As the race for three seats on the Bergen County Board of Freeholders winds down, campaign spending reports show that the three Democratic incumbents have raised nearly seven times more than their Republican challengers.
Democratic Freeholders Steve Tanelli, Tracy Zur and Thomas Sullivan had raised about $434,654 according to reports released on Thursday by the state Election Law Enforcement Commission.
Republican candidates John Mitchell, Ken Tyburczy and Daisy Ortiz-Berger had raised about $62,132 during the same period.
Democrats currently hold a 5-2 majority on the board. Republicans would have to sweep all three seats to regain control.
The reports show that Sullivan, president of Local 164 of the International Brotherhood of Electrical Workers, was the top fund-raiser among all the freeholder candidates.
His individual campaign reported $126,210 in contributions, many from labor unions such as the New Jersey Building and Construction Trades Council, which contributed $1,500.
Zur, a former municipal judge from Franklin Lakes, raised $98,430 and Tanelli, a former North Arlington councilman, raised $24,532.

WASHINGTON, D.C. – Rep. Scott Garrett (NJ-05), Chairman of the Financial Services Subcommittee on Capital Markets and Government-Sponsored Enterprises, today introduced H.R. 3798, the Due Process Restoration Act. This legislation will rein-in the Securities and Exchange Commission’s (SEC) controversial overuse of in-house administrative law judges (ALJs) and ensure that all Americans are given due process by allowing defendants the option of having their case heard before a federal court.
“Strong enforcement of the securities laws is an essential part of the SEC’s mission to protect investors and maintain a fair and efficient marketplace, but in recent years the agency has transformed into a veritable judge, jury, and executioner with its blatant overuse of their in-house courts,” said Garrett. “Every American has the constitutional right to defend themselves before a fair and impartial court, and the Due Process Restoration Act will go a long way towards protecting the rights of the innocent while maintaining the ability of the SEC to punish wrongdoers.”
The Due Process Restoration Act will:
Provide a mandatory right of removal allowing the defendant to request that the case be moved to a district court
Grant a right of removal to defendants who are subject to a cease and desist order and monetary penalty that the commission is seeking
Raise the burden of proof for cases that remain in the ALJ to a higher “clear and convincing evidence” standard
Background:
In the wake of the 2010 Dodd-Frank Act, which granted the SEC expanded administrative enforcement powers, the SEC started trying an increasing number of alleged wrongdoers before its in-house administrative panels rather than in the federal courts established by Article III of the Constitution.
The Wall Street Journal reported that from October 2010 through March of this year, the SEC won 90 percent of cases that came before SEC judges. In contrast, the SEC achieved less than a 70 percent outcome when the case is held in federal court. In addition to its success rate, the overall number of cases before the Commission’s in-house panels has increased nearly 75 percent over the past ten years.
The SEC has heard repeated criticism of these in-house panels from defendants who feel they weren’t given due process, former SEC judges who felt pressure to rule in favor of the Commission, and U.S. District Judges who find the panels unconstitutional.
The Commission recently announced that it will be giving more legal safeguards to defendants that come before its in-house administrative panels. Unfortunately, the SEC’s proposed changes fall well short of addressing many of these concerns and its enforcement practices continue to violate the separation of powers guaranteed by the Constitution.

Oakland — When leaving home and traveling to an unknown land, there often are myriad reasons why. Freedom. Opportunity. Even survival.
For Sandy Khabbazeh, it was all of the above. Leaving her home in Aleppo, Syria, and her parents and older brother was by no means an easy decision, but it had to be made.
“I would consider myself a strong person because I had a lot of difficulty when I got here,” said Khabbazeh at a panel discussion on the Syrian refugee crisis, held at Ponds Reformed Church on Oct. 6.
The panel discussion was organized so area residents could hear firsthand the dangers and difficulties of being a refugee. Its goals were to elicit their feelings about the crisis and ascertain what they and the government could do to help the refugees.
Khabbazeh is one of the estimated 9.5 million Syrians who have been displaced by the civil war that broke out in 2011. As many as 6.5 million remain internally displaced. Arriving in 2014 on a student visa, Khabbazeh is being hosted by Rev. Nathan S. Busker of Pond’s Church, who moderated the discussion.
“It was about a year ago this month that Sandy knocked on the side door here, where our offices are located, and asked just to come in and pray,” recounted Busker. “From that moment, we began to befriend Sandy and get to know her. In January, she moved in with my family and she’s been there since.”
Upon hearing Khabbazeh and Busker’s story, religious leaders such as Minister Nolan Psalma of Upper Ridgewood Community Church, Imam Mahmoud Hamza of the Muslim Society of Ridgewood and Imam Mohammad Moutaz Charaf of the Elzahara Education Foundation in Midland Park expressed solidarity across religious lines and hoped to help housing refugees through their respective clergies just as Busker has.
The church leaders looked to panelist Robert Pettet, district director for Rep. Scott Garrett (R-5th District), for answers on ways they and their clergies could help, citing the government roadblocks often faced in the sponsorship process.
“If there are folks that come here and are brought here in more than one sponsorship where there’s a group of individuals, it’s not the government’s responsibility, is it?” said Pettet. “It’s ours. Because we are the people.”
While most agreed with personal accountability, no direct answers on the individual sponsorship procedure were offered. Pettet acknowledged his own lack of preparation and emphasized community accountability for the issue. Residents and church leaders pressed the issue, reiterating that their churches are already willing to help.
“I agree with that 100 percent, but if the government doesn’t allow refugees to come, we cannot help,” said Psalma.

In a lawsuit that illustrates how inescapable surprise medical bills can be, a judge in Bergen County has sided with an anesthesiology practice that did not accept a patient’s insurance for emergency services at The Valley Hospital in Ridgewood and sued the patient for payment.
The judge found that the bill was reasonable and that the doctor had no obligation to figure out — “at midnight” — whether the patient’s insurance would cover the anesthesia she needed to deliver her baby.
Brenda Cristiano, who lives in Franklin Lakes, chose the hospital and her obstetrician because they participated in her insurance plan, Cigna. But when she needed an emergency cesarean section to deliver GianLuca in October 2014, none of the anesthesiologists at the hospital accepted Cigna.

Similar stories for two King’s Ponds
To the Editor:
What do the King’s Pond in Ridgewood and the King’s Pond in Franklin Lakes have in common? Both have been allowed to fall into disrepair due to years of inaction by both municipalities. The administrations in both towns have used the “kick the can down the road” approach to the maintenance of these ponds by refusing to plan and budget for the necessary repairs and restorations during their tenure. The result at this point is that both ponds are approaching swamp status.
The Franklin Lakes pond, which has never been dredged, has fallen into serious disrepair with low water levels, decaying vegetation and noticeable smell. Its pond is inaccessible due to overgrowth of foliage on its shoreline.
Similarly, the pond in Ridgewood has fallen in disrepair. It was last dredged in October 1999. Today, the water level in the center of the pond is five inches deep with vegetation protruding its surface. Access to the entire length of the pond existed in 2007. Today, the entire shoreline is overgrown thus denying access for fishing and viewing.
At least Franklin Lakes has finally taken action to resolve years of neglect for its King’s Pond by budgeting to dredge and restore the pond to its intended use.
To date, Ridgewood has done nothing to restore its King’s Pond to be worthy of its Wildscape status. After years of bringing this blight to the attention of past as well as the current administration, no plan or budget has been introduced to resolve this deterioration. Ridgewood’s lack of concern for these natural resources is irresponsible.
Both communities should be ashamed for allowing their inaction to promote this preventable deterioration.

“Brigadier General Abraham Godwin – Soldier, Statesman, artist, poet, engraver, musician and gracious host. Born July 16, 1763.
“His career began at the age of thirteen when his brother, David, aged eleven, he left home at Totowa to join Captain Woolverton’s Minute Men with the mother’s consent. The boys were musicians. Abraham playing a fife, David a drum. Their destination was a station at the corner of Partition and Horse and Cart Streets, New York City, now Fulton and William Streets. There the boys saw their father who had been commissioned Captain of Marines aboard the Lady Washington lying in port.
“Abraham went to Fishkill joining his brother, Captain Henry Godwin’s regiment, the Fifth of the Line, January 17, 1777, as a fife major.
“The regiment was ordered to Fort Montgomery to lay the chain across the Hudson River. He was in the Governor’s life guard at Schenectady protecting the frontier at Lake Otsego under General Sullivan during the Finger Lakes campaign and at Yorktown, where he witnessed the surrender of Cornwallis to Washington.
“After the war he married, settled in Totowa, now Paterson and devoted himself to the fine arts, and the pursuit of civil life; was elected to the Legislature 1803-07; Rose to Rank of Brigadier General New Jersey State Militia in 1814 marched a Company of Paterson volunteers to Sandy Hook was received with great acclaim and worked on the entrenchments; 1828 nominated for Presidential elector on the Jackson ticket.
“January 1st 1829 occurred the great event of interest to this community: its first name was Godwinville in honor of Abraham Godwin. This section covered Paramus, Newtown (Wortendyke) Midland Park, Ridgewood and Glen Rock and was known as Franklin Township.
“Godwin Avenue, formerly Godwinville Road is the only remnant of the honor conferred on him and was much cherished by Abraham Godwin.
“He passed to the greater life 1855.”

Everybody knows that Franklin Turnpike was named for the grand old man of the American Revolution, Benjamin Franklin, right?
You remember Ben, the heavyset guy who flew that kite in the electrical storm, who invented bifocals and the concept of the lending library. Ben, who told us: “They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety.”
Caution: Don’t bet on Ben. Truth is that the turnpike, an important north-south route through parts of Bergen County, was not named for Ben, not for Aretha, not for FDR and certainly not for Moe, who played 61 games for the Detroit Tigers in the early 1940s.
The Franklin in question was Ben’s illegitimate son, William, whose politics were far removed from his dad’s. Ben was part of the Colonial revolution. William was a staunch loyalist and, in fact, the Colonial governor of New Jersey for 13 years, appointed in 1762 by no less than King George III. It was during this period that the turnpike was developed and named for William. Franklin Lakes is also named for the former governor.
William made no secret of his loyalist leanings and his devotion to the king. And in William, King George clearly had a man he could trust. In William’s appointment, the king granted remarkable authority to his new governor: “We do hereby give and grant unto you full power and authority to suspend any of the members of our said council from sitting, voting and assisting therein if you shall find just cause for so doing.”
Later in the appointment document George said: “And you shall and may likewise from time to time as you shall judge it necessary adjourn, prorogue [discontinue] and dissolve all general assemblies as aforesaid.”

A Franklin Lakes man charged with falsely representing himself to police as a lawyer was formally indicted this week.
Mark J. McGuire, 53, told Ridgewood police last April he was an attorney representing “Real Housewives of New Jersey” stars Jacqueline and Christopher Laurita, authorities said.
McGuire was arrested by police in September, charged with a single count of unauthorized practice of law.
McGuire spent more than 45 minutes with the Lauritas as they were interviewed by police in April, following their involvement in a fracas at the grand opening of a salon in Ridgewood.
