share the online petition to help get the repeal movement rolling.”

Bateman’s new petition to support the repeal of the gas tax increase can be signed at senatenj.com/gastaxrepeal.

Bergen Sheriff Challenger Claims Incumbent Deceived Taxpayers

Manuel Alfonso

Manny Alfonso, the Republican challenger in the Bergen County sheriff race, on Wednesday accused incumbent Mike Saudino of what he termed “grant deception.” According to Alfonso, Saudino “will never make good on his  promise to reduce department spending by $200 million.”

In his statement, Alfonso went on to say that Democrats’ claims that they can save “up to $200 million in Bergen County by disbanding the county police force” are false. Alfonso also said that “the sheriff has increased spending year after year.”

Saudino’s campaign spokesperson Matt Bonasia issued the following response to Alfonso’s claims: “Manny Alfonso is entitled to have his own opinions but he is not entitled to create his own facts. These claims are outright fabrications from a desperate candidate who knows he is going to lose in November. If Manny Alfonso stuck with the facts he would be forced to admit that Sheriff Saudino has saved the taxpayers of Bergen County over $4 million through the realignment while improving public safety and that he has reduced overtime by 40% and saved $5 million since 2011 by cutting unnecessary spending.”

Federal court rules the structure of the Consumer Financial Protection Bureau (CFPB) is unconstitutional

cfpb-consumer-financial-protection-bureau

“All government bureaucracies should be accountable to hardworking taxpayers”

October 11,2016
the staff of the Ridgewood blog

Ridgewood NJ,  Financial Services Committee Chairman Jeb Hensarling (R-TX) released the following statement on today’s federal court ruling that the structure of the Consumer Financial Protection Bureau (CFPB) is unconstitutional:

“This is a good day for democracy, economic freedom, due process and the Constitution.  The second highest court in the land has vindicated what House Republicans have said all along, that the CFPB’s structure is unconstitutional.

“By design the CFPB is arguably the most powerful and least accountable Washington bureaucracy in American history, and it shows.  The Bureau has infringed on the economic freedoms of consumers, limited their financial choices, increased their costs, and failed to hold managers accountable for widespread discrimination and abuse of its own employees.  This must change.  The CFPB has an important mission. Properly designed and led, it is capable of great good. But the Bureau’s bizarre and defective structure allows it to evade the time-tested checks and balances that are necessary to hold it or any other government bureaucracy accountable.  Our Constitution requires these checks and balances to protect our God-given liberties from government abuse.  It is astonishing that the Democrats who voted for the Dodd-Frank Act so casually disregarded their constitutional obligations to the American people.  It’s also astonishing that President Obama illegally bypassed the Senate by appointing Richard Cordray to serve as the Bureau’s Director. It is time to restore the rule of law and Constitutional governance to this nation. While I welcome today’s decision, it’s absurd that a judicial opinion was necessary.

“The Financial CHOICE Act, approved by our committee last month, solves the constitutional defect identified by the court today.  The Financial CHOICE Act replaces the current unaccountable single director with a bipartisan, five-member commission – which is how virtually every independent regulatory agency, including those responsible for consumer and investor protection, currently operates.

“Republican efforts in the Financial CHOICE Act to reform the Bureau are and have always been grounded in the fundamental belief that all government bureaucracies should be accountable to hardworking taxpayers, especially those bureaucracies like the CFPB that can spend hundreds of millions of dollars each year with no oversight or control from Congress or the executive branch; employ an army federal employees; and have a direct impact on the personal finances of virtually every American citizen.”

Senator Doherty Laces Into Trump Opponent LG Guadagno

Senator Mike Doherty

By Max Pizarro • 10/10/16 4:58pm

State Senator Mike Doherty (R-Warren) swatted at Lieutenant Governor Kim Guadagno today following the LG’s announcement that she won’t vote for embattled Republican presidential nominee Donald Trump.

A movement conservative, Doherty was the first Republican elected official to back Trump in this year’s primary.

“Guadagno says nothing for seven years,” Doherty said. “Says nothing about the gas tax increase. Says nothing about Chris Christie running his reelection campaign through the Intergovernmental Affairs Office. She hires [former Christie COS Bill] Stepien, who ran the IGA political office.

“She finally becomes the moral conscience of the NJGOP to kick Trump when he’s down,” the senator added. “Pitiful.”

Doherty Votes ‘NO’ on Gas Tax

Senator Mike Doherty

Calls for Passage of His Legislation to Study & Control Excessive Road Costs
October 8,2016
the staff of the Ridgewood blog

Ridgewood NJ, Senator Mike Doherty (R-23) voted ‘NO’ on increasing the state gas tax by 23 cents per gallon, saying the state hasn’t done enough to control excessive costs related to road construction:

Sen. Mike Doherty at a roadside rally in Bridgewater on June 22, 2016 opposing a gas tax increase with Assemblyman John DiMaio, Assemblyman Erik Peterson, Americans for Prosperity-New Jersey, and concerned residents. (SenateNJ.com)

“My office has fielded thousands of calls from constituents who oppose this gas tax increase, and my vote ‘NO’ today was for them.

“Many callers have said that the state doesn’t use the gas taxes it already collects wisely, and it doesn’t deserve a penny more, let alone 23 cents per gallon more. I agree completely.

“If they’re going to force this tax increase upon unwilling drivers, the Governor, Senate President and Assembly Speaker should agree to advance and enact my legislation to get excessive transportation costs under control. That this cost-control bill continues to be blocked is unconscionable.”

Doherty is the sponsor of S-1888, which would create the “State Transportation Cost Analysis Task Force,” to examine state transportation spending and offer recommendations for reducing New Jersey’s highest-in-the-nation road construction costs.

More than 25,000 people signed an online petition run by Doherty and Senator Jennifer Beck (R-Monmouth) in opposition to the gas tax increase.

Ridgewood NJ, In an odd turn of events Rep. Garrett has received an endorsement from Speaker of the House Paul Ryan.

It has been well documented that Garrett has had a sometime contentious relationship in the GOP leadership .

“Throughout my tenure in Congress, Scott Garrett has been a consistent voice in Washington working to protect taxpayers,” said Ryan. “He has been a reliable ally in the fight to reduce wasteful spending and to balance the budget.”

Ryan’s endorsement emphasizes Garrett’s record as a consistent conservative leader who can get results in Washington D.C.

“I am proud to receive the support of Speaker Ryan,” said Garrett. “The Speaker is a principled leader on reining in our federal budget, and I look forward to continuing to work with him in the future. There are many serious issues that need to be tackled in the next Congress, and I am eager to continue to help to solve problems to help the people of New Jersey and the Fifth District.”

Doherty: Cut Road Construction Costs, Don’t Raise Gas Tax

Senator Mike Doherty

October 5,2016

the staff of the Ridgewood blog

Ridgewood NJ, Senator Mike Doherty (R-23) said that he opposes the newest plan to raise the state’s gas tax by $2 billion, and again called for the passage of legislation he sponsors which requires an analysis of New Jersey’s highest-in-the-nation road construction costs.

Sen. Jennifer Beck and Sen. Mike Doherty held a press conference to oppose a gas tax increase proposal at the New Jersey State House on June 15, 2016. (SenateNJ.com)

Under the tax increase proposal that is set to be voted upon by both houses of the New Jersey Legislature on Wednesday, the state’s current gas tax of 14.5 cents per gallon would increase by 158 percent to 37.5 cents per gallon.

“I opposed the 23 cent/gallon gas tax increase in June, and I continue to oppose it today,” said Doherty. “Until we get a handle on why New Jersey spends significantly more per mile than every other state, any new gas tax revenues we raise would be wasted. I don’t think that’s fair to drivers.”

Doherty has long called for a study to examine excessive state transportation costs as the starting point of any transportation funding discussion. He is the sponsor of S-1888, which would create the “State Transportation Cost Analysis Task Force.”

He and Senator Jennifer Beck (R-11) maintain an online petition opposed to a gas tax increase that has been signed more than 16,000 times.

“The thousands of people who signed our ‘no gas tax’ petition are telling us that an increase would only add to the state’s already oppressive taxes,” added Doherty. “I guess some people aren’t satisfied with New Jersey having the third greatest tax burden in the nation. They won’t be happy until we’re number one.”

According to the non-partisan Tax Foundation, New Jersey resident’s shoulder the third-greatest state and local tax burden.

Governor Christie Announces Counterfeit Fentanyl Ban and Expanded Recovery Coach Program

the staff of the Ridgewood blog

New Jersey Combats Opioid Abuse with New Initiatives During National Recovery Month

Trenton NJ,  Expanding his commitment in the fight against opioid addiction in the Garden State, Governor Chris Christie today announced new initiatives in recognition of National Recovery Month, including an Emergency Order to ban the manufacture, distribution, sale, and possession of seven illegal knock-offs of the highly addictive opioid “fentanyl” and an expansion of the state’s Recovery Coach Program.

“We are doubling down on our efforts to combat the epidemic of opioid addiction – a pervasive crisis in communities and neighborhoods throughout our nation. This past summer, I was joined by 45 other governors in a compact through the National Governors Association to carry on this battle, and today we continue New Jersey’s leadership role, in part, by becoming one of the first states to take on the use, sale, and distribution of illicit fentanyl analogs produced by drug trafficking networks,” said Governor Christie.

The Office of the Attorney General and its Division of Consumer Affairs is issuing an Emergency Order to ban the manufacture, distribution, sale, and possession of seven illegal knock-offs of the highly addictive opioid “fentanyl” which are being manufactured by drug dealers. Additionally, the Governor announced the expansion of the Recovery Coach Program, which connects persons who have been saved from drug overdoses to people who can help them find treatment.

These initiatives were among several unveiled by the Governor as he was joined in his outer office by cabinet members and former Governor James E. McGreevey, director of the New Jersey Reentry Corporation (NJRC), which was funded by the Christie Administration to provide addiction treatment, transitional housing, job training and employment to ex-offenders with substance use disorder.

FENTANYL EMERGENCY ORDER

This Emergency Order issued by Attorney General Christopher S. Porrino adds seven “fentanyl analogs” – derivatives of the regulated prescription drug – to the list of Schedule I Controlled Dangerous Substances (CDS) in New Jersey, subjecting them to the strictest level of state control.

Used to treat acute pain, fentanyl is up to 50 times more powerful than heroin and 100 times more powerful than morphine. Fentanyl knock-offs, often more potent than their legal prototype, have been sold on street corners across New Jersey, usually disguised as much less potent drugs like heroin, oxycodone, or other abused prescription drugs. The result has been deadly. Last year, the federal Drug Enforcement Administration listed New Jersey as one of five states hit hardest by a “surge” in fentanyl-related deaths. The total had reached 150 by mid-year, according to the latest available statistics.

“Those responsible for supplying the drugs that caused these deaths will no longer be able to fly under the legal radar in our state,” said Attorney General Porrino. “We are empowering our law enforcement agencies with the legal clout to arrest and fully prosecute anyone caught manufacturing, distributing, or possessing these lethal drugs.”

Knock-offs covered by the order include: Furanyl Fentanyl, 3-Methyfentanyl, 3-Methyl Butyrylfentanyl, Valeryl Fentanyl, Norfentanyl, Para-Florobutyryl-Fentanyl, and Carfentanyl. Under the order, manufacture, distribution, sale, or possession of the chemicals is now a third-degree crime. Violators are subject to a fine of up to $25,000 and imprisonment for a three- to five-year term. The Order will remain in effect for 270 days, or until a regulation is adopted through an administrative process to formally classifying the counterfeit drugs as Schedule I CDS.

EXPANSION OF THE RECOVERY COACH PROGRAM

Already demonstrating success in Camden, Essex, Monmouth, Ocean and Passaic counties, the Recovery Coach program connects people who have been saved from drug overdoses – often with the opioid reversal drug Narcan — with recovery coaches who can provide guidance and support and help them into treatment for their addiction. The Governor announced the program will be expanded into six more counties – Atlantic, Bergen, Burlington, Hudson, Gloucester and Middlesex.

Recovery coaches, who often are in recovery themselves, are on-site in hospital emergency rooms in the five counties where the program already operates. They tap into their own personal recovery experience to help individuals when they are most vulnerable and need support.  This initiative ensures a continuum of care for individuals recovering from an overdose reversal.

NARCAN REBATE EXTENSION

The Christie administration reached a deal this summer with Amphastar Pharmaceuticals, Inc., to extend for another year the ability for police departments and other public first responder entities to continue purchasing the opiate antidote Naloxone at a significant discount. Under that agreement, California-based Amphastar will continue to provide a $6 rebate for each Amphastar Naloxone syringe purchased.

Naloxone – often referred to by its most commonly known trade name Narcan – is an opioid antagonist drug used to reverse overdoses of heroin and other opiate-based narcotics. More than 500 law enforcement agencies across the state, including the New Jersey State Police, are now trained and equipped to administer the drug. Statewide, there were 7,222 deployments of Naloxone by law enforcement and EMS personnel in 2015. Law enforcement and EMS have deployed Naloxone more than 6,000 times so far this year.

In 2015, New Jersey became the third state to obtain a contractual commitment from Amphastar to provide discounts on Naloxone-related purchases. Under the new agreement struck with Amphastar, the Attorney General’s Office will continue to act as administrative conduit in the rebate process.

LEGACY OF FIGHTING ADDICTION

The initiatives announced today continue Governor Christie’s extensive efforts to combat the epidemic of opioid addiction, including: mandatory, statewide drug courts; expansion of New Jersey’s Prescription Drug Monitoring Program to include interstate data-sharing; statewide availability of the overdose reversal drug Naloxone (Narcan); a historic infusion of funding to expand capacity for behavioral health treatment; and formation of an Interim Management Entity (IME), a telephone hotline that provides access for the uninsured and those on Medicaid to addiction treatment.

Recently, the state’s Drug Monitoring Initiative at the Regional Operations and Intelligence Center earned national recognition by the National Governors Association and the White House Office of National Drug Control Policy for its groundbreaking efforts to monitor drug activity in the state. Their work there has enabled law enforcement and public health experts to better understand the supply chain, trends, implications, and threats from illicit drug activity and to notify the public of potentially lethal batches of drugs in the region as overdoses are reported.

In addition, this year marks the second anniversary of the Governor’s creation of the Facing Addiction Task Force, a 12-member team of leaders and experts from inside and outside of government to fight drug addiction through treatment and prevention.  Led by Pastor Joe A. Carter of the New Hope Baptist Church in Newark, the task force has been developing strategies to destigmatize, prevent and treat the disease of addiction with a comprehensive and multi-faceted approach.

In July, Governor Christie along with 45 other governors, signed the National Governors Association’s Compact to Fight Opioid Addiction, committing to fight the epidemic. That compact urges the governors to take steps to raise awareness of opioids and addiction, reduce the inappropriate prescribing of painkillers and facilitate treatment and recovery for those already addicted.

“We have made impressive gains in this fight, and we know there is more work to be done,” added Governor Christie. “With these new initiatives and the alliance of the National Governors Association, we should be able to help more and more people break the cycle of addiction, to reclaim their lives and to improve the lives of all of us dealing with the consequences of opioid addiction in society.”

Governor Chris Christie’s School Funding Fairness Formula Catches the Eye of the Ridgewood Board of Education

Ridgewood_BOE_theridgewoodblog

September 28,2016

the staff of the Ridgewood blog

Ridgewood Nj,  Governor Chris Christie School Funding Fairness Formula Catches the Eye of the Ridgewood Board of Education. In the latest RPS news letter Board President Sheila Brogan devoted a significant amount of space to the Christie Fairness formula and the failure of the Abbott School districts .

Sheila Brogan’s Legislative Report September 2016

Lately, there has been much discussion in Trenton about state funding for school districts.  Governor Christie has asked the courts to give the state relief from the School Funding Reform Act of 2008 (SFRA) and to allow the NJDOE Commissioner relief from statutory and contractual impediments that negatively impact on the thorough and efficient education required by the state constitution.  The State Auditor has issued a report listing the flaws in how state aid is distributed to school districts.   Senator Sweeney has proposed that a 6-member commission be established to study the state school funding issues and propose recommendations and legislation.

The first link below will bring you to the Abbott Memorandum, filed for Governor Christie, asking the NJ Supreme Court for relief from the current funding formula.  It is 95 pages, but worth the read.

Some of the issues discussed in the memorandum are —

#1 More funding does not equal higher student achievement in the School Development Authority (SDA) districts (formally the Abbott districts).  The SDA districts have 22.8% of all NJ students and they receive 59% of the pre-K through grade 12 school aid.

#2 The most important factor for quality education is  effective teachers.  Districts must be allowed to have systems in place to attract and retain effective teachers.  Statutory and contractual impediments to this must be eliminated.  Essentially, the memorandum calls for eliminating LIFO (last in, first out) when there is a reduction in force (RIF) of the teaching staff.  The memorandum also calls for streamlining the process of removing tenure teachers who are ineffective.  It requests that the court allows the Commissioner to override contractual impediments in teacher contracts that negatively impact on student achievement.

In another document released last week, the State Auditor listed flaws in the way the state distributes school aid.  There were four recommendations:

#1. School funding should be distributed based on current district data — for example —  current enrollment and district demographics.  The state is not using current data.  Eighty percent of districts are receiving less aid than what they should receive under the current state aid formula, School Funding Reform Act of 2008 (SFRA).

#2.  Special Education funding is not being distributed on the actual number of special education students in a district.  Under the 2008 state aid formula, the state  started using the census model to distribute money using the assumption that every district had a14.78% special education classification rate.  Some districts have higher classification rates.  According to the report in 2015, 234 districts, and in 2016, 258 districts, had actual classification rates  that were more than10% higher than the state’s rate used for funding. This funding is not tied to actual need.

#3.  Pre-school aid should be adjusted for actual enrollment.  According to the report, in 2016, 30 districts over estimated enrollment and overpayments to these districts from the state amounted to $32.9 million

#4.  The per pupil cost for preschool ranges from $2,036 to $27,663 and this disparity leads to imbalances in funding.  It should be noted that districts receiving pre-school funding can offer half day or full day programs creating disparity in the educational experiences and opportunities offered these students.

This report is linked below.

Finally, Senate President Sweeney and Senator Ruiz introduced a concurrent resolution, SCR119, to  establish the State School Aid Funding Fairness Commission consisting of six members who would be appointed by the Senate President (2 members ,one of whom would represent the NJEA), Speaker of the General Assembly (2 members, one of whom would represent a NJ education professional association), Senate Minority leader (1 member), and General Assembly Minority Leader (1 member).  The Senate approved SC119 on Thursday.  The Commission would be charged to study the following issues:

#1.  the impact of School Funding Reform Act of 2008 (SFRA) adjustment aid and state aid growth limitation provisions;

#2. the tax levy growth limitation and the ability for school districts to adequately fund operating expenses;

#3. the per pupil administrative cost limits and its impact on district staffing and operations;

#4.  determining local fair share amounts and how property tax abatements impact fair share; and

#5.  the ability for districts that are at or above adequacy budget to lower their tax levy if given additional state aid

The report must be issued no later than June 30, 2017 with its findings, recommendations, and proposed legislation. The legislation would be introduced in the Senate and the Assembly.  It would not be referred to committees.  The proposed legislation would be given three readings and must be approved  or rejected by the Senate and the Assembly  without changes or amendments.

Over the next 5 years, $500 million would be added to the state budget for school districts to give districts 100% of the aid as determined by SFRA.

The process for the commission will include three public hearings to gather input and then three hearings after the report is issued to elicit public input on the findings, recommendations, and proposed legislation.

It now goes to the Assembly for consideration.

PAYBACK: Obama Admin Sues Peter Thiel’s Palantir for Bogus ‘Racial Discrimination’

Peter Thiel

Palantir Technologies co-founder Peter Thiel is evidently paying the price for backing Republican nominee Donald Trump, as the Obama administration has slapped his company with a frivolous lawsuit alleging “racial discrimination” against Asians.

The lawsuit, filed and announced Monday by the Department of Labor, threatens the complete cancellation of every contract Palantir has with the federal government — a penalty worth $340 million, the lawsuit claims, which would end the company.

The claims in the lawsuit are laughable. The Obama administration alleges that Palantir discriminated against Asians. But it has to admit that Palantir, in fact, hired many Asians — 11 out of 25 software engineers, for example. The government does not even bother to claim that Palantir deliberately excluded Asians. Rather, it argues that since only 44% of Palantir’s software engineers are Asian, but 85% of the applicant pool was Asian, Palantir must, statistically, have discriminated against Asians.

Meet the N.J. native who’s running Donald Trump’s campaign

GOP strategist Kellyanne Conway

TRENTON — If Donald Trump ends up winning the White House, he might want to send a thank-you note to New Jersey’s blueberry country.

Last month, with his presidential bid battered by controversies and low poll numbers, Trump revamped his staff and tapped a new campaign manager: veteran GOP strategist Kellyanne Conway, who has run her own Washington D.C. polling firm for two decades.

But really, the way Conway tells it, the road to all of this started three decades ago when she was growing up in south Jersey. Especially the eight summers she spent working on a blueberry farm in Hammonton.

Donald Trump Vows to be an Advocate for School Choice

Trump #AmplifyChoice

September 22,2016
the staff of the Ridgewood Blog

Ridgewood NJ, On September 8th GOP Presidential Candidate Donald J. Trump unveiled four proposals to increase School Choice, and increase student performance. To achieve this long-term goal of school choice, Mr. Trump plans to make this a shared national mission; to bring hope to every child in every city in this land.

Trump said ,”As your president I will be the nation’s biggest cheerleader for school choice,” , speaking from the Cleveland Arts and Social Sciences Academy charter school. “I understand many stale old politicians will resist, but it’s time for our country to start thinking big and correct once again.Trump went on to say that expanding school choice would help minority students who are currently trapped in “failing government schools.”

Trump’s running mate, Indiana Gov. Mike Pence, weighed in on the proposal, giving it a big thumbs-up.

“The school choice proposals unveiled today by Mr. Trump are a bold set of policies that will increase accountability and lead to better results for our nation’s children,” he said. “These policies prove once again that Mr. Trump is the only person running for president who has the leadership required to make America great again.”

According to Trump ,the Trump team’s first budget will immediately add an additional federal investment of $20 billion towards school choice. This will be done by reprioritizing existing federal dollars. Specifically, Mr. Trump’s plan will use $20 billion of existing federal dollars to establish a block grant for the 11 million school age kids living in poverty. Individual states will be given the option as to how these funds will be used.

Trump’s proposal included as President,he would establish the national goal of providing school choice to every American child living in poverty.
