New Brunswick NJ, on Jan. 10, attorneys for Children’s Health Defense (CHD) filed an appeal in the United States Court of Appeals for the Third Circuit challenging the New Jersey District Court judge’s Sep. 22, 2022 dismissal of CHD’s Aug. 16, 2021 lawsuit against Rutgers and university officials for their COVID-19 vaccine requirement for students to attend classes, whether in person or remotely. The mandate that began at the start of the 2021 Fall semester now requires full vaccination and boosters for students, faculty and staff.

Washington DC, The Supreme Court on Thursday temporarily blocked the Biden administration’s vaccine-or-test mandate for large employers, but upheld the vaccine-only mandate for health providers.
The Court ruled 6-3 against the Occupational Safety and Health Administration’s employer mandate, blocking it from taking effect while other legal challenges play out.
The Court ruled 5-4 to keep the health care worker mandate, with Chief Justice Roberts and Brett Kavanaugh joining the liberals.

Washington DC, the United States’ “vaccine mandate”* was put on hold following a ruling by a 3-judge panel of the 5th US Circuit Court of Appeals. The panel concluded that the mandate, an Emergency Temporary Standard (ETS) issued by the Occupational Safety and Health Administration (OSHA) that generally applies to companies and organizations with 100 or more employees, is “staggeringly overbroad” and does not sufficiently account for variations in working conditions and environments. The panel concluded that the policy should be suspended until the case can be argued in court. Lawyers from the Biden Administration appealed the initial panel ruling, arguing that a delay in implementing the mandate could result in many unnecessary deaths, but the judges upheld the initial decision. In its ruling, the panel described the policy as “fatally flawed” and indicated that lawsuits aiming to overturn it “are likely to succeed on their merits,” which suggests that the White House could face an uphill battle to institute the mandate in January.

Despite Emergency Stay The Biden Administration said Employers Should Move Forward with the Vaccine Mandate

Washington DC, the Biden administration  on November 5 released an interim final rule regarding SARS-CoV-2 vaccination for private employers with 100 or more workers in an effort to increase vaccination rates among the US population. The next day, the US Court of Appeals for the Fifth Circuit in New Orleans granted an emergency stay of the federal Occupational Safety and Health Administration (OSHA) temporary emergency rule that employees of those companies be fully vaccinated by January 4 or be required to undergo weekly testing, although it is unclear whether the stay is applicable nationwide or only in those states under the court’s jurisdiction.* According to the 3-judge panel, the petitioners bringing the request—including 5 states, all led by Republican governors, and various companies—”give cause to believe there are grave statutory and constitutional issues with the Mandate.”

Governor Murphy Announces Vaccine Mandate for Workers in Health Care Facilities and High-Risk Congregate Settings

Trenton NJ, Governor Phil Murphy today announced that all workers in certain state and private health care facilities and high-risk congregate settings will be required to be fully vaccinated against COVID-19 or be subject to COVID-19 testing at minimum one to two times per week. This requirement will help increase protection against the spread of COVID-19, including the highly transmissible Delta variant, to vulnerable populations who have been hardest hit during the pandemic.
