Some doctors wary of taking insurance exchange patients

Now that many people finally have health insurance through the Affordable Care Act exchanges, some are running into a new problem: They can’t find a doctor who will take them as patients.

Because these exchange plans often have lower reimbursement rates, some doctors are limiting how many new patients they take with these policies, physician groups and other experts say.

“The exchanges have become very much like Medicaid,” says Andrew Kleinman, a plastic surgeon and president of the Medical Society of the State of New York. “Physicians who are in solo practices have to be careful to not take too many patients reimbursed at lower rates or they’re not going to be in business very long.”

Kleinman says his members complain rates can be 50% lower than commercial plans. Cigna and Aetna, however, say they pay doctors the same whether the plan is sold on an ACA network or not. United Healthcare spokeswoman Tracey Lempner says it’s up to their physicians whether they want to be in the exchange plan networks, which have “rates that are above Medicaid.” Medicaid rates are typically below those for Medicare, which in turn are generally lower than commercial insurance plans.To prevent discrimination against ACA policyholders, some insurance contracts require doctors to accept their exchange-plan patients along with those on commercial plans unless the doctors’ practices are so full they simply can’t treat any more people. But lower reimbursement rates make some physicians reluctant to sign on to some of these plans or accept too many of the patients once they are in the plans.

At the Washington Post’s “Wonkblog,” Matt O’Brien wrote a typical sort of hysterical screed about the gold standard system – the system that the United States used for nearly two centuries, until 1971. During that time, the country went from a handful of rebellious subsistence farmers, worn down by over a decade of war, hyperinflation and unstable government, to the most successful and wealthiest country in the world.

Think about that.

Now, let’s see what O’Brien wrote:

“When it comes to crackpot economic ideas, the gold standard is, well, the gold standard.

It’s a barbarous relic that has nothing to recommend it today. Pegging the dollar to the price of gold, you see, is just a doomsday device for turning recessions into depressions.”

To me, even without getting into any details, this smacks of a certain lack of connection with any fact of reality or history. You just don’t become the most successful country of the last two centuries with a “crackpot” monetary system that is a “doomsday device.”

The last twenty years of the U.S.’s gold standard era – the Bretton Woods years when the dollar was worth 1/35th of an ounce of gold – were times of prosperity and abundance, especially for the U.S. middle class. The gold standard era didn’t end in 1971 because it was producing bad results, and people decided it was time to find something better. It ended because those responsible for maintaining it were idiots.

I would even say that those years, the 1950s and 1960s, were the best of the last century, 1914-2014.

If the gold standard system is so horrible, then how did that happen?

Since 1971, even by the U.S. government’s falsely sunny statistics, the U.S. “real” median full-time male income has gone nowhere.

During debates and speeches, politicians often bring up the financial burden that’s placed on the middle class. We talk about the middle class as though they are this singular entity, who used to thrive until they underwent persecution by the evil 1%. But, realistically speaking, the middle class and the 99% are not really synonymous. So, who are the middle class?

In its discussion of historical middle class societies, The Economist reports, “Their members are neither rich nor poor but somewhere in-between. . . . ‘Middle-class’ describes an income category but also a set of attitudes . . . An essential characteristic is the possession of a reasonable amount of discretionary income. Middle-class people do not live from hand to mouth, job to job, season to season, as the poor do.”

Some argue that the most sensible income amount to attach to the middle class would be the median household income, of around $54,000. Perhaps, anyone who earns between the 25th percentile and 75th percentile is a member of the middle class.

Diana Farrell, once Deputy Director of America’s National Economic Council, told The Economist she thinks a middle class income begins at the point where a person (or family) has one-third of their income left over for discretionary purposes after they’ve provided themselves with food and shelter. In other words, someone who earns $3,000 per month would have $1,000 left after they’ve paid their mortgage or rent, utilities, and grocery bills.

The vast majority of Americans gaining health coverage under Obamacare actually qualified for Medicaid because of loosened eligibility —and that’s what boosted enrollment among those previously uninsured, a new report from The Heritage Foundation.

The Obama administration has boasted that the Affordable Care Act, popularly known as Obamacare, would allow those previously uninsured to purchase quality, affordable health care.

“The inescapable conclusion is that, when it comes to covering the uninsured, Obamacare so far is an expansion of Medicaid,” Heritage Foundation health policy experts Edmund F. Haislmaier and Drew Gonshorowski write in a research paper scheduled for release today.

Officials announced in May that more than 8 million Americans had picked a health plan on the Obamacare website, HealthCare.gov.

Haislmaier and Gonshorowski conclude that 8.5 million Americans gained coverage through Obamacare from January to July.

However, their paper says, more than 70 percent of those signups can be traced to the expansion of Medicaid eligibility in 24 states:

Of the 8.5 million total individuals who gained health insurance coverage, 71 percent of that net coverage gain was attributable to Obamacare’s expansion of Medicaid to able-bodied, working-age adults.

In the states that adopted and implemented Medicaid expansion under Obamacare, enrollment skyrocketed as an additional 5.7 million Americans signed up for coverage.

In 21 states opting out of Medicaid expansion, however, enrollment was strikingly lower. The Heritage report finds that 355,674 Americans signed up for Medicaid in those states.

In all, Medicaid enrollment increased by 6 million individuals for the first half of 2014.

The Affordable Care Act, popularly known as Obamacare, loosened eligibility requirements for Medicaid, traditionally the government’s health program for the poor. The changes made it easier for individuals with an income of up to 138 percent of the federal poverty line (roughly $16,000) to qualify for the taxpayer-funded health coverage.

As the Heritage experts note, many Medicaid-eligible Americans under the new requirements also don’t have dependent children.

States got an incentive–federal dollars–to adopt the requirements.

Twenty-seven states and the District of Columbia opted to expand Medicaid. By July, however, 24 states had implemented the program.

The Affordable Care Act went into effect in October. Its implementation included the rollout of HealthCare.gov, the online marketplace where consumers can peruse and purchase insurance plans.

HealthCare.gov’s advent was accompanied by well-publicized malfunctions, glitches and failures. White House officials scrambled to fix the website as consumers experienced long delays. As a result, the Obama administration extended the close of open enrollment from March 30 until April 15.

Despite the rocky rollout of HealthCare.gov, President Obama and then-Health and Human Services Secretary Kathleen Sebelius touted that enrollment in Obamacare insurance plans topped the original goal of 7 million.

According to reports from the Department of Health and Human Services, enrollment likely hovered around 7.3 million, as original estimates took into account those who selected a plan, but did not pay their first month’s premiums.

Sylvia Mathews Burwell, who in June replaced Sebelius as HHS secretary, said in a speech last month at the Brookings Institute:

Four years after President Obama signed the law, middle class families have more security, and many who already had insurance have better coverage. Fewer Americans are uninsured, and at the same time, we’re spending our health care dollars more wisely, and we’re starting to receive higher quality care.

Instead of seizing the bully pulpit (pun intended) and appoint a member of his own party as a replacement senator for the unexpired Lautenberg term (as any noble Democrat would have done), Christie swallows the poison pill and calls for the special election. He knew Booker would take the bait and Christie would be insulated from a moderate Democrat with a high name recognition value. Booker is running purely on celebrity because he has little else positive to show for his time in office. There is a reason NJ is the punchline for so many jokes (and setting for HBO series shows on corruption) – it’s the politics.

A visit by Barack Obama once had the buzz of Beatlemania.

When he visited New Jersey, crowds were packed with college kids who hoisted cameras and chanted “Yes We Can,” and the stages bulged with Democratic officials eager to bask in his glow.

But as Obama returns to New Jersey today for the first time in 16 months, his popularity is in a tailspin. And instead of headlining a campaign rally in a civic center, he will be escorted into a pricey, closed-door fundraiser in Union County, a visit that is supposed to draw donors and not attention. And the Democrats are more than happy to keep it that way.

U.S. Rep. Bill Pascrell is an eight-term Democrat from Paterson running for reelection against Republican Dierdre G. Paul, a Montclair State University professor, and he said his campaign polling detected a noticeable drop in Obama’s numbers. For Pascrell, the Obama effect has forced him to navigate – keep his distance from Obama on some issues but not abandon him altogether, which could potentially alienate hard-core Democrats who remain loyal to Obama.

“You have a choice if you are a Democratic candidate. You can run away from the president, you can embrace everything he does, or you can say it like it is,” Pascrell said last week while campaigning in Fort Lee. “When I agree with him, I agree with him; when I don’t agree with him, I say so.”

The president who could electrify crowds four years ago is now radioactive. With Obama besieged by multiple foreign policy crises and his popularity in free fall, Democratic candidates around the country are taking measures to separate themselves from the party’s standard-bearer.

Rachel Maddow, the biggest star on the MSNBC cable network, just posted her lowest quarterly ratings results ever.

“Morning Joe,” MSNBC’s signature morning program, scored its second-lowest quarterly ratings, reaching an average of just 87,000 viewers in the key news demographic group.

And “Ronan Farrow Daily,” the network’s heavily promoted new afternoon show, which stars a 26-year-old Rhodes Scholar with a high-profile Hollywood lineage, has been largely a dud.

Though it has mostly happened quietly, which may be a comment on the cable network’s larger status in the media landscape, MSNBC has seen its ratings hit one of the deepest skids in its history, with the recently completed third quarter of 2014 generating some record lows.

Phil Griffin, the president of MSNBC, acknowledged that his network had been struggling, but put it in the context of the overall drop in cable news. “This has been a tough year all around,” he said. “All three cable news channels are drawing a smaller combined audience than they were five years ago.” He also emphasized that despite the plunge that caused it to trail CNN in the last quarter, the network remained ahead of CNN for the full year.

In the past, MSNBC’s ratings have typically fallen during times of intensely followed major news events. The current period is awash in them, with stories like ISIS and Ebola commanding a high degree of international reporting. This plays well to CNN’s strengths.

For decades, the world of health insurance in New Jersey has been dominated by huge companies with billions of dollars in assets and millions of customers. But later this year, residents who shop for their own insurance will have a choice of two new companies — one launched by young tech entrepreneurs and the other a non-profit cooperative.

The two upstarts are Oscar Insurance, the brainchild of Joshua Kushner, scion of the Kushner real estate fortune, and Health Republic Insurance of New Jersey, conceived by the Freelancers Union, an association of independent workers, and funded with loans from the federal government. If they succeed, they may just goad the traditional behemoths of insurance into a different way of doing business. And by increasing the competition for people who buy their own coverage, they may already be helping to hold down premiums.

“These innovative new entrants are shaking things up for the entire industry,” said Ceci Connolly, managing director of PriceWaterhouseCoopers’ Health Research Institute, which recently released a report asking, “Who will be the [health care] industry’s next Amazon.com?”

Sorry, America. China just overtook the US to become the world’s largest economy, according to the International Monetary Fund.

Chris Giles at the Financial Times flagged up the change. He also alerted us in April that it was all about to happen.

Basically, the method used by the IMF adjusts for purchasing power parity, explained here.

The simple logic is that prices aren’t the same in each country: A shirt will cost you less in Shanghai than in San Francisco, so it’s not entirely reasonable to compare countries without taking this into account. Though a typical person in China earns a lot less than the typical person in the US, simply converting a Chinese salary into dollars underestimates how much purchasing power that individual, and therefore that country, might have. The Economist’s Big Mac Index is a great example of these disparities.

So the IMF measures both GDP in market-exchange terms and in terms of purchasing power. On the purchasing-power basis, China is overtaking the US right about now and becoming the world’s biggest economy.

We’ve just gone past that crossover on the chart below, according to the IMF. By the end of 2014, China will make up 16.48% of the world’s purchasing-power adjusted GDP (or $17.632 trillion), and the US will make up just 16.28% (or $17.416 trillion):

U.S. citizens who refuse to undergo the new screenings for Ebola at five major American airports could find themselves held in quarantine for up to three weeks, officials told Yahoo News on Thursday. Non-citizens who refuse the screenings could be quarantined or turned away from U.S. soil by U.S. Customs and Border Protection.

The Obama Administration announced on Wednesday that it would soon require passengers from Guinea, Liberia, and Sierra Leone — the countries at the epicenter of the deadly outbreak in West Africa — to answer questions about their potential exposure to the illness and to have their temperature taken upon arrival.

Officials unveiled the new rules hours after the only patient thus far diagnosed with Ebola on U.S. soil, Thomas Eric Duncan, died of the illness. Neighbors said he helped a pregnant woman in Liberia get to a hospital, where she was turned away from a crowded Ebola treatment ward. Liberian government officials said they planned to prosecute him for lying on health forms by denying any contact with an Ebola patient.

Attorney General Eric Holder, the first attorney general in history to be held in contempt by the House of Representatives, surprised the political world today when he announced he would be resigning, effective on the confirmation of his successor.

Holder will leave a troubled legacy and many unanswered questions as John Fund and I discovered when we were researching our new book, “Obama’s Enforcer: Eric Holder’s Justice Department.” The Justice Department veterans we talked to said that Holder has politicized the Department to an unprecedented degree, which should concern everyone who cares about the rule of law.

So what are the top seven worst actions by Eric Holder?

1. Operation Fast and Furious, probably the most reckless law enforcement operation ever carried out by the Justice Department. This gun-running scandal led directly to the death of an American border agent and many Mexican citizens. Holder was held in contempt because of his refusal to turn over information and documentation about this operation gone wrong that he basically claimed he knew nothing about.

2. Holder has waged a war on election integrity and “racialized and radicalized the [Civil Rights] Division to the point of corruption” according to one current Justice employee, embedding “politically leftist extremists in the career ranks who have an agenda that does not comport with equal protection or the rule of law; who believe that the ends justify the means; and who behave unprofessionally and unethically.”

3. Failure to conduct a real, criminal investigation of the IRS targeting of conservative organizations and to enforce the contempt citation issued by the House of Representative against Lois Lerner.

4. Reinstituting the Clinton-era model for handling terrorists that endangers the national security and safety of the American people and going after journalists in leak investigations while ignoring leaks coming out of the White House from high-level administration officials.

5. Failing to advise President Obama against taking actions that violate the Constitution and federal law, refusing to enforce or defend federal laws and trying to persuade state attorneys general to engage in the same type of behavior of refusing to defend laws passed by their state legislatures.

6. Engaging in collusive “sue and settle” lawsuits with advocacy organizations and political allies of the president in order to implement regulations and new requirements without public notice or participation in order to use taxpayer money to fund the budgets of liberal groups.

7. Treated Congress with contempt and did everything he could to evade its oversight responsibilities by misleading, misinforming and ignoring members of Congress and its committee.

There is no telling how long it will take to repair the damage that Holder has done to the Justice Department. History will not be kind to his legacy. As one former Justice Departmentemployee told us, in his opinion, “Holder is the worst person to hold the position of attorney general since the disgraced John Mitchell, who went to jail as a result of the Watergate scandal.”

Government Insider Warned of HealthCare.gov Security Risks: ‘I Am Tired of the Cover-Ups’

Government insiders who flagged security issues prior to the launch of HealthCare.gov were right to be concerned. That’s according to a new audit by the Government Accountability Office, which concluded that security weaknesses are putting “the sensitive personal information” contained by HealthCare.gov and its related systems at risk.

HealthCare.gov security problems put “sensitive personal information” at risk, @usgao concluded.

As the Obama administration prepared to launch the website last fall, one of those insiders voiced concern about the vulnerabilities and complained about “cover-ups” masking the severity of the problems.

The findings run counter to claims by Obama administration officials who have long insisted there’s no reason for any concern regarding the website’s security.

The news comes in advance of a House Oversight and Government Reform Committee hearing at 11 a.m. today examining the security vulnerabilities. GAO Director of Information Security Issues Greg Wilhusen will testify. His report concludes, “Until these weaknesses are addressed, the systems and the information they contain remain at increased risk of unauthorized use, disclosure, modification, or loss.”

Missing Information

As the GAO performed its security investigation, it did not receive full information from the government, according to Oversight Chairman Darrell Issa, R-Calif. He says that government officials refused to provide GAO with reports on 13 HealthCare.gov security incidents.

“What vulnerabilities to sensitive personal information is CMS still so intent on hiding from an independent government auditor?” said Issa in a statement issued Wednesday.

The GAO found that the Centers for Medicare and Medicaid Services (CMS), which runs HealthCare.gov, failed to “analyze privacy risks associated with HealthCare.gov systems or identify mitigating control.” The GAO also faulted officials for not performing comprehensive security testing and not ensuring that security plans contained all required information, “which makes it harder for officials to assess the risks involved in operating those systems.”

According to the GAO, the Department of Health and Human Services, which oversees CMS, agreed or partially agreed with GAO’s six recommendations “to fully implement its information security program” and “concurred with all 22 of the recommendations to resolve technical weaknesses in security controls, describing actions it had under way or planned related to each of them.”

Warnings Ignored

Serious security problems with HealthCare.gov were exposed in stories I reported for CBS News in November and December of 2013. They revealed that Teresa Fryer, the chief information security officer for the Centers for Medicare and Medicaid Services, explicitly recommended the website should not be launched Oct. 1, 2013, due to security concerns, but was overruled by her superiors.

“I am tired of the cover-ups,” a government security chief said of HealthCare.gov problems.

Fryer said she had warned, both verbally and in a briefing, that the website carried “high [security] risks” and possible exposure to “attacks.” Fryer also said that sherefused to put her name on a letterrecommending the website be given a temporary authority to operate while the issues were sorted out.

Additionally, Henry Chao, the CMS project manager in charge of building the website, was apparently kept in the dark about serious security failures. Those included “high-risk” issues, flagged by the government’s security testing firm, which indicated “the threat and risk potential [to the system] is limitless.”

‘Tired of the Cover Ups’

Meantime, internal documents newly released by Republicans on the Oversight Committee detail agency infighting and secrecy efforts surrounding the troubled launch of HealthCare.gov.

Fryer indicated that she was frustrated by fellow CMS officials who were not providing a true picture of security testing prior to the launch.

“I am tired of the cover-ups,” she emailed a colleague, stating that she intended to give “a truthful update of exactly what was going on” to an official at Health and Human Services who had asked for a status report.

When CMS’ independent security testing prior to launch produced negative results, documents indicate one CMS official sought to have the report changed.

“We need to hit the pause button on this report,” wrote CMS’ Thomas Schankweiler, “and have an internal meeting about it. … It is very possible that this report will be reviewed at some point by [the Office of the Inspector General], and could see the light in other ways.”

In an Oct. 5, 2013, email, CMS Administrator Marilyn Tavenner forwarded a subordinate a complaint from a White House adviser and then instructed, “Please delete this email.” Issa says that instruction violates federal record-keeping rules.

Tavenner is scheduled to testify at today’s Oversight Committee hearing.

U.S. threatened massive fine to force Yahoo to release data

The U.S. government threatened to fine Yahoo $250,000 a day in 2008 if it failed to comply with a broad demand to hand over user communications — a request the company believed was unconstitutional — according to court documents unsealed Thursday that illuminate how federal officials forced American tech companies to participate in the National Security Agency’s controversial PRISM program.

The documents, roughly 1,500 pages worth, outline a secret and ultimately unsuccessful legal battle by Yahoo to resist the government’s demands. The company’s loss required Yahoo to become one of the first to begin providing information to PRISM, a program that gave the NSA extensive access to records of online com­munications by users of Yahoo and other U.S.-based technology firms.

The ruling by the Foreign Intelligence Surveillance Court of Review became a key moment in the development of PRISM, helping government officials to convince other Silicon Valley companies that unprecedented data demands had been tested in the courts and found constitutionally sound. Eventually, most major U.S. tech companies, including Google, Facebook, Apple and AOL, complied. Microsoft had joined earlier, before the ruling, NSA documents have shown.
