Washington DC, Judge Michael R. Barrett signed off  on  Wednesday the settlement between the IRS and hundreds of tea party groups, closing out the last major legal battle over what all sides now agree was unwarranted and illegal targeting for political purposes. The Curious Case of Lois Lerner’s Physically Damaged Hard Drive

New documentation released by the House Oversight Committee this week again raises questions on how Lois Lerner’s hard drive was physically damaged and whether there was some kind of deliberate act to destroy data on it.

The House Oversight Committee report cites an officially transcribed interview with John Minsek, senior investigative analyst with the IRS Criminal Investigations (CI) unit. Minsek examined the Lerner hard drive in 2011. In the transcribed interview, he notes Lerner’s hard drive contained “well-defined scoring creating a concentric circle in the proximity of the center of the disk.” The Oversight Committee report states:

“Using the CI unit’s digital forensic facilities, Minsek opened the hard drive and conducted additional tests. Once he opened the hard drive, Minsek noticed “well-defined scoring creating a concentric circle in the proximity of the center of the disk.”

So how did the scoring get there?

Last month, testimony from the Treasury Inspector General for Tax Administration (TIGTA) revealed that Lois Lerner’s hard drive had “scoring on the top platter of the drive.” The testimony also noted that the IRS technician that inspected the hard drive believed that additional steps could have been taken to recover data, although this did not occur and the hard drive was later destroyed by an industrial strength AMERI-SHRED AMS-750 HD shredder.

Given these facts, it is logical to question how the “scoring” occurred and whether there was foul play involved. Here it what is known thus far:

According to TIGTA testimony submitted to the Oversight Committee on June 25, 2014, Lerner’s laptop stopped communicating with the IRS server on Saturday June 11, 2011, between 5:00 p.m. and 7:00 p.m.
According to the same testimony,the laptop was likely physically located in Lerner’s office the moment it stopped communicating with the server:

“Based on consistent network reporting for more than a week, the laptop computer was likely located in Ms. Lerner’s office.”

On Monday June 13, 2011, Lerner reported the laptop inoperable.
Lerner’s laptop was initially serviced by an IRS IT staff technician and a Hewlett-Packard contractor. Of note, the HP contractor thought the hard drive crashed due to a physical impact. According to the TIGTA testimony:

“When asked about the possible cause of the hard drive failure, the HP technician opined that heat-related failures are not seen often, and based on the information provided to him, the hard drive more than likely crashed due to an impact of some sort. However, because the HP technician did not examine the hard drive as part of his work on the laptop, it could not be determined why it crashed.”

The John Doe investigation of Wisconsin conservatives collapsed last week with a powerful decision from the Wisconsin Supreme Court that called state prosecutors’ theory of campaign-finance law “unconstitutional” and “unsupported in either reason or law.” But the legal exoneration shouldn’t pass without noting the hardship the secret probe imposed on its targets and on political debate in Wisconsin.

For the past few days, I’ve been talking to the targets of the task force of Milwaukee Democratic prosecutors, the Wisconsin Government Accountability Board and Special Prosecutor Francis Schmitz. Their experiences, on the record here for the first time, reveal the nasty political sweep of an investigation that invaded privacy with surveillance of email accounts, raided homes with armed law enforcement, and swarmed individuals with subpoenas demanding tens of thousands of documents while insisting on secrecy.

One target did speak up in public in real time— Eric O’Keefe, who went on the record in limited ways with me not long after he was subpoenaed in October 2013 as part of the prosecutors’ investigation of conservative speech during the Wisconsin recall elections. The director of the Wisconsin Club for Growth knew that violating the gag order put him at personal risk, but he told me then that he had to fight because it was an assault on basic constitutional freedoms and “we have done nothing illegal.” A Journal editorial exposed the extent and dubious legal basis of the Doe investigation for the first time.

Judicial Watch: New Documents Show IRS Used Donor Lists to Target Audits

(Washington, DC) – Judicial Watch announced today that it has obtained documents from the Internal Revenue Service (IRS) that confirm that the IRS used donor lists to tax-exempt organizations to target those donors for audits.  The documents also show IRS officials specifically highlighted how the U.S. Chamber of Commerce may come under “high scrutiny” from the IRS.  The IRS produced the records in a Freedom of Information lawsuit seeking documents about selection of individuals for audit-based application information on donor lists submitted by Tea Party and other 501(c)(4) tax-exempt organizations (Judicial Watch v. Internal Revenue Service (No. 1:15-cv-00220)).

A letter dated September 28, 2010, then-Democrat Senate Finance Committee Chairman Max Baucus (D-MT) informs then-IRS Commissioner Douglas Shulman: “   I request that you and your agency survey major 501(c)(4), (c)(5) and (c)(6) organizations …”  In reply, in a letter dated February 17, 2011, Shulman writes: “In the work plan of the Exempt Organizations Division, we announced that beginning in FY2011, we are increasing our focus on section 501(c)(4), (5) and (6) organizations.”

In 2010, after receiving Baucus’s letter, the IRS considered the issue of auditing donors to 501(c)(4) organizations, alleging that a 35 percent gift tax would be due on donations in excess of $13,000.  The documents show that the IRS wanted to cross-check donor lists from 501(c)(4) organizations against gift tax filings and commence audits against taxpayers based on this information.

A gift tax on contributions to 501(c)(4)’s was considered by most to be a dead letter since the IRS had never enforced the rule after the Supreme Court ruled that such taxes violated the First Amendment.  The documents show that the IRS had not enforced the gift tax since 1982.

But then, in February 2011, at least five donors of an unnamed organization were audited.

The documents show that Crossroads GPS, associated with Republican Karl Rove, was specifically referenced by IRS officials in the context of applying the gift tax.  Seemingly in response to the Crossroads focus, on April 20, IRS attorney Lorraine Gardner emails a 501(c)(4) donor list to former Branch Chief in the IRS’ Office of the Chief Counsel James Hogan. Later, this information is apparently shared with IRS Estate Gift and Policy Manager Lisa Piehl while Gardner seeks “information about any of the donors.”

Emails to and from Lorraine Gardner also suggested bias against the U.S. Chamber of Commerce.  An IRS official (whose name is redacted) emails Gardner on May 13, 2011, a blog post responding to the IRS targeting of political and other activities of 501(c)(4), (5) and (6) organizations:

Obama’s Department of Justice may have been involved in the IRS scheme to target conservative non-profit organizations, according to newly-released documents obtained by Judicial Watch under the Freedom of Information Act.

The documents reveal that Lois Lerner met with attorneys from the Public Integrity Section (including its chief) of the Justice Department’s Criminal Division and a representative from the FBI in 2010 to discuss using campaign-finance laws to bring criminal charges against conservative non-profit organizations.

A memo prepared by Siri Buller, a tax law specialist who worked for Lerner, summarizing the meeting talks about the possibility of “a three-way partnership among the DOJ [Department of Justice], the FEC [Federal Election Commission], and the IRS” to “prevent prohibited activity by these [conservative] organizations.”  Of course, the problem is that the activities that Lerner thought were “prohibited,” like expressing opinions about Obamacare, were not prohibited.

Emails between Justice Department and IRS employees also expose an attempt by the Justice Department  to obtain unredacted versions of the documents IRS employees provided to Congress. One July 2013 email from a Justice Department employee to a lawyer for the IRS (the names have been redacted) says “If any of your clients have documents they are providing to Congress that you can (or would like to) provide to us before their testimony … we would like the unredacted documents.” It goes further, stating “I just know that some employees have assembled their own set [of documents], in which instance it is helpful to obtain them.”

Emails between IRS officials confirm that the IRS transmitted 21 disks containing 1.25 million pages of highly confidential tax information to the FBI. These pages included information from 2007-2010 regarding 113,000 tax returns of non-profit organizations.

The House Committee of Oversight and Government Reform was “astonished to learn…that these 21 disks contained confidential taxpayer information protected by federal law” that could not lawfully be turned over to the FBI without meeting very specific requirements for opening a criminal investigation of a particular taxpayer as outlined in 26 U.S.C. §6103. Those requirements were clearly not met by the FBI.

Judicial Watch President Tom Fitton notes “[t]hese new documents show that the Obama IRS scandal is also an Obama DOJ and FBI scandal … The FBI and Justice Department worked with Lois Lerner and the IRS to concoct some reason to put President Obama’s opponents in jail before his reelection. And this abuse resulted in the FBI’s illegally obtaining confidential taxpayer information.”

Not only did Lerner have friends in the Justice Department, it also seems she had allies in Wisconsin, where conservative non-profit groups were similarlytargeted in a secret “John Doe” investigation for publicly supporting Gov. Scott Walker’s union reforms.

Recently obtained emails show that Lerner was in contact with Kevin Kennedy, director of the Wisconsin Government Accountability Board, who was one of the government officials behind the investigations of conservative organizations in Wisconsin such as the League of American Voters, Wisconsin Family Action, Wisconsin Manufacturers & Commerce and several others. Those emails show them “sharing articles on topics including greater donor disclosure,” which, as The Wall Street Journal points out, is significant “because those were the years when the IRS increased in harassment of conservative groups and Wisconsin prosecutors gathered information” that led to the John Doe “Star Chamber.”

Wisconsin Watchdog describes the state’s John Doe procedure as “a grand jury investigation, without a jury.” These investigations allowed law enforcement to conduct abusive, paramilitary-type raids on the leaders of a number of nonprofits and their families, most of which were conducted before dawn.

In one case, a 16-year-old boy was home alone very early one morning when armed law enforcement officers raided his home as if they were closing in on a dangerous drug cartel or mob operation. Though he was terrified, the officers would not allow him to call his parents.

Several other victims of these nighttime raids came forward, even though they were ordered not to speak about the investigations. The targets of these raids were not criminals—they were Wisconsin conservatives who had supported Act 10, the “Wisconsin Budget Repair Bill,” and whose reputations and livelihoods have been severely damaged as a result of these unwarranted, heavy-handed raids.

In January, a judge blocked subpoenas against the conservative targets of the John Doe investigations. In May, U.S. District Court Judge Rudolph Randaordered that the investigations be shut down in their entirety because it was “unlawful” for the state to “target the plaintiffs for engaging in vigorous advocacy.”

These recent revelations suggest that the targeting of conservative non-profit organizations was a scheme that went far beyond the IRS and Lois Lerner alone. It was an effort that involved the coordination of several Obama administration executive agencies and supposedly non-partisan public servants.

With the discovery of the connection to the seemingly-unjustified, retaliatory investigations in Wisconsin, it seems Lerner’s efforts even extended beyond the federal government and into at least one state, threatening conservatives and chilling conservative speech at both the federal and state level.

What’s it going to take for the networks to start seriously reporting on the IRS scandal again? On Tuesday, Judicial Watch announced the stunning revelation that newly discovered Department of Justice and IRS documents showed there was “an October 2010 meeting between Lois Lerner, DOJ officials and the FBI to plan for the possible criminal prosecution of targeted nonprofit organizations for alleged illegal political activity.” This latest bombshell has yet to be reported on any of the Big Three (ABC, NBC, CBS) networks.

The July 7 Judicial Watch press release added: “The newly obtained records also reveal that the Obama DOJ wanted IRS employees who were going to testify to Congress to turn over documents to the DOJ before giving them to Congress. Records also detail how the Obama IRS gave the FBI 21 computer disks, containing 1.25 million pages of confidential IRS returns from 113,000 nonprofit social 501(c)(4) welfare groups  – or nearly every 501(c)(4) in the United States – as part of its prosecution effort.”

GREENVILLE, S.C.—At a Republican Party fundraising breakfast in his district on Wednesday, Representative Trey Gowdy suggested that the congressional GOP needed to investigate the IRS’s scrutiny of political groups with the same intensity that it was investigating the 2012 attacks in Benghazi.

“I’m glad that the speaker of the House convened a select committee on Benghazi,” said Gowdy, a former prosecutor who chairs that panel. “I think it makes every bit as much sense to convene a select committee on the IRS. Now that we have the Senate, the Senate has tools the House doesn’t have in terms of getting e-mails and cooperation. It has nothing to do with politics. Do you really want an IRS targeting you based on your political beliefs?”

The congressman, flanked by colleagues Mick Mulvaney and Jeff Duncan, took most of the questions at the $25-per-head voter briefing. Mulvaney encouraged fellow Republicans to win the moral argument about immigration reform, instead of allowing the issue to be frozen and polarized. “If you hear us talking 10 percent about the Constitution and 90 percent about something else, that’s why,” he said. Gowdy described the ways that Democrats had undermined his committee—mostly by portraying it as heartlessly partisan.

Thursday on Fox New Channel’s “America’s Newsroom,” Sen. Ron Johnson (R-WI) explained in November the Treasury Inspector General reported that it had recovered almost 80,000 missing emails from the seized IRS disaster recovery tapes. Upon investigation it was found approximately 80 percent are duplicates, which leaves roughly 16,000 recovered, unique Lois Lerner emails.

The Wisconsin senator promised “a number of committees,” working together will spend the next couple of month “sorting through” the emails to “piece together this plot.”

Johnson said, “This administration has been completely opaque. But that’s one question. Who was communicating with Lois Lerner? What emails were exchanged with the White House or Treasury department? That’s what we are trying to get to the bottom of.”

The Obama administration is refusing to publicly release more than 500 documents on the IRS’s targeting of Tea Party groups.

Twenty months after the IRS scandal broke, there are still many unanswered questions about who was spearheading the agency’s scrutiny of conservative-leaning organizations.

The Hill sought access to government documents that might provide a glimpse of the decision-making through a Freedom of Information Act (FOIA) request.

The Hill asked for 2013 emails and other correspondence between the IRS and the Treasury Inspector General for Tax Administration (TIGTA). The request specifically sought emails from former IRS official Lois Lerner and Treasury officials, including Secretary Jack Lew, while the inspector general was working on its explosive May 2013 report that the IRS used “inappropriate criteria” to review the political activities of tax-exempt groups.

TIGTA opted not to release any of the 512 documents covered by the request, citing various exemptions in the law. The Hill recently appealed the FOIA decision, but TIGTA denied the appeal. TIGTA also declined to comment for this article.

IRS employees subverted the agency’s nonpartisan mission to further President Obama’s political goals, according to a new House GOP report that will be released Tuesday.

The report, from Oversight Chairman Darrell Issa (R-Calif.), seeks to undercut the administration’s explanations for the IRS’s improper scrutiny of Tea Party groups, including that the conduct was centered in a Cincinnati office and that confusing regulations played a role.

While the 210-page report finds no evidence that Obama or White House officials ordered the special treatment of Tea Party groups, it says the record points to a “culture of bias against conservative organizations among certain IRS employees.”

That bias, the report says, underscores that the IRS is no longer the neutral tax collector it claims to be, at a time when its employees are tasked with implementing Obama’s signature healthcare law.

“Evidence shows an IRS responsive to the partisan policy objectives of the White House and an IRS leadership that coordinates with political appointees of the Obama administration,” the report says.

So-called torture report is Democrats’ distraction from these six unpleasant issues

No. Look this way. Not that way.

You have to ask: If it’s such a serious issue for the Bush Administration to have “tortured” detained terrorists back when we still had a president who cared about fighting terror, why did Senate Democrats wait seven years to release their report on this purported atrocity?

The answer is simple: Politics. On the one hand, they’re running out of time as the Senate majority. But more importantly, there are serious issues that demand the attention of the public, and it’s not in Democrats’ interests to have the public pay attention to these things. That’s why, having kept this assortment of their uninformed opinions diguised as a “report” in their back pockets for seven years, they’re releasing it now.

It’s time for a series of lectures about how horrible it is to “torture” terrorists so we don’t talk about a whole host of other things, particularly these things:

The election results, both federal and state. With Democrats having gotten their clocks cleaned at every level, we can’t spend time mulling the aspects of governance under the Democrats that have everyone so dissatisfied. Better to rehash things the Democrats used to upset people a decade ago when Republicans were in power. That’s much more relevant.

Grubergate. Coincidence that the “report” on “torture” came out the same day Jonathan Gruber was hauled in front of Congress to testify about the Democrats’ misleading of the American people – made necessary, he explains, by our “stupidity”? I think not. Speaking of which . . .

ObamaCare. It’s imploding, and even past and present Democrat senators like Chuck Schumer and Tom Harkin are now admitting it’s a train wreck and was a bad idea in the first place. What do you do with that? Change the subject to “torture,” of course!.

Unemployment. Now you might think Democrats would want to talk about this because the unemployment rate as traditionally announced by the Labor Department is down. But you know what? The real unemployment rate, which counts the underemployed and those who have given up looking for work, exceeds 10 percent. Pay much attention to the real employment picture and it’s trouble for Democrats.

The IRS scandal. Oh no, this hasn’t gone away. Lois Lerner’s e-mails have finally been recovered and they are sure to contain a treasure trove of information about how the IRS targeted conservative groups. We already know that certain senators, including Chuck Schumer and Carl Levin, publicly demanded that the IRS do this. Any bets on whether it was understood to be a priority of the Obama White House as well?

The national debt passed $18 trillion in the last couple of weeks, and you barely heard a word about it from the media. Now the “report” on “torture” gives them another excuse to ignore the story. By the way, in case you’ve forgotten, $10 trillion of that was accumulated under the 43 presidents from Washington to Bush. That means $8 trillion has been accumulated under Obama. Now that’s some achievement.

Better change the subject to something! Hey Senator Feinstein! Do we still have that torture report sitting around somewhere? Better release it now or the news cycle is going to kill us!

NYT investigation: MSNBC’s Sharpton runs ‘delinquent’ nonprofit organization

A New York Times investigation into the finances of MSNBC host and Washington heavyweight Al Sharpton has found “$4.5 million in current state and federal tax liens against him and his for-profit businesses,” according to the story by Russ Buettner. Titled “Questions About Sharpton’s Finances Accompany His Rise in Influence,” the story documents a long trail of unmet obligations and a messy web of financial interests spanning nonprofits, personal finances and beyond.

“Mr. Sharpton has regularly sidestepped the sorts of obligations most people see as inevitable, like taxes, rent and other bills,” claims the piece. Even with his tax liabilities, notes the story, Sharpton “traveled first class and collected a sizable salary.”

Though he anchors “Politics Nation” on MSNBC on weeknights, Sharpton is a target of far greater resonance than a cable news host. The longtime rabble-rousing Brooklyn preacher and civil rights activist has become a player of national import under the Obama administration. As explained in an August piece in Politico Magazine by Glenn Thrush, Sharpton had transformed himself into the Obama administration’s “go-to man on race.” After the killing of Michael Brown in Ferguson, Mo., in August, Sharpton established himself as the “de facto contact and conduit for a jittery White House seeking to negotiate a middle ground between meddling and disengagement.”

All of which makes him a large and fair target for a newspaper investigation.

In 1991, Sharpton founded the National Action Network (NAN), which calls itself “one of the leading civil rights organizations in the Nation with chapters throughout the entire United States.” Trouble is, it has achieved its current size without paying the payroll taxes of its employees, according to the Times:

30,000 missing emails from IRS’ Lerner recovered

Up to 30,000 missing emails sent by former Internal Revenue Service official Lois Lerner have been recovered by the IRS inspector general, five months after they were deemed lost forever.

The U.S. Treasury Inspector General for Tax Administration (TIGTA) informed congressional staffers from several committees on Friday that the emails were found among hundreds of “disaster recovery tapes” that were used to back up the IRS email system.

“They just said it took them several weeks and some forensic effort to get these emails off these tapes,” a congressional aide told the Washington Examiner.

Sunday on Fox News Channel’s “MediaBuzz,” Bob Woodward said there are, “lots of unanswered questions,” about the Obama administrations involvement in the IRS scandal surrounding the targeting conservative groups for extra scrutiny.

Employers won’t hire her. She’s been berated with epithets like “dirty Jew.” Federal agents have guarded her house because of death threats. And she’s spent hundreds of thousands of dollars defending herself against accusations she orchestrated a coverup in a scandal that has come to represent everything Americans hate about the IRS.

Lois Lerner is toxic — and she knows it. But she refuses to recede into anonymity or beg for forgiveness for her role in the IRS tea party-targeting scandal.

“I didn’t do anything wrong,” Lerner said in her first press interview since the scandal broke 16 months ago. “I’m proud of my career and the job I did for this country.”

Lerner, who sat down with POLITICO in an exclusive two-hour session, has been painted in one dimension: as a powerful bureaucrat scheming with the Obama administration to cripple right-leaning nonprofits. Interviews with about 20 of her colleagues, friends and critics and a survey of emails and other IRS documents, however, reveal a much more complicated figure than the caricature she’s become in the public eye.
