Ridgewood Water Litigation ;the Good, the Bad, and the Ugly

Ridgewood NJ, Mayor Hache fills us in on all the details and where we stand . Since 2010, the governing bodies of the three communities outside of Ridgewood served by Ridgewood Water (Gen Rock, Midland Park and Wyckoff) have been engaged in a law suit, which challenged the allocation of expenses by the Village for the water company’s budget. The 3 towns felt that a 21 percent increase in rates in 2010 was excessive. The actual rate per 1,000 gallons is not excessive and, in fact, is in the lower middle of rates offered by other neighboring water utilities and still much cheaper than Suez. The challenge was started by the governing body of Wyckoff, whose auditor is a member of the former auditing firm of the Village when similar allocation methods procedures were used by the Village for the Water Utility budget. The claim argued that the methodology used by the Village in allocating percentages of Village expenses to the Water Utility was unfair (since it was not actual expenses) to the 3 towns and it caused the rates for water usage to be unreasonably excessive to the rate payers of the 3 towns and those rate payers were subsidizing the property taxes of Village residents.


The methodology used by the Village had been accepted by the Local Finance Board of the State in 2004, and the Village continued using that method throughout the years. This litigation which was started in 2010 (and amended in each of 2011 & 2012), finally reached trial in 2017. The trial court decided that the ordinances which approved rate increases in 2010, 2011 and 2012, did not have an adequate factual basis in the record that would warrant the rate increases that were adopted by the Village. As a result, the Court required the Village to hire an expert to calculate what the appropriate rate increases for the years in question should have been.
The Village (while still disagreeing with the Court’s decision that the record lacked an adequate factual basis), complied with the preparation of the rate study by hiring the most qualified expert in the field of water rate studies, Howard Woods. Mr. Woods completed his rate study and has recognized that the Village did not adopt excessive rates during those years challenged by the 3 towns.

The three communities decided to appeal the Court’s decision, and that appeal is pending; the Village cross-appealed on those issues raised by Plaintiffs. Their requests to stay the rate study pending the outcome of the appeal has been denied (at least for now) by the trial Judge. The rate study was presented to the Village Council in early 2018. The Village Council adopted an ordinance to adopt rates established by the Woods study, with the purpose of establishing rates for the years of 2010 through 2017.

Between now and February 14, 2019, the non-profit organization is collecting pajamas that are sizes newborn to adult, all genders, cotton only, and new with tags. School Bus Explodes in Flames in Glen Rock

Glen Rock NJ, Flames completely engulfed a van used to transport school children just moments after all of the children and their driver had been safely evacuated to a nearby strip mall on Thursday afternoon, 01/24. The raging fire was extinguished by members of Fair Lawn Fire Department Fire Companies 2 & 4, Fair Lawn Heavy Rescue, Bergen County Hazmat, Glen Rock Police , Glen Rock Fire Department, and Fair Lawn Fire Department also responded to the incident which was located in the parking lot of an office building at 266 Harristown Road, Glen Rock.

GLEN ROCK BANS OVERNIGHT STREET PARKING DUE TO WINTER STORM

DUE TO EXPECTED WEATHER CONDITIONS NO OVERNIGHT PARKING WILL BE PERMTTED THROUGH MONDAY 1/21

Glen Rock NJ, Due to expected weather conditions beginning tonight no overnight parking will be permitted on any Borough roadway or public parking lot. Those with parking issues should make arrangements with a neighbor or other private property owner to park their vehicles off the street on private property. This will remain in effect through Monday January 21st to allow DPW crews to address road conditions.

All of Glen Rock’s emergency services and DPW are on standby to provide whatever assistance may be necessary as the expected weather conditions progress.

Motorcyclist Sustained Non Life Threatening Injuries after colliding with a Car in Glen Rock

Glen Rock NJ, A motorcyclist sustained non life threatening injuries after colliding with a passenger vehicle at the intersection of Beekman Place and Prospect Street, Glen Rock on Friday morning, 01/04. Glen Rock Police and Glen Rock EMS rushed to aid the adult male victim. He was transported by ambulance to Hackensack University Medical Center’s main campus. Both vehicles involved in the crash were removed from the scene by a flatbed tow truck. Glen Rock Police reportedly issued one (1) crash related summons.

Rollover Crash following a high speed Chase by Fair Lawn Police

Glen Rock NJ, A rollover crash following a high speed pursuit by Fair Lawn Police took place on the evening of Tuesday, 01/01 at the intersection of Gibson Place and Godfrey Terrace, Glen Rock. One (1) suspect in the vehicle was taken into custody by Fair Lawn Police and transported by a Glen Rock EMS ambulance to The Valley Hospital. A paramedic team from The Valley Hospital assisted Glen Rock EMTs with patient evaluation. A possibility exists that two (2) suspects from the incident triggering the pursuit may still be at large.

Glen Rock NJ, Two (2) injuries were reported following a two (2) vehicle, Tuesday afternoon, 01/01, collision at the intersection of Rodney Street and South Maple Avenue, Glen Rock. Glen Rock Police, Glen Rock EMS, and a paramedic team from The Valley Hospital responded to aid the victims, both of whom were occupants of a 4-door sedan that slammed head on into a utility pole. One (1) vehicle was removed from the scene by a flatbed tow truck.

Glen Rock NJ, from the Glen Rock Police department ; We received word that the Hawthorne Police Dept has received many telephone calls at their Police Headquarters reporting that residents are receiving calls from people claiming to be from Social Security, stating there is a problem with thier accounts and they need to contact SS Office, or a Police Officer will call them. This is a SCAM, Social Security is not calling asking for info.

Never provide INFO, please advise friends, family and neighbors especially the elderly as they may be easy target.

Ridgewood , Hawthorne and Fair Lawn Fire Departments Assist Glen Rock Fire Department for Basement Fire in Glen Rock

Glen Rock NJ,A Thursday evening, 12/06, basement fire in a single family home located at 562 South Maple Avenue, Glen Rock, injured at least one (1) firefighter and required the services of several neighboring fire departments to extinguish. Glen Rock Fire Department was assisted by personnel from Ridgewood Fire Department  , Fair Lawn Fire Department , and Hawthorne Fire Department at the scene. Glen Rock Police and Glen Rock EMS also responded. The cause and exact origin of the blaze is currently under investigation.

Glen Rock NJ, Mayor Bruce Packer commented on Facebook New Jersey’s effort to Legalize Marijuana , “I realize that this is quite a hot button issue in our state so if you are not aware, the NJ Senate and Assembly will be holding a joint hearing on Monday on Senate bill 2703, the New Jersey Cannabis Regulatory and Expungement Aid Modernization Act.
Any legislation will include an ‘opt out’ provision that would allow municipalities to opt out of the legal sale of marijuana. This is a complicated and ever changing issue and any questions or comment should be directed to our state legislators.As far as Glen Rock is concerned, it is premature for us to make any decisions with regard to opting out but we will have plenty of time to have that discussion once we know what happens at the state level.
The banning ordinances that were passed in many municipalities to date have no impact on the potential ‘opt out’ provision and are, effectively, meaningless from a legal perspective. We will all have to go through the same process to opt out if the state legislation is passed, irrespective of any ordinances that were passed prior to the new law.”
