Demarest NJ, a former employee of the Demarest Department of Public Works (DPW) has filed a lawsuit, claiming he was assaulted by three co-workers in 2022, leaving him permanently disabled. The civil suit, filed in Bergen County Superior Court last week, names the employees involved as well as the Demarest DPW, alleging that the department failed to maintain a safe work environment.
The Alleged Incident
According to the lawsuit, the incident occurred on November 15, 2022, on Ross Avenue, a residential street in Demarest. Giancarlo Villena, the former employee, claims that while working in the area, he was “suddenly and unexpectedly” attacked by three co-workers. The alleged assault has left Villena suffering from ongoing “permanent pain, suffering, and disability.”
The lawsuit argues that the Demarest DPW had a responsibility to ensure a safe workplace, free from “hazardous and dangerous conditions.” Villena also claims that the department “tolerated and ratified” the use of physical force among employees, suggesting a broader issue of mismanagement and lack of oversight within the department.
Failure to Screen and Train Employees
The lawsuit further accuses the DPW of negligence in the hiring and training of employees and management personnel. Villena alleges that the department failed to properly screen its workers and did not provide adequate training to prevent such incidents from occurring.
Lasting Impact on Villena
Since the alleged assault, Villena has been dealing with significant medical expenses, according to the lawsuit. The injuries sustained have not only caused him physical pain but also limited his ability to work and perform everyday tasks. The suit claims that he has been unable to attend to his “occupations, duties, activities, and business” due to the long-term effects of his injuries.
Seeking Justice
Villena’s lawsuit seeks compensation for medical bills, lost wages, and the physical and emotional toll the incident has taken on him. The case also sheds light on the importance of workplace safety and proper employee training, especially in departments like public works, where physical labor and potential hazards are part of the job.
